À travers l’analyse des espaces spécifiques à la ville de Béchar qui exhibe une expérience historique dans la production des établissements humains « les Ksour», adaptés aux modes de vie des occupants et qui se plaint aujourd'hui de mutations radicales de ses logiques de production architecturale et spatial ; nous tentons de répondre à la question suivante : Dans quelle mesure la dimension humaine participe t- elle dans la nouvelle conception de la ville de Béchar ? Creator An entity primarily responsible for making the resource الجواري, ايناس غانم عبد الرحمن, بدران شكيب بناني, نرجس Date A point or period of time associated with an event in the lifecycle of the resource 2022-03-23 2023-10-03 Description An account of the resource عندما تجيز التشريعات للقاضي تطبيق القانون الاجنبي على المنازعات المشوبة بعنصر أجنبي في الحالة التي تشير فيها قواعد الاسناد الوطنية لذلك ، إلا أن القاضي يبقى مقيداً بتطبيق القانون الوطني واستبعاد القانون الاجنبي المختص والذي أشارت إليه قواعد الاسناد في حالات معينة، تتمثل الحالة الاولى باستبعاد القانون الاجنبي المختص عند تعارض مضمونه مع النظام العام في دولة القاضي ، والحالة الثانية المتمثلة باستبعاد القانون الاجنبي المختص عند ثبوت وجود الغش نحو القانون. وعلى اعتبار مسائل النفقة مستمدة من أحكام الشريعة الاسلامية وذلك في أغلب التشريعات العربية ، ومتعلقة بوجود الطرف الضعيف في العلاقة القانونية المتمثل بمستحق النفقة ، والذي تتجه كل التشريعات العربية والاجنبية لتوفير الحماية له وتلبية متطلباته. مما يترتب عليه استبعاد القانون الاجنبي المختص كلما تعارضت أحكامه مع المبادئ القانونية والشرعية التي تستند إليها هذه التشريعات وكذلك أن ثبت له الاختصاص عن طريق الغش .    في ظل تزايد الاهتمام العالمي والمحلي بضرورة تحقيق التخطيط الحضري المستدام وتنمية المدن من خلال بناء استراتيجيات حديثة. يناقش بحثنا إشكالية الصراع بين تخطيط وتنفيذ مدن حديثة على حساب هوية وأصالة المجتمع التي تتجسد في المدينة و ومبادئ التخطيط الحضري المستدام على الصعيدين العمراني والمعماري للمدن مما قد يفقدها طابعها وهويتها المحلية ومن أهم مظاهر هذه مظاهر الإشكالية : التشابه والخلط في التطبيق غير المدروس بين المخططات العمرانية الجديدة في العديد من المجالات على الرغم من تباين خصائصها المكانية وأهدافها العمرانية وأبعادها التراثية. و تأتي أهمية البحث في تحديد تغيرات أهداف التخطيط الحضري المعاصر للمدن ما بين الأصالة و المحافظة والفقد والإهمال المتعمد لها او القضاء عليها كليا من اجل بروز مدن جديدة فاقدة لهويتها بدون اي انتماء لمجالها الاصلي . تبحث الورقة تغييرات المدن من جانب الهوية الحضرية بين قيم الأصالة والحداثة في ظل التغيرات السوسيو- ثقافية للمجتمع الجزائري بطرحنا للتساؤلات الاتية: • ما هي أسباب التغييرات التي تعرفها المدن وما التحديات التي تنعكس عنها وما تأثير ذلك على هويتها؟ • هل يمكن للمدينة ان تستوعب النمطين: الأصيل والحديث في وعائها ؟ وهل لا يحدث ذلك شرخا في وحدتها العمرانية المعمارية ؟ يركز البحث على التحديات التي تعرفها المدينة في سبيل المحافظة على هويتها والتي تعمل على افقادها بريقها الحضاري الذي يتغذى باستمرار من دفعة المجتمع الثقافية الاجتماعية، وذلك في ضوء تأصيل القيم الحضارية في التخطيط الحضري المعاصر في واقع الهوية العمرانية المعمارية للمدينة. ويتخذ في ذلك مدينتي غرداية وعلي منجلي بقسنطينة نموذجا. Compte tenu de l'intérêt mondial croissant dans le local et la nécessité d'assurer la planification urbaine et le développement durable urbain grâce à la construction des stratégies modernes. Cette recherche discutera la problématique entre la planification et la mise en œuvre des villes modernes,au détriment de l'identité et l'authenticité de la communauté incarnée dans la ville et les principes de l'aménagement urbain durable dans les cotes urbaines et architecturales, qui pourrait perdre son caractère et son d'identité locale, cette problématique s’exprime par la similitude et la confusion dans l'application hasardeuse des nouveaux plans d'urbanisme dans de nombreux domaines, malgré la divergence de leurs caractéristiques spatiales, objectifs urbainset les dimensions patrimoniales. L'importance de la recherche s’inscrit dans la déterminationdes changements des objectifs de l'urbanisation moderne des villes : entre originalité et préservation, et la perte et la négligence autrement dit son élimination entièrement ce qui permet l’émergence des nouvelles villes dépourvue d’identité et sans appartenance à la région d'origine. Ce document examine les changements dans les villes d’après l'identité urbaine entre valeurs de la tradition et modernité à la lumière des changements socio-culturels de la société algérienne,en posant des questions suivantes: • Quelles sont les raisons des changements que connait les villes ? et quels sont les défis qui y sont reflétés et l'impact sur leur identité? •La ville, peut-elle englober deux modes: authentique et moderne dans son corps?est-il possible que ceci influe son équilibre urbano-architectural? A la lumière de l'enracinement des valeurs culturelles dans la planification urbaine contemporaine dans la réalité de l'identité architecturale urbaine concernant la ville, cette recherche accentue sur les défis que rencontre la villeafin de préserver son identité , et qui influent son éclat civilisationnel expédier de façon continue de lapousséesocioculturelledela société, et prennecomme modèle les villes : Ghardaïa et Ali-Mendjelia Constantine. The Constructional Environment effects in creating the atmosphere which helps in growing the child and encourages him on creativity , mental and physical sides. And it considers a strong construction in preparing aware generation who can helps in progress the society and its advancement. That’s why its important to do care of the construction and planning which is the basic for the Strategy of develop the Education , health and urban which its part and parcel from psychological , health , mental development of the child. However in Egypt Particularly its still takes the random , traditional, and non organized un safe shape. That’s why this research perform sort of the mis- planning construction in Cairo divided into three shapes: (overcrowded ,(urban) ,the industrial building in living places, the overcrowded in governmental, politics and administrate places, and its bad effect which caused (Child labor- escaping the child from the school and the spread of phenomenon of Street Child) and the existence of industry which fill of water and Air pollution in the population places which effect badly on child health .besides the overcrowded in Cairo governor which caused traffic and consequently the raise of the accident. Pour que l’enfant scolarisé puisse réussir dans ses études et puisse se sentir bien dans son école où il passe la plus grande partie de sa journée, il doit trouver toutes les conditions nécessaires pour cela. L’école doit donc être un endroit qui favorise le bien-être et la haute qualité de vie de l’enfant. La cour de récréation avec ses aménagements et son espace vert sont des éléments importants dans l’école. Leurs apports sont indéniables selon les études menées à ce sujet par un nombre important de chercheurs. Ils augmentent le sentiment de compétence, améliorent les capacités cognitives et réduisent le stress chez l’élève. Rendre la cour des écoles verdoyante est un mouvement international en plein expansion. Il a comme objectif l’amélioration de la qualité de l’espace de récréation des établissements scolaires en augmentant la surface réservée à l’espace vert. Il s’agit dans ce papier de faire le diagnostic de l’état des cours d’un certain nombre d’écoles de la ville de Batna, du potentiel de leurs espaces verts existants et de connaitre la vision de l’élève envers la cour de son école. Based on the experiential marketing model, this article examines the problem of the urban ambience of the Medea public square of November 1, 1954, by assessing the evaluation of the satisfaction of its users. It highlights the close link between these two variables, and uses a statistical method of linear regression to analyze its nature. The results obtained show clearly that they are positive and highly correlated, but in favor of the relational component and in the detriment of the sensory component. Thus, it is understandable that the attractiveness of this place comes much more from its social practice and less from its sensory characteristic Cet article s’interroge, sur la base du modèle de marketing expérientiel, sur la problématique de l’ambiance urbaine, de la place publique du premier novembre 1954 de Médéa, au moyen de l’évaluation de la satisfaction de ses usagers. Il met en évidence le lien étroit qui existe entre ces deux variables, et s’engage dans une méthode statistique de la régression linéaire pour analyser sa nature. Les résultats obtenus démontrent bien que celles-ci sont positives et fortement corrélées, mais en faveur de la composante relationnelle et au détriment de la sensorielle. Ainsi, l’on comprend que l’attractivité de cette place revient beaucoup plus à sa pratique sociale et moins aux caractéristiques sensorielles. The school building is considered as the fundamental element in the educational process and one of the most important factors of its success and of the increase in the level of knowledge acquisition, since it represents the recipient in which all the elements of the educational and didactic process interact, including educational sessions and recreational activities, administration and social relations between all the actors of the educational process. The educational process cannot take place without considering the place in which it takes place, in all its aspects, starting with design, construction and equipment. All this has an impact on the psychology of the students who spend long hours in this place, in addition to its impact on the rest of the people: teachers and administrators. Consequently, school buildings must be reconsidered, developing new plans to implement them in accordance with international quality standards and modern educational models, in order to allow, on one hand, a psychological comfort of the students, and on the other hand, to be attentive to the educational needs and current requirements. From this viewpoint, this article is in line with school equipment and educational reforms in order to shed light on certain fundamental aspects of this subject, with reference to the most important problems from which the education system in Algeria suffers. The deep changes that the third millennium, universally adopted, has seen in terms of measures for marginalized groups, including persons with mobility disabilities, are of a quality with regard to the worldwide achievements, to improve conditions and build assets for this category of persons, with a view to achieve equality away from discrimination, by drafting and approving the agreement of the International Convention of Person’s Rights with Disabilities in all its forms in 2006. The main purpose of the Convention is to strengthen the protection of the rights of persons with disabilities, to ensure their dignity and to guarantee the fundamental freedoms and their enjoyment of all human rights including schooling. For six years, the school environment embraces the child from an early age. It is considered the most important phase of a child's life, given its role in the formation of his/her personality and the refinement of his/her talents. While the needs of the disabled child require greater efforts and more resources with regulatory assistance dedicated in his favor for architecturally rehabilitated educational institutions from the outside to open spaces and also pedagogical spaces, so that he can attend school independently and be able to overcome the psychological barriers that reinforce his physical disability and inhibit his initiative to learn and acquire skills.
