رغم الحق المقرر لصاحب براءة الإختراع بإستغلال الاختراع على وجه الإستئثار ،ومنع الغير من إستغلال الإختراع بدون موافقته ،فقد أجاز المشرع الحصول على ترخيص إجباري بإستغلال البراءة ،رغما عن صاحبها و ذلك إذا توفرت حالات معينة تتعلق بعدم الإستغلال للإختراع ،أو النقص في هذا الإستغلال من طرف مالك البراءة ،أو الإختراعات المرتبطة ،وأيضا حالة الترخيص الإجباري للمنفعة العامة ،ولكن توفر الحالات السابقة غير كاف لمنح الترخيص الإجباري ،لذلك فلابد من توفر بعض الشروط التي منها ما يتعلق بصاحب البراءة و منها ما يتعلق بطالب الترخيص الإجباري ،و في الأخير وضع المشرع الجزائري إجراءات للحصول على الترخيص الإجباري ،ففي القوانين القديمة أعطى الإختصاص للجهات القضائية ،أما في القانون 03/07 فقد أعطى الإختصاص للجهات الإدارية .]]>

The Algerian legislator, by Act 04-11, setting the rules governing real estate development activity, defined the terms of sale of real estate that the real estate developer can use when undertaking the construction operation and of sales as part of the real estate activity.The legislator, in fixing these modalities, aims to avoid to the purchasers to fall in a controversy in particular concerning the nature of the acts signed for the real estate for residential use. In addition, the use in more than one way for the sale, gives to each of the two contracting parties the possibility of the most suitable choice especially in view of the financial capacities. The terms of sale of immovable property in which the real estate developer is a stakeholder, consists in the deeds of sale of built property as well as the acts of sale of property in progress.The latter includes two categories: the sale by deed of reservation of right and the deed of sale on plans.]]>

إن الأصل في المسؤولية الجزائية هو أن تكون شخصية استنادا إلى المبدأ الدستوري الذي يقضي بشخصية العقوبة، أي أن من يسال عن جريمة لابد أن يكون قد صدر عنه فعلا يجعله فاعلا أو شريكا وأن تكون إرادته قد اتجهت على نحو يقوم به الركن المعنوي، لكن المشرع قد يخرج عن القواعد العامة للمسؤولية، خاصة قواعد المساهمة الجنائية لصعوبة تطبيقها كما هو الحال في جرائم النشر لأن عمليات التأليف، الطبع، النشر، والتوزيع تتسم بكثرة المتدخلين بالإضافة إلى طابع السرية فمن الصعب تحديد من ساهم في الجريمة باعتباره فاعلا أصليا، ومن ساهم فيها باعتباره شريكا بل إن تطبيق القواعد العامة على إطلاقها قد يؤدي إلى إنزال العقاب على جميع المشاركين في النشر وهذا بدوره يعد إخلالا جسيما بمبدأ شخصية العقوبات.
عليه ونظرا للطبيعة الخاصة لجرائم النشر، كان من الضروري تركيز المسؤولية الجنائية في شخص واحد عن الجرائم التي ترتكب عن طريق الصحف وسائر المطبوعات، ويتمثل هذا الشخص في رئيس التحرير باعتباره المهيمن على سلطة الإذن بالنشر من خلال واجب الرقابة والإشراف المفروضة عليه قانونا على كل ما يتم نشره فيها، فيتحمل بذلك المسؤولية الجنائية عن أعمال تابعيه على أساس نظرية المسؤولية الجنائية عن فعل الغير.]]>
The origin of criminal responsibility is to be personal, based on the constitutional principle stipulating the individuality of Penalty, i.e. who charges about an offence, has to be issued from him an act, making him the person who commits an offence or who takes part of it .And that his will conduct to the mental element. But the legislator can deviate from the general rules of responsibility, specially criminal participation‘s rules which is difficult to apply, as in the case in publication’s offences because the processes of: authorship, printing, publication, and distribution characterized with many intervenors.
In addition to the character of confidentiality, it is difficult to determine who contributed to the crime as a principal actor or who takes part of it as a partner, but the application of the general rules could lead to apply the punishment on all participants in the publication and this in return is a serious breach on the principle of the individuality of Penalties.
That’s why, because of the special nature of the offence of publication, it was necessary to focus the criminal responsibility on the offences committed by the press and by other publications on one person, this person is represented by the editor in chief, as the one who gives authorization to publish it, through duty of control and supervision imposed by law on him and on the publication, that’s why he should endure the criminal responsibility for the acts of his subordinates on the basis of the theory of criminal responsibility for the act of other person.]]>

وضع المشرع ضوابط تحد من تصرفات النائب الشرعي بما يؤدي لحفظ حقوق وصيانة أموال القاصر، فقد قنن قانون الاسرة الجزائري الذي سلك مسلك الفقه الاسلامي الجوانب الموضوعية لبيع عقار القاصر، وتم تنظيم الجوانب الاجرائية لبيع عقار القاصر بالمزاد العلني في قانون الاجراءات المدنية والإدارية. وبحكم اشتراك اجراءات بيع عقار القاصر مع إجراءات التنفيذ الجبري على العقار المفضي للبيع بالمزاد العلني تبين أن الضمانات القانونية تعتريها سلبيات أهممها أن إجراءات البيع بالمزاد العلني تكتنفها إجراءات بطيئة معقدة ومكلفة مما يؤثر في مصلحة القاصر المالية، وهذا ما يستدعي إعادة النظر فيها، وفصل إجراءات بيع عقار القاصر بالمزاد العلني عن بيع العقار بالمزاد العلني في إطار الحجز العقاري، وإفراد لها نصوص خاصة ومستقلة بما يحفظ حقوق القاصر.]]>
In order to protect the inheritance of the minor, the Algerian legislation has emitted several restrictions to limit the authority of the legal tutor. However, the Family Code followed the Islamic jurisprudence in defining the sales conditions in the selling of minor’s real estates, while the civil and administrative law takes over the sales process at public auctions.
Nevertheless, in accordance with the common process between the sale of minor’s real estates and the seizure of immovable assets, it appears that the legal assurances are weakened by the long duration of the process and the procedural complexity which could affect the financial interests of the minor.
To avoid any prejudice, a separation between the both procedures is required for the purposes of saving the interests of the minor.]]>

أجاز المشرع الجزائري بموجب المادة 205 من قانون التأمين لشركات التأمين تقديم خدماتها للجمهور باعتماد وكلاء عامون يقومون بتوزيع عقود تأميناتها على العملاء، متى توفرت فيهم جملة من الشروط المحددة قانونا، مستعينين في سبيل إبرام وتسيير هذه العقود على خبرتهم وكفاءتهم المهنية في هذا الميدان.
ويترتب على اعتماد هؤلاء الوكلاء مسؤولية شركات التأمين عن أفعالهم تجاه العملاء من جهة، ومسؤوليتها تجاههم إذا أخطأت في حق أحدهم من جهة، أو مسؤولية الوكلاء تجاه شركات التأمين التي يعملون لحسابها متى تجاوزوا حدود صلاحياتهم وسلطاتهم.]]>
Under article 205 Of the Insurance law, the Algerian legislator authorized insurance companies to provide their services to the public via general’s agents. The latter can distribute insurance contracts to their customers. These agents should, however, meet a set of legal conditions and their expertise and professional competence in this field allow them to conduct and manage these contracts.
The insurance companies are responsible for all the actions of their agents towards the customers on one hand and responsible towards the agents if one of them is abused by the insurance company on the other hand. The agents also must bear responsibility towards the insurance companies they work for in case they misuse their powers and prerogatives.]]>

إن الرقابة على دستورية القوانين هي بشكل أساسي عمل قانوني يهدف إلى التأكد من تطابق القانون مع أحكام الدستور والتعرف فيما إذا التزمت السلطة التشريعية حدود اختصاصاتها أو تجاوزتها، تعتبر الرقابة الدستورية على القوانين إحدى الدعائم الأساسية لقيام دولة الحق والقانون، وتعد أهم وسيلة لضمان حماية حقوق الأفراد وحرياتهم من أي تجاوز.
واستنادا إلى التعديل الدستوري لسنة 2016 أجاز للأفراد المتخاصمين في دعوى منظورة قضائيا الطعن في دستورية القوانين التي تنتهك الحقوق والحريات التي يكفلها الدستور أمام القضاء العادي، واختصاص مجلس الدولة إذا كانت الدعوى مرفوعة أمام المحاكم الإدارية، أو محكمة النقض إذا كانت الدعوى مرفوعة أمام المحاكم العادية في إحالة الطعن إلى المجلس الدستوري من عدمه.
إن قراءتنا لآلية الدفع بعدم الدستورية ستحصر في النصوص التشريعية وقصر مراجع دستوريتها على الحقوق والحريات المضمونة دستوريا أسوة بالمشرع الفرنسي الذي حصرها في هذه العناصر المذكورة، ذلك أن المشرع الجزائري لم يصدر القوانين المنظمة لهذه الآلية وأرجأ العمل بها إلى سنة 2019.]]>
The control of the constitutionality of laws is essentially a legal action aims to ensure that the law with the provisions of the Constitution and whether committed legislative authority within its competence or surpassed, the constitutional censorship laws as one of the main pillars of the creation of the state of right and law, and is one of the most important means to ensure the protection of the rights and freedoms of individuals from any encroachment
On the basis of the constitutional amendment in 2016 passed disputing individuals in a proceeding pending judicial appeal against the constitutionality of laws which violate the rights and freedoms guaranteed by the constitution before the ordinary courts, and the competence of the Council of State if the lawsuit filed before the administrative tribunals, or of the court of cassation if the lawsuit filed before the ordinary courts in to refer the appeal to the Constitutional Council or not.
That our reading of the mechanism for a constitutional motion in legislative texts and the palace of the External Auditor unconstitutionality of the rights and freedoms of constitutionally guaranteed like the French legislator which confined in these elements mentioned, that the Algerian legislature has not issued the laws governing this mechanism and postponed to 2019.]]>
