This study reveals the truth of the modernist Maqasid discourse, its objectives, foundations, sources, characteristics, and reasons for its influence. It is comparing it with what was mentioned in the moderate Islamic maqasid discourse. This study included critiquing its mistakes in justice and fairness. The study followed a descriptive, inductive analytical approach in presenting its material. It concluded that the modernists exaggerated the promotion of the maqasid to exploit them in wasting the legal texts that oppose modernist ideas. In addition,they employ some legal texts in a utilitarian manner. Moreover, they exploit some of the theories of jurisprudence. Emphasizing a number of western foreign curricula on Arab legal texts;  The predominance of ignorance over the modernists, blind imitation of Westerners, and the lack of reliance on the predecessors’ interpretation texts are the main reasons for their deviation. The transition to a green economy based on renewable energy has become a major goal for some Arab countries, including Morocco in a particular way. Where investment in renewable energies is baccalaureate that contributes to preserve the environment and this is what the study seeks to. In this study, the analytical descriptive approach was adopted, and many available studies were examined. It was concluded that the state of Morrocco has completed a series of reforms in order to improve the integration of the environmental dimension, but despite its interest in renewable energies as clean and alternative fossil energy, all the evidences show that renewable energy will not be able to play this role at this time because of the difficulties facing the technology of renewable energy. Therefore, the high cost of investment, despite this, Morrocco is spending great efforts within the framework of renewable energy to move towards the green economy. The paper deals with contract contradiction in the maliki doctrine and its effects on the financing contracts. when two contracts are inconsistent and contradictory in nature and run counter to tenets and teachings. they cannot gathered according to the maliki doctrine. Its origin is sale and credit .and is one of the fundamental principal if financial transaction. it is a true considerable and reliable restraint. Some scholars generalized this restrictions to include any two contradictory contrcts. thus many contracts fell under this restriction when the contradiction is absent or not total.
