Creator An entity primarily responsible for making the resource النعيمي , زهراء صبحي خليل Date A point or period of time associated with an event in the lifecycle of the resource 2023-03-14 Description An account of the resource مما لا شك فيه أن الغاية من فرض الضريبة هو إشراك المكلفين في الأعباء العامة كل حسب مقدرتهم التكليفية، إلا أنه في بعض الأحيان تحصل عدة إشكاليات في تطبيق الضريبة مثل أن تفرض أكثر من ضريبة على نفس الوعاء الضريبي ما يطلق عليه مصطلح الازدواج الضريبي. كما قد يلجأ بعض المُكلّفين إتباع أساليب معينة بقصد تهريب أموالهم كلياً أو جزئياً من الضريبة، وهذا ما يطلق عليه بالتهرب الضريبي، وأخيراً قد يلجأ المكلف إلى استرداد الضريبة التي دفعها للخزانة العامة من شخص آخر، وهو ما يطلق عليه بالانعكاس الضريبي. ان النظام الضريبي في الواقع هو صياغة وترجمة عملية لسياسة الضريبة في المجتمع من أجل تحقيق اهدافها التي تتمثل عادة في تحقيق حصيلة ضريبية ملائمة لتمويل برامج موازنة الدولة، اضافة إلى رفع مستويات الكفاءة الاقتصادية في استغلال الموارد الاقتصادية المتاحة، والتخفيف من مشكلات عدم الاستقرار الاقتصادي ومن ثم تحقيق العدالة في توزيع الدخل القومي بين أفراد المجتمع، كما أن الضريبة تعد من اهم المصادر المالية للدولة لتحقيق التنمية الاقتصادية. مهما اختلفت صورها عبئا على المكلف، ولهذا يسعى جاهدا للتخلص منها بأية وسيلة إذا اخفقت محاولاته في نقل عبئها على الآخرين، ومع توسع نطاق وانواع الضرائب نتج عنه ظاهرة خطيرة هي ظاهرة التهرب الضريبي، وبسبب أهمية هذا الموضوع فإننا سوف نتناول مسألة التهرب الضريبي وفاعلية النصوص القانونية في مكافحته، تحتل الضرائب في كل دول العالم، كمورد سيادي مركز الصدارة بالنسبة للإيرادات العامة في الدولة التي تدخل في الخزانة العامة للدولة. وهي وسيلة رئيسة يمكن للدولة اعتماد أموالها لأداء وظائفها اليومية وتمويل مشاريعها ومرافقها العامة، بغية تقديم أفضل الخدمات لعموم أفراد المجتمع.  كما تعد الضرائب محل اهتمام معظم دساتير دول العالم، ولها تشريعات خاصة تنظم أحكامها من حيث فرضها وتقديرها والطعن أمام الجهات المختصة، وهذا دليل على مدى أهميتها كإيراد عام وما تحمله في ثناياها من أهداف تسعى إلى تحقيقه كل دولة في سياستها المالية والضريبية، ولعل من أهم الضمانات التي تحقق العدالة الاجتماعية والضريبية وجود جزاءات جنائية مقابل مخالفة المكلف لأحكام القانون الضريبي. ويتجه الفكر الحديث في تحديد الأساس القانوني في فرض الضرائب والقيام بجبايتها إلى أن حق الدولة في ذلك ينبع من فكرة التضامن الاجتماعي، والتي تقوم على أساس تضافر جهود الأفراد في تحمل الأعباء العامة، بحيث يتاح للدولة، على أساس أنها ضرورة اجتماعية، حماية المجتمع، توفير الخدمات العامة لجميع المواطنين بغض النظر عن مساهمة كل منهم في الاعباء العامة، لذلك على الدولة بما تملكه من سيادة وسلطان أن تلزم الأفراد بدفع ما يترتب عليهم من ضرائب.
