يعتبر الوقف المخطوط جزءا مهما من تراث وتاريخ الأمة العربية والإسلامية، ولكن الجهل بقيمته عرضه إلى الإتلاف والضياع، ويكفي ما ضاع من تراث الأمة المخطوط في نهري دجلة والفرات وغيرهما، فلا نجد عذرا لأحد، في إهمال ما تبقى من الوقف المخطوط في مشارق الأرض ومغاربها، ثم لابد من حفظ المخطوط والمحافظة عليه وفق الإمكانيات والوسائل الحديثة، ولبعث الوقف المخطوط لابد من تكوين هيئات وطنية عليا تشرف عليه جمعا وحفظا وصيانة وحماية، وضرورة التعاون مع الهيئات الدولية المهتمة بهذا النوع من التراث العالمي، المهدد بالانقراض في العالم الثالث خصوصا، ثم لابد من فتح باب الاستثمار، ولا نقصد هنا البيع والشراء والتبادل النفعي، للوقف المخطوط ونقصد بها البحث عن بديل مشروع، والاستفادة من تجارب الأمم المتقدمة في كيفية التعامل والاستثمار في الوقف المخطوط من حيث النفع المادي الذي رجع بفوائد طائلة على تلك المؤسسات التي اختصت في هذا المجال، وبالتالي أصبحت تساهم في رفع مستوى الدخل الوطني، وتوفر مناصب الشغل، وتساهم في النهوض بالاقتصاد المحلي.
The endowment of ancient manuscripts contains an outstanding collection of illuminated manuscripts and offers a representative sample of the intellectual output of Arabic and Muslim heritage. However, many of these valuable manuscripts have been damaged and reduced to ashes as it has been the case in the historically important Euphrates and Tigris rivers. To retrieve and preserve the enviable core collection of manuscripts, it is of prime necessity to set national institutions that can house them. Other activities may include series of international programs with the soul aim of overcoming the problems facing ancient manuscripts. Further, manuscripts are of great financial value. Therefore, they can be treated as economic investments to improve the living standard of any given nation.

تعد دراسة القواعد الفقهية والمسائل المتفرِّعة عنها ذات أهمية بالغة بين الفقهاء والباحثين؛ لأنها تُولِّد عندهم الملكة الفقهية، من خلال ربط المسائل الفقهية المتنوعة ذات الأبواب المختلفة بقواعد تجمع شتاتها، وتؤلف بينها، مما يُسَهِّل جمع النظير إلى نظيره، والمثيل إلى مثيله.
ومن أعظم القواعد الفقهية قاعدة: (الضّرر الأشد يُزال بالضرر الأخف)، لذا جاء البحث لدراسة هذه القاعدة ومسمّياتها، واستجلاء تطبيقاتها الفقهية على بعض مسائل الأسرة المعاصرة، فإذا تعارض ضرران فإنّه يُنظر في أيّهما أعظم وأشدّ، فإذا عُرِف الأشدّ دفعناه ولو بارتكاب الضرر الأخفّ؛ لأنّ الشريعة جاءت بتقرير المصالح وتكميلها وتعطيل المفاسد وتقليلها.
The study of the jurisprudence rules and related issues is considered to be of crucial importance among jurisprudents and researchers; because it generates in them the faculty of jurisprudence by linking the various doctrinal issues of different sorts with rules to gather their sporadicity, and reconcile them with each other, the thing that makes it easier to collect the counterparts and those of the instance. One of the greatest rules of jurisprudence is the rule: (the greatest damage can be removed by the lighter damage), that’s why research has emerged to study this rule and its implications, and to clarify its jurisprudent applications on some contemporary family issues; so if two damages conflict, one is looked at, if it is known to be the greatest it is repulsed even by committing the lighter damage because the Islamic doctrine has come to affirm and supplement the interests and to disrupt and minimize the mischief.

إن الجمود التشريعي في القانون التجاري الجزائري وخاصة في نظام الإفلاس يمكن تبريره بسيطرة المشروعات العامة على النشاط التجاري خلال حقبة زمنية معينة فنشأ القطاع العام مضطلعا بالجانب الأكبر من النشاط الاقتصادي، وحظر القانون شهر إفلاس شركات القطاع العام مما أدى إلى عدم الحاجة لتعديل قانون يتناول نشاط جانب صغير من مجتمع التجارة.
أما اليوم فان النشاط التجاري الخاص أخذ يستعيد مكانته فتم تأسيس بنوك ومشروعات وطنية وأجنبية أو مشتركة، وهو الأمر الذي يقتضي تغيير وتعديل جدي في الفلسفة والنظرة التي يقوم عليها نظام الإفلاس في الجزائر لكي يتلاءم مع تلك المتغيرات. خاصة فيما يتعلق بشروط شهر الإفلاس من خلال التمييز بين العمل المدني والتجاري من حيث طبيعة الدين، وان أحكام الإفلاس تنطبق على التجار دون سواهم.
La stagnation législative algérienne en matière commerciale et notamment le système de liquidation est justifier par la faite de la domination des projette publics sur les activités commerciales au cour dune phase dèternminèe la liquidation a été prohiber sur le secteur public ce qui a pousse le blocage.
Actuellement les activités commerciales ontètè développer par la constitution des nouvelles institutions commerciales ce qui a pousse la nécessité de promulguer un nouveau arsenal junidique conforme avec laclualitè notament les mécanismes de la liquidation. Et le statut juridique du commerçant.

Cet énoncé entreprend l’étude des efforts des Chick Mohammed ben abd –el-Karim el-maghilli Telemcani، dans les productions du livre de la jurisprudence de la politique législatives et de la rénovation dans la forme et de la contenu. Et cela à partir de ses correspondances aux rois et aux princes du soudan occidental à travers sa fameuse promenade à ce lieu، et il a pu à partir de ces lettres d’effecteur un effet positif considérable dans tous les coins de la vie de la population du soudan occidental، et encore rétabli dans l’Afrique occidentale jusqu’à aujourd’hui.

Pour les enfants, la sécurité revêt une importance capitale. Les droits des enfants commencent avant même leur naissance et leur conception. Considérant que les enfants - en tant qu'entité fragile et catégorie sociale vulnérable - endurent la plus grande part des souffrances provoquées par la main de l'homme, avec leur cortège de drames comme l'exploitation des enfants pour des opérations militaires, des travaux pénibles ou dangereux ou des activités illégales, sans parler de l'épreuve des enfants victimes de maltraitance de toutes les formes ; de mauvais traitements physiques et affectifs, de sévices sexuels, ou d’exploitation commerciale ou autre, entraînant un préjudice réel ou potentiel pour la santé de l’enfant, sa survie, son développement ou sa dignité.

Represents the industry structure of area of interest organizations, where in the framework of the formulation and implementation of competitive strategy, and have economic theories and theories of management contributed to the provision of a number of concepts and tools related to analysis of the industry in terms of form and structure, and here is the industrial concentration (not intended for Endemic Industry) of important dimensions the basic structure of the industry, but this has been in this research building industrial concentration indicators to measure the number of very distinctive characteristics of the industry structure. In addition, our discussion will focus on the industrial concentration indicators and interpretations available to them for the behavior and performance of the industry inadvertently allow expected impacts: profitability, market share, competition, integration and others.

إن التفتح على اقتصاد السوق، وتحرير المعاملات العقارية، وسياسة الاستثمار، كلها أسباب داعية بما فيه الكفاية للنهوض بنظام "مسح الأراضي العام " متين وحديث، وإذا تمحورت الأهداف المحددة له إلى يومنا هذا في الجانب التقني والقانوني فإن استعماله في الاحتياجات الأخرى ذات الطابع الاستثماري والجبائي لا تقل أهمية عن ما سبق ذكره، نظرا لما يوفره من ثروة للمعلومات المهمة والمفيدة لكل من القطاعات الاقتصادية والاجتماعية، مما يجعله العامل الفعّال في إجراء التّطهير العقاري.
The opening of the market economy, the establishment of economic transactions and the investment policy are all reasons for developing the concept of "general cadastre" strong and modern. If the objectives which determine it are focusing, to date, on technical and legal aspect, its use also has value in other needs like investment and taxation taking into account the provision of wealth, important and beneficial information for all social and economic sectors, making it the active agent in order to purge the land.

تسلط هذه الدراسة الضوء على السلطة التقديرية للقاضي المدني في التشريع الإسلامي وتطبيقاتها في القضاء الشرعي، وبالتحديد في الشهادة كدليل إثبات منتج في الوصول إلى الحقيقة القضائية، كما تم التعرض إلى تطبيقاتها في القضاء الجزائري الحديث، وقد تبين جليًا أهمية الشهادة، وشروط الشاهد، والحالات الخاصة التي لا يجوز الاستماع فيها إلى الشاهد.
This paper deals with the judge’s estimated authority in judicial legislation and its applications in religious courts, which needs to clarify the concept of estimated authority, and its evidences of legislation. There were some discussions to certain application in recent Algerian judgments, such as estimating the importance of the witness; the eyewitnesses’ obligations, and the special cases where the evidence taken from an eyewitness is for bidden.

يهتم هذا البحث، بنوع من الخلاف انفراد بذكره المالكية، ألا وهو ما أطلقوا عليه اصطلاح: الخلاف في حال وفي شهادة. والفرق بين النوعين من حيث التصوير: اعتماد الأحوال والصفات في الأول، وذلك بما يحضر في ذهن المخالف وقت الحكم، واعتماد ما تقتضيه المشاهدة والمعاينة في الثاني، وفي كل منهما وجود حالتين، يختلف باختلافهما الحكم.
وأظهرت نتائج البحث: أنه خلاف لفظي، له علاقة بالعوائد، وبمقاصد الناس، وباختلاف الزمان والمكان؛ لذا نبه العلماء على ضرورة مراعاة هذه الأمور، والنظر إليها قبل استصدار الأحكام.
ولقد خدم هذا الاصطلاح المذهب المالكي خدمة جليلة؛ حيث أخضعت الأقوال المختلفة فيه إلى معيار الأحوال والمشاهدات، فنتج عنه ضبط الخلاف الفقهي في المذهب.
This research focuses on a kind of divergence mentioned by the Maliki and called: the disagreement on the conditions and disagreement in viewpoints. The difference between these two types in terms of imaging: the adoption of the conditions in the first, and the adoption of testimonials in the second, and in each of them the presence of two cases where the judgment varies.
The results showed that it is just a verbal divergence is related to the habits and people's goals with time and place. This is why the Ulema have warned about the need to consider these statements of fact and examine them closely before announcing judgments.
This term has rendered a great service to the Maliki doctrine in such a way that it has submitted the various criteria set out in testimonials and facts, which resulted in a settlement of doctrinal disputes.
