يُشكٍّلُ العقار الوقفي أحد الآليات الفاعلة التي أثبتت مساهمتها في دفع عجلة التنمية الاقتصادية لاسيما في ظل الانفتاح الاقتصادي الذي رافقه فتح المجال واسعا أمام الاستثمار الوطني والأجني باعتباره أداة لتنمية وتثمين الأملاك الوقفية وضمانة للمحافظة على ديمومتها وحركيتها بما يعود بالنَّفع على الفرد والمجتمع.
وقد أولى المشرع الجزائري مؤخرا أهمية قُصوى للاستثمار في هذا النوَّع من الأملاك الوقفية من خلال تطوير البنية التشريعية المؤطرة لعملية استغلالها لاسيما تلك الموجهة منها لإنجاز مشاريع اقتصادية سعيا منه لتحقيق التنمية الاقتصادية واستقطاب اليد العاملة تزامنا مع الأوضاع الرَّاهنة التي تشهد تزايُدا على سوق العمل ، وهو ما جسَّده المرسوم التنفيذي رقم 18/213 الذي عُدَّ منعرجا حاسما في تجسيد البعد الاستراتيجي لاستغلال العقارات الوقفية العامَّة الموجهة لإنجاز مشاريع استثمارية.
انطلاقا من هذا الطرح تهدِف هذه الورقة البحثية إلى تقييم مدى مساهمة استثمار العقارات الوقفية الموجهة لإنجاز مشاريع استثمارية في تثمين الأملاك الوقفية وتنميتها .
The endowment real estate is considered as one of the most active mechanisms that has proved its contributions in the economic developement mainly in the light of economic openess which accompanied the vast national and foriegn investement which are considered as tools of development and the valuation of endowment properties through the development of the ligislative operation of endowment and its garantee for the sake of the preservation of its permanence and mobility for the benifit of the individual and the society as well .
The algerian lisgislator has recently been aware about the importance of the investement in this type of properties through the development of the ligislative structure which conducts its exploitation mainly those which are oriented to for the of achievement of the economic projects for the sake of the development and the attraction of the handlabour conciding with the recent circumstances .which is embodied by the executive decree number : 18/213 tha is considered as a crucial changing point in the imbodiment of the strategic dimensions of general endowment meant for the achievement of invested projects .
Based on this proposal, this research paper aims to assess the extent to which the investment of waqf properties directed at the completion of investment projects contributes to the valuation and development of waqf properties

يتمتع الوقف بالشَّخصية المعنوية والاستقلال المالي، ويترتب عن ذلك ثبوت الأهلية الكاملة له في حدود عقد إنشائه، فله حق التصرف والتعاقد مع أي طرف، شأنه في ذلك شأن أي شخص معنوي آخر، لذا قد يتعرض الوقف لحالة الغبن أو الاستغلال، سواء بتواطؤ الناظر و الطرف المتعاقد معه أو من أحدهما أو من أي جهة كانت، لذا كان لا بد من مراقبة هذه العقود لحماية الوقف من النهب والسرقة.
فعقود الوقف تتشابه إلى حد كبير مع العقود الإدارية الصادرة عن الإدارة، وذلك بحكم أن الهيئة المشرفة عليه هي إدارة عمومية من أشخاص القانون العام، لذا كان لزاما تحديد طبيعة عقود الوقف من حيث أنها عقود مدنية أو عقود إدارية، وذلك من أجل تحديد جهة الاختصاص القضائي.
فهي عقود مدنية، على اعتبار أن مؤسسة الوقف تتمتع بالشخصية المعنوية وبالذمة المالية المستقلة عن ذمة مسيِّريه، فهو في نظر القانون من أشخاص القانون الخاص، لذا فالقاضي المدني هو صاحب النظر فيها وما ينشأ عنها من نزاعات.
و يهدف هذا البحث إلى معرفة مدى صلاحيات القاضي المدني في مراقبة عقود الوقف، وكان من نتائجه؛ أن القاضي المدني ليس له السلطة المباشرة في الرقابة إلا بعد طلب من أصحاب المصلحة في ذلك، و يمكن له إبطال أو تعديل العقود الذي قد يكون تعديلا تشريعيا بموجب نصوص تشريعية عامة كالقانون المدني أو خاصة المتعلقة بالأوقاف، أو يكون تعديلا قضائيا بموجب السلطة التقديرية المخولة للقاضي بنصوص صريحة.
The endowment enjoys moral personality and financial independence, and this results in proving its full capacity within the limits of its establishment contract. Therefore, it was necessary to monitor these contracts to protect the endowment from looting and theft.
Endowment contracts are very similar to administrative contracts issued by the administration, due to the fact that the body supervising it is a public administration of public law persons, so it was necessary to determine the nature of endowment contracts in terms of civil contracts or administrative contracts, in order to determine the jurisdiction .
They are civil contracts, given that the endowment institution enjoys a legal personality and financial liability independent of its managers. In the eyes of the law, it is a private law person, so the civil judge is the one who considers it and the disputes arising from it.
This research aims to know the extent of the civil judge's powers in monitoring endowment contracts. That the civil judge does not have the direct authority in oversight except after a request from the stakeholders in that, and he can invalidate or amend contracts, which may be a legislative amendment under general legislative texts such as civil or private law related to endowments, or it is a judicial amendment under the discretionary power granted to the judge with explicit texts.

رغم النص على تحريم التبني شرعا وقانونا في العديد من الدول الإسلامية، إلا أننا نجد البعض منها أقرت صحته وترتيب آثاره في بعد القانون الدولي الخاص، وذلك تحسبا لوجود العنصر الأجنبي المقيم في إقليمها، كما فعل المشرع الجزائري من خلال المادة 13 مكرر 1 من القانون المدني الجزائري، وعليه بات من الممكن اللجوء إلى القاضي الجزائري للوقوف على صحة العلاقة عند المنازعة بشأنها، وصار بإمكان ذوي المصلحة التمسك بآثار هذه العلاقة أمامه.
وإزاء هذا الموقف الغريب من المشرع الجزائري برزت إشكالية الدفع بالنظام العام في مسألة التبني سواء في الإقرار بصحته أو ترتيب آثاره، خاصة إذا علمنا أن التشريع الداخلي لدولة القاضي حرم التبني شرعا وقانونا من خلال المادة 46 من قانون الأسرة الجزائري، ومن جهة أخرى حتى ولو فرضنا ان العلاقة نشأت صحيحة في بلدها المقر بها فالأكيد أنه يترتب عليها آثار وحقوق، وهنا تطرح فكرة الحقوق المكتسبة الواجبة الاعتبار في بُعد القانون الدولي الخاص، لكن من شأن هاته الحقوق المساس بمبادئ المجتمع كموانع الزواج والإرث والنفقة فما مصير فكرة الدفع بالنظام العام في مسألة التبني عموما؟
Despite the text prohibiting adoption in many Islamic countries, we find that some of them have been validated in private international law, as the Algerian legislator did through Article 13 bis 1 of the Civil Code. Accordingly, stakeholders can adhere to the effects of this relationship before the Algerian judge. The strange position of the Algerian legislator The problem of pushing public order in the matter of adoption arose, especially since he prohibited adoption through Article 46 of the Algerian Family Code. Here the idea of acquired rights is raised in the dimension of private international law, which affects the principles of society, so what is the fate of the idea of pushing public order in the issue of adoption generally?

This paper is a detailed study on smart contracts, which represent a transition from normal language to code language (in terms of definition, pillars, conditions, up to judgment); This is because the fatwa changes due to the change of circumstances, conditions and persons, since Islamic sharia is valid for all times and places, it is of great importance for researchers in Islamic fikeh to counter this development as a serious issue of fikeh; which is the contracts issue.
This research is among those efforts, which focuses on conditions, and then dropping them on this type of contracts to know the Islamic judgment.

من القضايا المهمة التي يركز عليها المستشرقون، استمداد الأحكام الشرعية في الشريعة الإسلامية من الديانات والحضارات التي سبقت الإسلام، حيث تبحث هذه الدراسة مدى صحة الدعوى التي تبناها ثلاثة من كبار المستشرقين: د.ل. أوليري، ن.ج. كولسون، إ. جولد تسيهر حول استمداد نظام المواريث الإسلامي من نظم الديانات والحضارات التي سبقت الإسلام. وهل هناك تطابق أو تشابه بين النظام الإسلامي للميراث وما سبقه من النظم. وقد خلصت الدراسة إلى أن تلك الدعاوى التي رفعها المستشرقون تفتقر إلى الدقة والموضوعية؛ ويكذبها واقع التباينات الهائلة بين أحكام الميراث الإسلامية، وبين نظم الميراث في الديانات والحضارات التي سبقت الإسلام.
This study seeks to examine the veracity of the view adopted by three of the greatest scholars: I.Goldziher, N.J. Coulson, and D.L. Oleary, which revolves around deriving the Islamic inheritance law from the law system of diverse religions and civilizations preceding Islam. And if there is a possibility for similarities or correspondences; between the systems of inheritance law, in Islam, and the systems that existed before its revelation. The study concluded that this point of view presented by the scholars is missing accuracy and objectivity, proven by the huge disparities between the Islamic inheritance law and the other inheritance laws known in the different religions and civilizations preceding Islam.

في محاولة لإيجاد ضوابط تقلل الجدل الحاصل بين المجتهدين المعاصرين في مسألة استقلال المقاصد عن علم أصول الفقه، وتحقيقا لهدف تجديد رصين لعلم الأصول بما يؤهله لمجابهة ما يستجد، تتبعت وجهات نظر كل رأي في المسألة ومستنداته والانتقادات الموجهة إليه، وذلك بالإجابة عن الإشكال الآتي: هل يمكن أن تنفصل المقاصد عن علم الأصول؟ وما الضوابط التي تقلل من حدة الجدل الحاصل بسبب ذلك؟
وتوصلت إلى أن دعوى الفصل بين الفنين لا تحقق المطلوب، ولا سبيل إلى تجديد مثمر في علم الأصول إلا بمراعاة تكاملهما ووفق جملة من الضوابط.
In an attempt to find controls that reduce the controversy among modern hard-workers on the issue of independence of Makassed from the science of Origins, I traced the views of each opinion on the issue, its documentation and Implications, by answering the following problem: is it possible to separate Makassed from the science of Origins? What are the controls that reduce the intensity of the controversy that occurs because of this?
I came to the conclusion that the lawsuit for the separation of Makassed from the science of assets does not achieve the desired, and there is no way for a fruitful renewal in the science of assets only taking into account their complementarity and in accordance with a number of controls.

يتميز العصر الحاضر بسطوة المعلومة على كافة أنشطة الإنسان حتى صارت تستغرق كل وقته إما إرسالا أو استقبالا أو تفاعلا.
وانسجاما مع شمول المعلومة لكافة مجالات الحياة والحاجة الماسة والدائمة إلى تداولها فقد تفرعت أشكال متنوعة من الخطاب يغطي كل منها جانبا من المعلومة متصل بجانب من الحياة، وفي هذا السياق ظهرت فكرة الخطاب الإشهاري باعتباره تناولا للكيفية التي تسوق بها المعلومة في شكلها المعنوي النظري أو المادي السلعي.
ضمن هذا المنظور يسعى هذا المقال إلى لبيان مفهوم الخطاب الإشهاري من مختلف وجهات النظر ثم التطرق إلى بعض المحددات الثقافية التي تحكمه وتوجه مساره وذلك باعتماد قراءة معرفية تتناسب مع الموضوع.

نسعى من خلال هذه الدراسة أساسا إلى تبيان مدى فعالية أنشطة العلاقات العامة الرقمية في مجمع سيفيتال لصناعة الزيوت والمواد الدسمة و تكرير السكر. وهذا من خلال تحليل مضمون جميع المنشورات المتضمنة و المتاحة في الصفحة الفيسبوكية الرسمية الخاصة بالمجمع طيلة سنة 2021.و هو ما سمح لنا بالوصول إلى عدة نتائج أهمها:
تركز الصفحة الفيسبوكية الخاصة بالمجمع على وضع المنشورات بمعدلات مختلفة من شهر لآخر تبعا لما تقتضيه طبيعة نشاط المجمع وكذا ظروف المجتمع، معتمدة في ذلك على أسلوب النص مرفقا بالصورة موظفة اللغة العربية الفصحى إلى جانب اللغة الفرنسية كلغة أساسية في عرض المنشورات مراعية بذلك خصوصية الجمهور الذي يتوجه له المجمع. و مركزة على بعد الإعلانات في المواضيع المتناولة إلى جانب أبعاد أخرى لا تقل أهمية عن هذا البعد و هادفة إلى التسويق بمنتجاتها كهدف أساسي إلى جانب هدف خدمة صورة المؤسسة هذا إلى جانب بروز قيمة التشجيع على الاقتناء كهدف رئيسي لها كمجمع منتج.
This paper seeks to shed light on the effectiveness of the digital public relation activities in civital complex for the manufacture of oils,fats and sugar refining.
Throw the analisis of the official facebook page content belonging to the complex during the year of 2021. We have found that the page bases on putting publications with different RATES from a month to another depending on the nature of the complex’s activity as well as the conditions of the society , using the text attached to the image with arabic and french language as the main language used in the presentation of publications taking into account the privacy of the audience to which the audience to which the complex is headed .focussing on the dimension of the advertisements in the subjects covered as well as other dimentions which are equally importent and aimed at marketing its products as a primary objective along with the purpose of survicing the image of the organization and the value of promoting.

يعتبر موضوع القيم من الموضوعات البارزة التي تعرض الكثير من المسائل الشّائكة حول خصائصها وتصنيفاتها وعلاقاتها في واقع تتنوع ظواهره الاجتماعية وتتداخل عواملها لدرجة يصعب معها التّحكم في مجرياتها، ولعل من أبرز تلك الظواهر وأكثرها ارتباطا بالقيم ما يعرف اليوم بالتّواصل بين الثّقافات، بكل ما يحمله من إشكالات تطرح على مستوى التّفاعلات الاجتماعية التي تشكل العلاقات البشرية، لتتعدد جدليات التّواصل المستمرة والمعقّدة في عالم مشبع بالاتّصالات والتّقنيات حول أنجع الطرق لجعله أداة للتّفاهم والتّعايش لا الصّراع والخلاف.
إن الحديث عن ظاهرة التّواصل بين الثّقافات ليس بالأمر الجديد، إلا أن مساره كذلك، نظرا لتغير الظّروف والإمكانيات المتاحة على المستوى العالمي، وسيطرة التّكنولوجيا الحديثة على عقول وذهنيات المجتمع الإنساني، وظهور شبكات التّواصل الاجتماعي التي جعلت الاتّصال يتعدى حدود الزمان والمكان، فارتفعت أصوات متعدّدة المشارب تنادي بإعادة النّظر في بناء تلك العلاقات، ومراجعة القيم التي تتحكم في مجرياتها. وظهرت كتابات تبحث في السّبيل الأمثل لتفعيل هذه العملية وإصباغها بالقيم المناسبة التي تحقّق فعاليتها ونجاعتها، وتصل بها إلى المستوى الذي يتحقّق معه النّفع والأمن لجميع الأطراف، خاصة في ظلّ هذا الواقع الذي أنهكه الصّراع في كثير من المحطّات، ولم يعتريه التّقارب إلا في حالات محدودة.
من هنا جاءت هذه الدّراسة التي تستند على رؤى وخلفيات علميّة تبحث في أبرز القيم الإنسانيّة التي يجب أن يتحلّى بها التّواصل بين الثّقافات في الفضاء الرقمي، حتى تتجاوز مرحلة تعميق الخلافات إلى مرحلة احترام الاختلافات.
The topic of values is considered one of the prominent topics that presents many thorny issues about their characteristics, classifications and relationships in a reality whose social phenomena are multiple and whose factors overlap to the extent that is difficult to control their course.
Perhaps one of the most prominent of these phenomena and the most intertwined with the term values is what is known today as intercultural communication with all the problems it poses at the level of social interactions that make up human relationships, due to the multiplicity of continuous and complex communication polemics in a world saturated with communication and technologies about the most effective ways to make it a tool for understanding and coexistence , not conflict and discord
Talking about the intercultural communication phenomenon is not something new , due to the circumstances and possibilities available at the global level, the control of modern technology on the minds and mentalities of human society,and the emergence of social networks that made communication transcend the bounderies of time and place. For this reason, many voices have risen calling for a review and reconstuction of the values that control their course.
Writings were appeared looking for the best way to activate this process and paint it with appropriate values that would achieve its effectiveness and efficiency and bring it to a level that achieves benefit and security for all parties, especially in light of this reality that has been exhausted by the conflict in many stations, and rapprochement in some of them only.
From here came this study, which is based on scientific visions and backgrounds,looking at the most prominent human values that intercultural communication in the digital space must possess, in order to go beyond the stage of deepening differences to the stage of respecting differences

تهدف هذه الدراسة إلى الكشف عن كيفية المعالجة الإعلامية للأزمة الأوكرانية الروسية في قناة الجزيرة الإخبارية من خلال برنامج "ما وراء الخبر"، وذلك للتعرف على حجم اهتمامها في تناول الأزمة، ودراسة استراتيجية القائم بالاتصال في بناء برنامجه المتضمن رسائل إعلامية موجهة للمشاهد، كما كشفت الدراسة عبر تحليل أطر المعالجة الإعلامية للأزمة الأوكرانية الروسية عن اتجاه قناة الجزيرة الإخبارية المفاوض والمتعاطف والمقنع بالمعلومات عن طريق طرحها للأسئلة وتحويلها بين الضيوف من أجل تفسيرات لمجريات الأزمة وإعطاء حلول ونظرة استشرافية لها، حيث كان ضيوف البرنامج بين المؤيد والمعارض والمحايد ، كما توصلت الدراسة إلى أن البرنامج قد وظف قوالب إعلامية منها الخبرية والتقريرية لإثراء البرنامج الحواري، كما دعم البرنامج مجريات الأزمة باستضافة شخصيات سياسية وعسكرية وأكاديمية لمعالجة الأزمة إعلاميا، كما خلصت الدراسة باستنباط القيم الإخبارية المتمثلة في الحداثة والآنية، الإثارة، الصراع، والاهتمامات الإنسانية من خلال تحليلنا الضمني للبرنامج.
This study aims to reveal how the media handles the Ukrainian-Russian crisis in Al Jazeera News Channel through a program " Behind The News ", to see how much it cares about the crisis, Examination of the contact person's strategy in building his program containing media messages for the viewer .The study also revealed, through an analysis of media treatment frameworks for the Ukrainian-Russian crisis, the negotiating, sympathetic and informative direction of Al Jazeera News Channel by asking questions and shifting them among guests in order to explain the course of the crisis Give solutions and a forward-looking look, as the program guests were between supporter, exhibitor and neutral. The study also found that the program had employed information templates, including expertise and reporting, to enrich the talk show, The program also supported the crisis by hosting political, military and academic figures to address the crisis in the media, The study also concluded by inferring the news values of modernity, prestige, excitement, conflict, and human concerns through our implicit analysis of the program.
