Abstract This research attempts to deal with one of the most specific assets to the Maliki school of thought, especially in the field of judicial verdicts and applications. Which is the jurisprudence of operations or what is known as “how the work was done”, as it is a unique jurisprudential and judicial heritage left by the genius of the Maliki of the Western Islamic world. It is one of the legislative fundamentals, which revived the neglected pronouncements of the Maliki and continuing to work with them when necessary.Accordingly, the research deals with the illumination of this fundamental conceptand, the conditions for its implementation, its reasons, its types, as a model for the jurisprudence of operations The Maliki,which is the issue of the testimony of a group of people and the manifestations of renewal within the Maliki doctrine. Keywords the operations, the Maliki doctrine, the renewal, the group of people.

Will the author be held accountable for that, or will he not be held accountable?, and I I tried to show diligently the effect of knowing the correct title of the book, To find out if it is true the claiming that the meaning of the term varies between one author and another, or one era and another

يعالج هذا المقال موضوع (إعادة بناء علم أصول الفقه عند ابن رشد وفق رؤيته التجديدية وتقييمها في ضوء موقف علماء الأصول)؛ ليجيب عن إشكالية رئيسية تتمحور حول مدى اعتبار إسهام ابن رشد الحفيد في التجديد الأصولي، من خلال أنموذج نظريته في إعادة البناء الهيكلي علم أصول الفقه، ذا مصداقية علمية؛ في ضوء موقف علماء الأصول الفقه القدامى والمحدثين؟ بقراءة نقدية تتوسل بالمنهج التحليلي والمنهج المقارن، وذلك عبر مبحثين رئيسيين؛ حيث خصصنا المبحث الأول لعرض التصنيف الرشدي للعلوم وعل اقته بغيره من تصنيفات العلماء المسلمين، وخصصنا المبحث الثاني لعرض مسلك إعادة البناء الهيكلي لعلم أصول الفقه عند ابن رشد في ضوء تصنيفه السابق للعلوم وتقييمه في ضوء موقف الأصوليين، ونختم المقال بخاتمة نعرض فيها نتائج البحث وبعض توصياته.
Summary This article addresses the topic of (Restructuring the science of jurisprudence according to Ibn Rushd according to his innovative vision and its evaluation in the light of the position of the scholars of assets (.To answer a major problem centered on the extent to which Ibn Rushd's contribution to the fundamentalist renewal is considered. Through the model of his theory of restructuring the science of jurisprudence, with scientific credibility in light of the position of the ancient and modern scholars of jurisprudence? Criticism that appeals to the analytical and comparative method, This is done through two main themes; Where we devoted the first topic to presenting the rational classification of sciences and its relationship to other classifications of Muslim scholars. We devoted the second topic to presenting the path of structural reconstruction of Ibn Rushd's science of jurisprudence In light of his previous classification of sciences. and its evaluation in the light of the position of the fundamentalists. We conclude the article with a conclusion in which we present the results of the research and some of its recommendations.

يهدف هذا البحث إلى التعرّف على مفهومِ الفسادِ المالي وأسبابه، كما يتعرّض لآثاره المباشرة المفضية إلى تخريب الاقتصاد الوطني، ويركّز على وسائل الوقاية منه عن طريق دراسةٍ تأصيليةٍ مقاصدية تصبُو إشكاليتُها الرئيسية إلى تحديد مَعَالِم منافحةِ الفسادِ المالي في ضوءِ مقاصدِ الشريعةِ الإسلامية، وهي ترنو إلى استخدام المنهج الاستقرائي التحليلي وسيلةً تَرْصُدُ آلياتِ هذه المحاربة، من حيث تناولُ مكانة المال في الإسلام، ونَبْذِهِ لفكرةِ الفسادِ المالي، وما يترتب على ذلك من تحقيقِ شروطِ المُوَاطَنَة. وقد خَلُصت الدراسةُ إلى مجموعةٍ من النتائجِ التي وَقَفَتْ على خطورةِ الفسادِ المالي، ومَدَى تأثيرِه على مستقبلِ التنمية، وأنّ الشريعةَ الإسلامية متميزةٌ في مقاصدِها العامةِ الرَّامِيَةِ إلى دَرْءِ مادّتهِ وتجفيف منابعه، نظراً لأنّ المالَ شيءٌ مهمٌّ في الحياة، به تتحقق التنميةُ الاقتصادية، وعليه يقوم أساسُ التقدم والازدهار
This research aims to identify financial corruption and its causes leading to the sabotage of national economy, focusing on the means of prevention through a study whose main problematic seeks to identify the parameters of combating financial corruption in the light of the purposes of Islamic Shariaa, using the inductive-analytical approach as a means to monitor the mechanisms of this struggle. The study concluded with the danger of financial corruption, and that Islamic Shariaa in its general purposes dried up the sources of corruption, because money is important in economic development and prosperity.

لقد خاض كثير من العلماء على اختلاف تخصصاتهم ميادين البحث في وجود الله أو الخالق، من خلال تقديم بحوث وإجابات في الموضوع، وفي الاتجاه المعاكس ظهر تيار آخر (الملاحدة) على اختلاف طوائفهم وعلى رأسهم الفرسان الأربعة (دوكنز، هاريس، دينيت وهتشنز)، حاولوا عكس الفريق الأول إثبات عدم وجود إله وخالق لهذا الكون. وقد كان الغرب هو الحاضن الأول له ومعقله من خلال تصدير مفاهيمه الأحادية للعقلانية والحرية وأن الإنسان محور الوجود، ما أدى إلى بطلان البعد الروحي والأفق الغيبي. كما أن قصوره الروحي جعله ينتج حضارة ويصنع إنسانا خاليا من القيم الروحية المثلى، تتحكم فيه الغرائز والشهوات والأنانية، لا يعطي وزنا إلا للمادة خارج القيم الأخلاقية العليا. ليقع الخلل وعدم الاتزان بين جانبي الإنسان الروحي والمادي.

الملخص اللّسان سلاح ذو حدين؛ فقد يصدر منه كلاما طيبا يرفع صاحبه درجات، كما قد يحدث العكس فيهوي بصاحبه دركات ، فهو نعمة كبيرة النفع والأثر إن استخدم في الخير، وهو نقمة إن استعمل في الشر لأنّ الإنسان مسؤول عن كل لفظ يخرج من فمه. ومن ثمّ ربط الله به كثير من الأحكام الشرعية، ورتّب عليه آثارا خطيرة بحسب السياق الذي استعمل فيه. ومن هنا يطرح السؤال نفسه : كيف يؤثر اللّفظ في الأحكام الشرعية ؟ مما يستوجب الإجابة عن التساؤلات الفرعية الآتية : ما حقيقة اللفظ لغة واصطلاحا ؟ وما علاقته بالمعنى ؟ وما هو موقف القرآن الكريم والسنة النبوية منه؟ وماهي آثاره الفقهية على مستوى العقيدة، والأسرة والمعاملات ، والعقوبات الشرعية ؟ هذا ما أحاول بيانه من خلال هذه الورقة البحثية.
The tongue is a double-edged sword; He may emit good words from him that raise his owner by degrees, and the opposite may happen and cause his owner to fall into ruins, so it is a blessing of great benefit and impact if used in good, and it is a curse if used in evil because man is responsible for every word that comes out of his mouth. And then God linked many legal rulings to it, and arranged dangerous effects on it according to the context in which it was used. Hence the same question arises: How does the word affect the legal rulings? Which requires answering the following sub-questions: What is the truth of the pronunciation, linguistically and idiomatically? What is its relationship to meaning? What is the position of the Holy Qur’an and the Sunnah of the Prophet? What are its jurisprudential effects on the level of belief, family, transactions, and legal penalties? This is what I am trying to show through this research paper.

يعتبر المنظور الفقهي في تنظيم علاقة الدولة الإسلامية بغيرها من الدول، منظورا قائما بذاته، واضح المعالم والبناء، ومن معالمه، أن أسس هذا المنظور لما يعرف ب"دار العهد"، وهي مجموعة الدول غير الإسلامية التي تدخل مع الدولة الإسلامية في عهود ومواثيق، ومن واجبات دار الإسلام تجاه دار العهد ـ في هذه الحالة ـ حماية دار العهد من العدوان الخارجي، والمحافظة على أمنها واستقرارها، ومن هذا المدخل، يكون الفساد تهديد لأمن واستقرار الأسرة الدولية، التي دخلت معها الدول الإسلامية (حاليا) في علاقات توثقها عدد من الاتفاقيات والمعاهدات الدولية، وهو ما يؤسس للدور المنوط بهذه الدول أن تؤديه في مكافحتها ومواجهتها لصور الفساد. المختلفة داخليا وخارجيا من خلال تعاونها الدولي في هذا المجال. تعتبر المعاهدات الأداة فضلى في مجال العلاقات وإنماء التعاون بين الدولة الإسلامية وغيرها من الدول. كذلك فإن وجود معاهدة بين الدولة الإسلامية ودولة أخرى؛ بشأن موضوع معين أو مسألة محددة، يمثل في حد ذاته ضمانة قانونية لاحترام وتنفيذ الالتزامات المتعلقة بهذا الموضوع، أو تلك المسألة، وعليه تحاول الورقة البحثية أن تتناول دور المعاهدات الدولية من منظور الفقه الإسلامي في مواجهة الفساد مقارنة بالدور الذي تؤديه المعاهدات الدولية في العالم المعاصر باعتبارها محور تكوين القانون الدولي العام. الكلمات المفتاحية: المنظور الفقهي للعلاقات الدولية، المعاهدات الدولية، الفساد، فقه العلاقات الدولية.

تعرض القرآن ولا يزال يتعرض لحملات متكررة وهجمات شرسة من جهات متعددة، كونه أصل دين الإسلام وأقدس مقدساته، وأي مساس به يعني المساس بالدين كله، ولعل من أبرز الجهات التي وجهت سهام طعنها للقرآن الكريم طائفتي المستشرقين والشيعة الاثني عشرية، ويعد المستشرق الفرنسي ريجي بلاشير من أبرز المستشرقين الذين كتبوا حول القرآن، إلا أن الدارس لآرائه حول مسألة جمع القرآن يجد أن لديه تأثرا ظاهرا بآراء الشيعة والشبه التي أثاروها حول المسألة. تهدف الدراسة إلى تجلية هذا التأثر والتوافق في الآراء إضافة إلى الرد على بعض الشبه المثارة.
The Qur’an has been exposed and is still subjected to repeated campaigns and fierce attacks from multiple sides, being the origin of the religion of Islam and its most sacred sanctities, and any prejudice to it means prejudice to the whole religion. The most prominent orientalists who wrote about the Qur’an, but the student of his views on the issue of collecting the Qur’an finds that he is clearly influenced by the views of the Shiites and the similarities they raised on the issue. The study aims to clarify this influence and consensus in addition to responding to some of the similarities raised.

يناقش البحث أطروحة معاصرة للقصص القرآني في كتاب "المدخل إلى القرآن الكريم" للجابري، وذلك بالكشف عن خصائصها ومدى موضوعيتها ومصداقيتها في تقديم نظرة جديدة للقصص القرآني، ولأجل ذلك عرضنا أقواله وفق المنهج التحليلي نقدي. وقد توصلنا في نهاية البحث إلى عدة نتائج أبرزها: اعتماد الجابري على خصائص خمس للقصة القرآنية: اعتباره القصص القرآني نوعا من ضرب المثل، والاقتصار على المادة التي يعطيها القرآن وحده، والحقيقة التاريخية للقصص القرآني، ثم تتبع القصص القرآني حسب ترتيب النزول، وأخيرا التصنيف والتحقيب. ومن النتائج أيضا دمج المؤلف بين مصطلحين متغايرين تماما وهما آيات القصص القرآني وآيات السيرة النبوية، تخيره للأدلة الموافقة لآرائه والإعراض التام عن ذكر الأدلة التي تعارض ما ذهب إليه، أن المؤلف بعد ما قدم منهجه وأنه سيلتزم به لكنه في خضم العرض نقض بعضه.
The research discusses one of the contemporary theses of Quranic stories in the book The Introduction to the Noble Qur’an by Al-Jabri, with the aim of revealing the characteristics of this proposition and the extent of its objectivity and credibility in providing a new view of Quranic stories, for that we presented his sayings according to the analytical method, accompanied by criticism. The research reached several results, the most important of which are: Five characteristics are the Qur'anic stories such as my people, relying on the Qur'an only, ordering the Qur'an downward, and finally classifying the stories. the author combined two completely different terms and here are the verses of the Qur’anic stories and the verses of the Prophet’s biography, some of it.
