This study aimed to establish an intellectual framework around strategies and legal and banking procedures followed by the banking sector in order to disclose and the fight against money laundering, using a study based on the means and mechanisms in place to prevent this crime in the financial services responsible for the banking sector and regulatory bodies, and exercise the obstacles on its objectives. The study showed the role of the banking sector to face the crime and how to reduce the disadvantages, usually for the good of the country and banking in particular, as she pointed out the urgent need to take a series of procedures this respect also placing emphasis on the problems and deficiencies that require: a policy, prudence and particular care to protect the banking system risks, on the one hand, the fight against money laundering and on the other hand, its role as an access deep and rapid efficient manner. The privacy right is considered as one of the natural and personal rights that is given a big interest due to its relation with the individuals’ freedom for it is regarded among the public liberties, the sanctity of private life is the heart of the personal freedom which is a fundamental freedom ; because it guaranties the man’s dignity, it is the holiest and the highest of human rights and is featured by its confidentiality and privacy; and it is a rooted right in all Common  laws on the ethical and  religious bases their source is the Islamic legislation.     The privacy right seems in various shapes among them that are agreed upon  as the inviolability of home, of the body, of the correspondences and the communication ; including what is disagreed about them such as the right of  the photo and the unlikeness the professional life and of another unlimited shapes that cannot be restricted either in the Common law or in the Islamic legislation ; due to the difference in the patterns and styles and  customs and habits and cultures and the legal systems that prevail the societies the latter  may face change and development constantly.      Despite; the abundance of the Islamic legislation and the Common laws in giving it a special definition, yet they have acknowledged it and have put for it restrains and rules for its protection through the guiltiness of any deed which decrease the man’s right of  honorable survival on the shadow of privacy like: the crimes of  soul aggression, and the crimes linked to the home’s sanctity and messages, and the secrets’ deviling , plagiarism and forgery in it ; also its bearing about  saving the personal talks by the forbiddance of spying ...etc, and  as mentioning  them in the Islamic legislation sources: (The Holy Quran and The Prophetic Tradition), and in the Common laws sources either on the international level as the conventions and the decisions issued from The United Nations Body and the international and territorial conferences or domestically by a claimed constitutional texts and internal legislative texts within the penal or civil laws. Creator An entity primarily responsible for making the resource عيساوي , عادل Date A point or period of time associated with an event in the lifecycle of the resource 2016-12-01 Description An account of the resource عالج هذا البحث حقّا ماليا مُقرّرا للزّوج يتمثّل في عِوض الخلُع، ويُقدِّم نظرة قانونية حول معالجة المشرّع الجزائري لهذا الموضوع، كما يستعرض الرّصيد الفقهي والاجتهاد القضائي في المسائل المرتبطة به.    إنّ عِوض الخُلع هو المقابل الذي تمنحه الزّوجة لزوجها لقاء فرقتها، وهو مقرّر بنصوص الشّريعة ونصوص قانون الأسرة، ويشترط فيه أن يكون مالا أو قيمة مالية أو منافع حسب الاتّفاق، وقد اختلف الفقه حول قيمة بدل الخُلع ومدى إلزامية مراعاة قيمة المهر عند تقديره، وقد أناط المشرّع الجزائري تقدير قيمته للقاضي حال عدم اتّفاق الزّوجين في تقديره، على أن يحكم بما لا يتجاوز قيمة صداق المثل وقت صدور الحكم، وإمكانية استغلال الزّوجة لهذا المبدأ لافتداء نفسها بأقلّ من المهر الذي قبضته.   يعالج البحث أيضا الارتباط القائم بين الاتفاق على بدل الخلُع وأحكام تصرّفات المريض مرض الموت تطبيقا للقواعد العامّة المقرّرة في الفقه الإسلامي والقانون الجزائري، كما يعالج أهمّ إشكالات عِوض الخلُع في قانون الأسرة الجزائري، خاصة ما تعلّق منها بعدم اشتراط رضا الزّوج بالعِوض، ومعايير تقديره من طرف القاضي.   Cette recherche traite un droit financier établi pour l'époux qui est " La contre- partie du khol'a",    et présente un aperçu juridique sur le traitement du législateur algérien à ce sujet, comme elle expose la réserve du fiqh et la jurisprudence dans les affaires relatives.   La contre- partie du khol'a est en revanche, ce que donne une femme à son mari en contre partie    à sa séparation, et il est établi par les textes de chari'a et les textes du code de la famille, et il faut qu'il soit financier ou de valeur monétaire ou de prestations conforme à l'accord,  le désaccords du  Fiqh en ce qui concerne la valeur de la contre- partie du khol'a et l'ampleur de l'obligation de complaisance de la valeur de la dot quant à son appréciation; le législateur algérien a confié son estimation au juge en cas de désaccord des conjoints sur son estimation, il doit ordonner le versement d'une somme dont le montant ne saurait dépasser la valeur de la dot de parité "sadaq elmithl" évalué à la date du jugement, et la possibilité de l'exploitation de l'épouse de ce principe afin de se rançonner avec un montant moins que la dot quelle a pris en main.    La recherche traite aussi le lien existant entre l'accord sur la contre- partie du khol'a et les dispositions des actions par une personne, au cours d'une maladie ayant entraîné sa mort en application des règles générales prescrites dans le fiqh islamique et le code algérien de la famille, comme elle traite les plus importants problèmes de la contre- partie du khol'a, Surtout ceux relatifs à la non-exigence du consentement de l'époux pour la contre- partie du khol'a, et les critères de son évaluation par le juge. The intervention of the criminal law in a lot of fields, both those related to the economic or social life, and the disturbed this situation a lot of the modern criminal jurisprudence who believes it is necessary to put an end to this intervention under the name of "The Reduction of Punishment."
