It tackles his scientific products and his method of jurisprudence. The scholar Mohamed Mahmoud was very famous. With his remarkable knowledge, intellectuality and innovation, he enlightened Chinguit for a long period of time as pioneer leader and chief of the traditional religious school known as Mahdara: Al- Kahla and Al- Hamra. His scientific products reached many of the universities of the world and he was one of the first scholars who were interested in the art of jurisprudence in the country. However, this unique personality did not get enough attention in the academia in various aspects, and perhaps the most important of those aspects was the one of his leadership in the art of jurisprudence in the country. So, he was one of the first scholars who wrote in this field focusing on the specificity of Al-Mahdara. The research aims to consolidate the principle studied from in Islamic Sharia and Algerian law, by defining the content of the principle and determine the basis for its activation, and to clarify its relationship with other principles of criminal legislation. It also aims to identify the exceptions in which invalidate the effect of this principle, and the criminal text applied retroactively. This research aims at defining the methodology of Imam Mohamed Al Shoukani in conflict, weighing and how to deal with the conflicting sharia evidence, and to indicate that conflict of evidence is virtual conflict in point of view of the diligent person who shall dedicate all efforts to refute the conflict. To define this, the researcher used the inductive and analytical methodology. The research concluded that weights according to Imam Al Shoukani are different by consideration. Weighing may be based on attribution, consideration of text or significance. Weighing may be based on consideration of foreign matter. There is weighing of standards and weighing of auditory limits. The spread of domestic violence in societies has become a global phenomenon, which has a great impact on people’s lives and their stability. Due to the great importance of this research and to the individual and society, I conducted this study “Family Violence”, with the aim of explaining the meaning of family violence in an accurate way, its forms and divisions, and then clarifying the jurisprudential ruling on domestic violence. Explaining the causes that lead to family violence, and the effects that occur and resulting from it on the individual and society, and clarifying the most important means and methods of protection against this pathological phenomenon before it occurs, and the most important medicines, treatments and solutions to it after the occurrence. In the conclusion, I mentioned the most important findings and recommendations of this study, and the need for concerted efforts between Sharia, law and education scholars to develop laws and legislation to eliminate the phenomenon of domestic violence, as well as the need to spread moral and educational values that protect or treat domestic violence and its causes. This research paper is an attempt to explain the importance of the references in the holy Quran purposes and its priority over others Sharia’s objectives. Since It represents an asset for all the purposes furthermore It is a guide to a good understanding of the Islamic law, Sharia and elicitation of its rules besides the elaboration of its provisions on the proper approach methodology.As well as applying its provisions according to the right path. after that we active these provisions to control the human movements in the universe then working on harnessing it in a useful beneficial way.The holy Quran is a source of unlimited knowledge and an asset to the implemented science despite all the studies around it still needs an other focused research and deep contemplative study to extract its hidden treasures; because Quran is the word of God and it is his miraculous book, impermissible from any changes, distortion or switching, and all of that give it the absolute originality that is accepted by all different opinions, and refer to it to resolve disputes .the holy Quran contains lofty supreme purposes that could form a system of guidance with a clear vision for anyone to understand Sharia and apply its rules, as it can be a reference in different religious issues beside its facts. That’s to set fixed laws that control human movements and their activities inthe universe.In practice, it is noted - diligently and applied- that the recognition of the Quran’s terms and its reference is weak regarding its wisdom and provisions, these great meanings of the Quran has no longer a great presence at the level of thoughts and behaviors. They are no more references for reflection, consideration of the consequences and confronting life's developments; therefore Muslims were involved in multiple legitimate infractions, and it was necessary to recall the Quran's references back, continue to explore its meanings and purposes; to guide the thoughts, actions, laws that inform attitudes and consequences. The research deals with the study of the issue of changing legal rulings, rooted and applied; Explaining the nature of the change of legal rulings and their causes; Whether those related to custom and its appendices, or related to reality and its development, then a statement of the controls for changing the legal rulings, and in the last section two applications were studied to change the legalrulings from the branches of contemporary financial transactions, namely the ruling on selling gold as a debt, and the ruling on taking compensation for moral rights. The research method was descriptive and analytical, presenting the scientific material and its applications; By explaining the nature of changing the legal rulings, rooting for them, and then applying them.
