تميزت الشريعة الإسلامية عن ما غيرها من الشرائع السماوية بتنظيم الطاعة الزوجية ووضع الأسس المتينة لها، والمستمدة أحكامها من الوحي الإلهي، إذ وازنت بين أطراف الطاعة الزوجية دون ظلم ولا إجحاف، وأناطت بكل منهما من الحقوق والواجبات التي تصون مصالحهم وترعاها دون تعدي لإحداهما على الآخر، تلافياً للشقاق والتنازع بينهما، دون التفريط بعبادة الله عز وجل، كما ان للزوجة حقوق على زوجها انطلاقا من مبدا توزيع الحقوق بين الزوجين على الرغم من اختلاف الفقهاءعلى البعض منها كعلاج الزوجة وخروج الزوجة للعمل ومدى احقية الزوج في منع الزوجة من الخروج للعمل وطاعة الزوج له.
المجال يؤثر على مستخدمه بشكل تفاعلي، يوجه السلوك نحو الاستخدام الوظيفي اليومي، والانتقال بين المجالات يولد تواترات عديدة تعكسه حقول رؤية مختلفة بانفعالات وأحاسيس متعددة. وحسب مخبر التركيب المجالي بكلية "بارتلت" (Bartlett) بالكلية الجامعية بلندن فمبحث التركيب المجالي الحاسوبي يؤدي إلى الفهم الأساسي للعلاقة بين التصميم المجالي واستخدام المجال فضلا عن النتائج الاجتماعية على المدى الطويل، وبناء على ذلك يمكننا استشراف السلوك الاجتماعي والفعل الإنساني في المجال في مشاريع التخطيط الحضري للمدن الجديدة، وبالتالي يمكننا تفادي الاستخدامات السيئة للمجال قبل استخدامه باختيار الحل الأنسب رقميا في مراحل التخطيط ما قبل التنفيذية منها. مدينة علي منجلي كواحدة من أهم المدن الجديدة في الجزائر، وقطب التوسع الأول في عاصمة الشرق الجزائري "قسنطينة"، هذه المدينة عرفت تخطيطات حضرية متتالية ولا تزال، وبعد تنفيذها وإنجاز مشاريع قسم هام منها وشغورها بعد ذلك من طرف السكان عرفت هذه المدينة استخدامات مجالية أسفرت عن خلق مجالات سلبية وبقع سوداء كان يمكن تفاديها لو مرت على المسح البرمجي الحاسوبي الاستشرافي باستخدام خريطة الرؤية. إذن بحثنا هذا يعالج فكرة الكشف عن مواقع الزلل في التخطيط الحضري بتفادي ما يمكن أن يخلقه هذا الأخير من مواقع تساعد في تنامي السلوكات الاجتماعية الخطيرة في المجال الحضري للمدن الجديدة وذلك بناء على مقاربة التركيب المجالي الحاسوبي في شقها البصري (حالة دراستنا تتمثل في مدينة علي منجلي بقسنطينة: ثالث أهم مدينة في الجزائر).
This paper explain how specially the space type can interpret why the human being derives to a negative behavior like "Crime". So, in this study we adopt the visibility approach which is developed by the laboratory of space syntax (UCL), and which makes a sense for the link between the space design and its use and its positive or negative social consequences in the future. Then, the purpose of this paper is to present the importance of the use of visibility map which can also be an outlook approach for detecting potential hot-spots in urban planning designs specially of new cities, for avoiding the negative using of urban spaces like "Crime" in the future. The case of study is the new city of Ali Mendjeli (Constantine - Algeria), the capital of the East of Algeria known by a very fast demographic and urban growth. After analyzing a central urban neighborhood of this city using Depthmap, we found thirty-four hot-spots which can be appropriate spaces for the exercise of crime in the future, and we found that this point was downplayed in the urban planning designs before the realization of Ali Mendjeli new city. يتلخص هذا البحث الذي هو في غاية الأهمية حيث تكمن في ضمانات الدستور لكل إجراء جنائي، ولكن ليس في الظروف العادية الطبيعية، فهنالك ظروف غير عادية وغير طبيعة، عرفناها بالظرف الاستثنائي وهذه الحالة يجب الضمان هنا وكذلك مراعاة الظروف ومدى إمكانية مراعاة الإجراء الجنائي باعتباره إجراء دقيقا ويجب أن لا يتضرر أي أحد في حالة الظرف الاستثنائي سواء كان جاني أو مجني عليه، من هنا، فإن الظروف الاستثنائية تستوجب مبادرة السلطة العامة، في اتخاذ تدابير عاجلة أو إجراءات استثنائية، لا تبيحها قـواعـد القانون المقررة في العادي من الظروف. ونتيجة لذلك نرى أن الدولة عندما تصادف بعض الظروف الطارئة تضطر إلى التحلل من بعض القواعد المقررة في القوانين المنظمة للحرية، إفساحا للمجال أمام قواعد مختلفة أكثر تقييدا وتضييقا، وحيث إن هذا الموقف يتم في حدود الدستور، ونصوص الدستور متكاملة متساندة، وكان يتوجب المحافظة دوما على النظام العام الدستوري، فإنه لا بد من ذكر مجال الضمانات الدستورية للإجراءات الجنائية في الظروف الاستثنائية. فتحديد هذه المسألة يستدعي تحديد الأساس، وانطلاقا من ذلك، تتخذ التدابير غير العادية، والتي تنسجم والظروف الاستثنائية في ظل دولة القانون.
Building materials play an important role in the architecture by providing the protection requirements, comfort, and technical performance while promoting an architectural language and an image. The impact of the building materials varies according to their properties: physical, chemical, mechanical and thermal. Also, each material has certain behavior to the environmental factors heat, humidity ... etc. so materials interact with these factors through conductivity, resistance. Therefore choosing the right building materials is a key factor in achieving a certain level of comfort inside the building. In this study, we investigate the impact and the thermal behavior of different materials and the most used building materials traditional and modern under the climatic conditions of Biskra a hot and arid climate. Also, we analyze the results of a different simulation using “ecotect5.0” to performed thermal analysis and we used “opaque3.0” and “u-wert” to figure some envelope proprieties in order to choose the best building material that ensures thermal comfort inside the building. The results show that choosing local massive materials and thermal insulation can achieve that to a certain degree.

يُعَدُّ خيار الرجوع في عقد البيع الالكتروني خياراً أقره المشرع في بعض القوانين التي تخص المستهلك ضماناً له من مغبة التسرع وعدم التفكير والتروي ، وهو يقدم على إبرام عقوده على السلع والخدمات ، دون التفحص والتمعن في مدى ملاءمة هذه السلع والخدمات لرغباته واحتياجاته، فيكون للمستهلك (المشتري) من خلالها الخيار الحق في فسخ العقد أو إمضائه خلال مدة زمنية محددة بنص القانون، وتُعَدّ من القواعد المتعلقة بالنظام العام التي لا يجوز الاتفاق على مخالفتها ، حمايةً للطرف الضعيف (المستهلك) من ممارسات البائع المحترف الذي يستخدم وسائل الضغط والإغراء من خلال الدعايات والإعلانات ، مما يغري الطرف الضعيف المستهلك(المشتري) من الإقدام على إبرام العقد دون تفكير وتروي ، وتبرز اثناء إستعمل خيار الرجوع بعض المشاكل العملية ، فضلاً عن إختلاف الآثار التي تترتب على طرفي العقد قبل وبعد إعمال خيار الرجوع في عقد البيع الالكتروني.
دفت هذه الدراسة إلى تقييم مواقع إنشاء بعض المدارس الابتدائية والكشف عن علاقته بالسلوك العدواني لدى طفل القسم التحضيري، ودراسة الفروق بينهم في مستوى هذا السلوك تبعا لتقييم لمتغير الجنس، ولتحقيق ذلك تم تطبيق الدراسة على عينة من أطفال التحضيري بلغت 80 طفلا وطفلة. ولغرض جمع بيانات الدراسة تم بناء شبكة ملاحظة لقياس السلوك العدواني الذي يبديه الطفل وتكييف مقياس لتقييم موقع المدارس، وباستخدام معامل الارتباط "سبيرمان للرتب" واختبار "ت" لدراسة الفروق بين متوسطين غير مرتبطين ولعينتين غير متساويتين توصلنا إلى النتائج التالية: وجود علاقة عكسية دالة إحصائيا بين التقييم الموقعي للمدرسة والسلوك العدواني لدى طفل القسم التحضيري، عدم وجود فروق ذات دلالة إحصائيا في درجات السلوك العدواني بين الجنسين. وخلصت الدراسة إلى جملة من الاقتراحات أهمها: محاربة التفكير التقليدي في إنشاء المدارس والذي يقوم على الفصل بين المعطى الفني ـــ التقني والمعطى البيداغوجي في عملية تصميم وإنشاء هذه المباني، مساهمة المختصين في مجالي التربية والتعليم في عملية اتخاذ قرار اختيار موقع البناء المدرسي وإبداء رأيهم حول بعض المعايير والمواصفات المساعدة على عمليتي التعليم والتعلم ذات العلاقة بالبناء المدرسي والفضاءات التي يوفرها، توفير الملاعب الرياضية المجهزة بما يناسب مستخدميها من التلاميذ؛ بغرض إتاحة الفضاء الضروري لإحساس الطفل بحريته.
This study aimed to evaluate the locations of selected primary schools and their relationship to the aggressive behavior of the pre-school child, and to study the differences between them by assessing the gender variable. For this purpose, the study was applied to a sample of 80 children and girls in the preparatory class. For the purpose of collecting data for the study, an observation grid was constructed to measure the child's aggressive behavior and adapt a scale to assess the location of schools. Using the "Spearman for Ranks" correlation coefficient and the "T" test to study the differences between two unrelated averages and two unequal samples, we achieved the following results: The presence of a statistically significant inverse relationship between the assessment on school location and the aggressive behavior of the child in the preparatory class; There are no statistically significant differences in the levels of aggressive behavior between the two sexes; In the end, this research is concluded with a set of proposals, the most important of which are the following: fighting against traditional thinking in the creation of schools, which is based on the separation of artistic-technical and pedagogical facts in the process of designing and constructing these buildings; The participation of specialists in education’s fields and teaching in the decision-making process for the choice of location of the school building and to give their opinion on certain standards and specifications helping in the teaching and learning process related to the school building and the spaces it offers; To provide equipped sports fields that are suitable for student users, in order to provide the necessary space for the development of the child.

ناقشت هذه الدراسة أحد أهم التداعيات القانونية لأزمة(covid-19)، وهي العلامة التجارية، وما ارتبط بها من تصرفات، كالسعي لتسجيل علامات جديدة تحمل اسم الفيروس بغية استغلال الوضع المأساوي لتحقيق الربح، وكذلك محاولات تزييف علامات أخرى، وما يمكن فعله للتصدي لذلك، خصوصا والأمر يتعلق بمنتجات وخدمات أغلبها ذات طابع طبي، مع ما يشكله ذلك من خطورة على صحة وسلامة المستهلك أولا، ويعكس ضعف الحماية القانونية للعلامة التجارية، ويمس بسلامة وأمن البلدان اقتصاديا، ويؤثر سلبا على قدرتها التنافسية.
إن التراث العمراني هو المجال المدني الذي يميزنا و يعبر عن شخصيتنا ، و هو بهذا مرتبط بالهوية الوطنية و بالشخصية الاجتماعية و المظهر الجمالي البصري للبيئة المحلية و مع ذلك فنحن هنا لم نتطرق إلى عمر المبنى و نوعه ، لأن التراث العمراني يمكن أن يكون قريبا جدا من الناحية الزمنية ، و يمكن أن يكون غائرا في التاريخ ، لكنه ما زال له أثر واضح في الفضاء الاجتماعي و الثقافي المعاصر ، لأن التراث العمراني مرتبط بالحياة المعيشية ، أي انه عمران حي يحمل إرثا تاريخيا عميقا متراكم عبر الزمن (ملتقى التراث العمراني2011 ، ص 10) خاصة فيما يتعلق بالحلول البيئية المنتهجة على مستواه ، حيث أنه و في هذا الإطار حاولت العديد من الدراسات الاستفادة من التجارب البيئية المعاصرة خاصتا منها الغربية دون أخذ الهوية الفكرية و الثقافية لمجتمعاتنا المحلية ، في حين ناقشت دراسات أخرى موضوع التراث العمراني بأسلوب تاريخي ، و هو شيء مطلوب ، و لكن خصائص التفكير في جوانب التراث العمراني من منظور بيئي معاصر تحتاج إلى الاهتمام بها بشكل أكبر.

يهدف هذا البحث الى تسليط الضوء على الانشقاقات في الاحزاب السياسية وتاثيرها على العملية السياسية في العراق بعد عام 2003 كما يهدف الى التعرف على مفهوم الانشقاق الحزبي ومفهوم الحزب السياسي كاطار نظري ومن ثم التعرف على الاحزاب السياسية بمختلف توجهاتها وما هي دوافع تلك الانشقاقات الحزبية وكيف تؤثر تلك الانشقاقات الحزبية على العملية السياسية من ناحية العملية التشريعية واثرها على صنع السياسة العامة وكيف اثرت تلك الانشقاقات الحزبية على الاستقرار السياسي واداء الحكومة العراقية بعد عام 2003 ,حيث اعتمد المنهج النظمي والمتمثلة بالمدخلات وهي الاحزاب السياسية والمخرجات المتمثلة بالانشقاقات الحزبية حيث توصل البحث الى مجموعة نتائج كان ابرزها أن جميع الأحزاب العراقية بمختلف التوجهات الإسلامية والعلمانية والقومية تعاني من ظاهرة الانشقاق والتشظي، ويرجع السبب في ذلك إلى عدة عوامل ومنها العامل الشخصي والمتمثلة في الحصول على النفوذ داخل العميلة السياسية لاسيما أن شعار أغلب النخبة السياسية في العراق هو المكاسب والنفع الشخصي، وقد يكون انشقاق الشخصي عن الحزب هو الصراع على زعامة الحزب نظراً لامتيازات التي يتمتع رئيس الحزب على الصعيد المادي والمعنوي، إذ تتصور النخبة السياسية أن من حق كل كتلة فازت بالانتخابات حتى لو كان الفوز على شكل مقعد أن تشارك في الحكومة واوصى البحث على الاحزاب السياسية العراقية بمختلف التوجهات الاسلامية والعلمانية ترك الصراعات على زعامة الحزب والمنافع الشخصية وان تكون العملية السياسية تتصدرها النخبة السياسية الفائزة بالانتخابات حتى لو كان الفوز على شكل مقعد ان تشارك في الحكومة على اساس الحق الدستوري .
تعالج هذه الدراسة موضوعا مهما متمثلا في تحليل أنماط التوزيع المكاني للمراكز العمرانية بولاية بسكرة بهدف استنباط الحالة التي آلت إليها حسب أماكن توزيعها وروابطها والعلاقات التي تنشأ بينها بقدر أحجام التجمعات العمرانية وتدرجها، والتي من خلالها سنتمكن من معرفة اتجاهات التركز السكاني وتحديد مدى ميل السكان إلى التركز في منطقة معينة داخل حدود الإقليم دون سواها، والتبعثر في مناطق أخرى، حيث خلصت الدراسة المنجزة على ولاية بسكرة وبعد قياس التركز السكاني أن سمة التمركز هي السائدة في الولاية بدليل معامل (هوفر) للتركز الذي بلغ القيمة (60.11% ) عام 1998 ولم يتعدى (57.60%) عام 2015 وهي نسبة تميل إلى التركز الحضري للسكان أكثر منا إلى الانتشار، مما أثر على البنية الهرمية للمراكز العمرانية المكونة لإقليم ولاية بسكرة
This study deals with an important topic of analyzing the spatial distribution patterns of the urban centers in the State of Biskra with a view to developing the situation they have reached by their distribution locations, links and relationships that arise between them as much as urban clusters are sized and listed. Through which we will be able to identify trends in population concentration, determine the extent to which the population tends to be concentrated in a particular region only within the boundaries of the Territory, and to be scattered in other regions, The study carried out on the state of Pescara and after measuring the population concentration, concluded that the state's dominant position is the index of concentration (Hoover), which reached 60.11% in 1998 and did not exceed (57.60%) in 2015, a ratio that tends to be more urban concentration of the population than spread. This has affected the hierarchical structure of the urban centers that make up the province of Biskra

يروم هذا البحث الإسهام في التصدي للشبهات المعاصرة التي تسعى لتعطيل أحكام الميراث في الإسلام؛ وذلك من خلال تجلية أوجه القصور والظلم في تقسيم الميراث داخل الشرائع والنظم الوضعية القديمة والحديثة، والكشف عن مزايا أحكام الميراث في الإسلام، وفلسفتها، ومقتضياتها. وقد خلص البحث إلى التأكيد على تفوق أحكام الميراث في شريعتنا الإسلامية على سائر الشرائع والنظم؛ بما تتميز به من وسطية واعتدال، وباعتبار نظرها الشمولي الذي يراعي أبعاد مختلفة في تقسيم الميراث: من أهمها: الفطرة الإنسانية، والجوانب الوجدانية، والقيم الأسرية، والحرص على جلب المنافع ودفع المضار عن الناس، والنظر إلى التكاليف المنوطة بالإنسان داخل نظام الأسرة. في مقابل ذلك تبين لنا أن معظم الشرائع والنظم القديمة والحديثة تتسم قوانينها في الميراث بالنظر الجزئي؛ وتطغى فيها النظرة المادية على الجوانب الوجدانية والقيمية، ولا تتوافق مع مقتضيات النظام الأسري والاجتماعي.
تتناول هذه الورقة البحثية موضوع الفن العمراني للمدينة الاسلامية، هذا الفن الذي يتميز بالبساطة والتنوع التناسق يعكس صورة واضحة لقيم التسامح والتضامن والتعاون التي جاء بها الدين الاسلامي الذي يعتبر منهجا وطريقة واضحة في تشييدها وفق ثلاثة مبادئ المتمثلة في: التخطيط العمراني، التصميم العمراني، والتسيير. فمن خلال مظهرها العام يتبين لنا أنها لم تنشأ نتيجة دراسات أو تخطيط مسبق، بل وجدت كنتاج تفاعل الانسان مع بيئته الجغرافية وخلفياته الاجتماعية والاقتصادية والثقافية والدينية. هذه الاخيرة كان لها دور بارز ومهم في كل ما يقام من مساجد وسكنات ومدارس...الخ. ليتشكل نسيج اسلامي متميز يعبر عن أسلوب ونمط معيشة المجتمع بكل تفاصيلها وفق مبادئ وتعاليم الدين الاسلامي. وعليه من خلال هذا البحث سنحاول تحليل العناصر التخطيطية والمكونات العمرانية للمدينة الاسلامية التي تهدف على ارساء ثقافة التضامن والتسامح بين أفراد المجتمع. معتمدين في ذلك على المنهج الوصفي التحليلي.
This research paper addresses the subject of urban art in the Islamic city, this art is characterized by simplicity and diversity. The symmetry reflects a clear image of the values of tolerance, solidarity and cooperation that the Islamic religion brought, which is considered a Approach and a clear way of constructing it according to three principles represented in: Urban planning, urban design, and management. From its general appearance, it becomes clear to us that it did not arise as a result of studies or prior planning. Rather, it is found as a product of human interaction with his geographical environment and his social, economic, cultural, and religious backgrounds. The latter had a prominent and important role in everything that was established, including mosques, dwellings, schools... etc. To form a distinctive Islamic structure that expresses the society's lifestyle in all its details. According to Islamic principles and teachings. تتطلب مهنة الطب من الطبيب ان يكون رحيماً ويبذل اقصى جهد وعناية لشفاء المريض وهذا ما تقتضيه الاصول المستقرة في مهنة الطب وتظهر الاشكالية لقيام المسؤولية الطبية في حالة ارتكاب الطبيب بعض الاخطاء الطبية وما يلحق بها من اضرار يستوجب التعويض عنها. ونظراً لحساسية ودقة هذا النوع من العلاج وما يتطلبه من توفير الادوات والأجهزة الطبية الحديثة، وما رافق العلوم الطبية من تطورات تقنية بالاعتماد على اساليب العلاج الحديثة ودقة الفحوصات والعينات ولكثره الاخطاء وصعوبة اثباتها، فان بقيام مسؤولية الطبيب يحق للمريض المضرور المطالبة بالتعويض عن الاضرار المادية والمعنوية التي لحقت به نتيجة خطأ الطبيب. وما دامت المسؤولية العقدية هي جوهر عقد التطبيب عن بعد فإن بمجرد اخلال الطبيب بالتزامه محل العقد تنهض المسؤولية المدنية للطبيب ولا يستطيع التخلص منها إلا بأثبات السبب الاجنبي وعدم تحقق النتيجة.
L’architecture scolaire évolue à mesure de l’évolution des tendances pédagogiques dont elle est étroitement liée au service de l’efficacité scolaire des élèves. C’est ainsi que l’école, devenue un édifice spécifique il y a seulement quelques siècles, a connus différents styles architecturaux à travers l’histoire à savoir l’école traditionnelle refermée des pays francophones, l’école ouverte et modulable mais controversée des pays anglo-saxons et l’école standardisée après la Seconde Guerre mondiale. Par le biais du présent travail, nous passerons globalement en revue les différentes tendances de l’architecture scolaire depuis son essor. Nous soulignerons également les principaux impératifs pédagogiques érigés pour tout projet d’architecture scolaire, en souhaitant ainsi donner quelques pistes pour la conception d’un bâtiment scolaire et également de soulever une question à laquelle on devrait réfléchir sur l’école future : doit-on concevoir pour demain avec les conceptions d’hier ?

تعدُّ جريمة العدوان جريمة دوليّة؛ إذ تجد أساسها القانونيّ بالوصف المذكور في نصوص ميثاق الأمم المتّحدة، و الضمير الدوليّ، وهي تمثّل مساسًا و اعتداءً من قبل دولة ما ضدّ السلامة الإقليميّة ، أو الاستقلال السياسيّ لدولة أخرى؛ فيكون فعل الاعتداء منافيًا لميثاق الأمم المتحدة ، والهدف هو الاحتلال لغاية ما، أو ضمّ إقليم ما أو جزء منه لدولة أخرى، ليترتب معه تحقيق المسؤوليّة الدوليّة للدولة المعتدية ، مع جزاء يُفرض من قبل السلطة المختصّة يتناسب مع حجم الجريمة وما تسبب به هذا الفعل من ضرر.
As part of the field of reflection inherent in reconciling cities with their users, greenspaces seem to be an inseparable part of the urban puzzle, the aggregate of whichaspires to sustainable development, their efficient management gives the city a qualitythat contributes to changing its image. These green spaces come in various forms(gardens, parks, squares, wastelands, etc.), forms that can be grouped into differentcategories according to their status, function and membership.The reflections carried out around the theme of green spaces, resulted in their totalityin a typological classification subordinated to the size, content and location of thesegreen spaces in the city. The result is a range of categories, of which the oneconsidered most in demand in a city by citizens is that of "non-specialised urbanpublic green spaces". Open to the public, located in an urban environment and withspatial robustness, this category of green space will be the subject of our study.In this study, we will therefore focus on evaluating the non-specialized public urbangreen spaces in Bejaia City in terms of quantity, quality and spatial distribution. Ananalytical study that will involve highlighting a set of conventional standardsidentified from the emblematic example of the city of tower in France, which willserve as a model to be followed in the form of a theoretical analysis grid. Thisinvestigation emphasizes the need and importance of taking charge of non-specializedurban public green spaces when working on urban composition, and on the essentialparameters to be considered when designing them.
Inscrit dans le champ de réflexion inhérent à la conciliation des villes avec leurs usagers, les espaces verts semblent être une pièce indissociable du puzzle urbain dont l’agrégat aspire à un développement durable, leurs efficiente prise en charge confère à la ville une qualité qui contribue au changement de son image. Ces espaces verts se présentent sous diverses formes (Jardins, parcs, squares, friches ...etc.), des formes qui peuvent être regroupées dans des catégories différentes selon leur statut, leur fonction, et leurs appartenances. Les réflexions menées autour de la thématique des espaces verts, se sont soldées dans leur totalité par une classification typologique subordonnée à la taille, au contenu et à la localisation de ces espaces verts dans la ville. Il en ressort une palette de catégories dont celle considérée comme étant la plus demandée dans une ville par les citoyens, est celle des «espaces verts urbains publics non spécialisés ». Ouverte au public, située en milieu urbain et jouissant d’une robustesse spatiale, cette catégorie d’espaces verts fera l’objet de notre étude. Nous nous intéresserons donc, dans cette présente investigation à évaluer les espaces verts urbains publics non spécialisés de la ville de Bejaia, en termes de quantité, de qualité, et de répartition spatiale. Une étude analytique qui passera par la mise en exergue d’un ensemble de normes conventionnelles décelées de l’exemple emblématique de la ville de tour en France, qui nous servira d’un modèle à suivre sous forme d’une grille d’analyse théorique. Cette investigation met l’accent sur la nécessité et l’importance de la prise en charge des espaces verts urbains publics non spécialisés lors d’un travail de composition urbaine, et sur les paramètres incontournables à considérer lors de leur conception.

جاء هذا البحث بعد قراءة واطلاع لكثير من الأبحاث والمنشورات، وكذلك الحضور الوجاهي والإلكتروني لكثير من ورشات العمل التي تتناول موضوع المرأة ومكانتها، وما تتعرض له من عنف وتنمر سواء من الأسرة أو المجتمع الذي يخضع للعادات والتقاليد، والذي يصفوه بالمجتمع الذكوري. ومن خلال البحث والاطلاع توصل الباحث إلى جملة من النتائج والتي أهمها.أن مشرع تمكين المرأة الذي طرحته الأمم المتحدة هو عبارة عن غزو فكري للثقافة العربية والإسلامية، أن هذا المشروع جاء ليحرر المرأة من أخلاقها وينزع عنها عفافها، وينقلها من ملكة في مملكتها إلى سلعة يتناولها من يتناولها في سوق النخاسة، أن لمقصود من تمكين المرأة هو استقواؤها على الرجل، وتمردها عليه وعلى المجتمع، وهذا ما جاءت به الترجمة الحقيقية للعبارة الواردة في وثيقة الأمم المتحدة في مشروع التمكين، والتي هي: [ Women Empower ment ] في حين أن المراد لكلمة "تمكين" في اللغة الإنجليزية هو: [ Enabling ] وهو مفهوم منبثق من عمق الحداثة الأوروبية والأمريكية، أن هذا المشروع هو مشروع سياسي استعماري مبني على أن انهيار المجتمع العربي يأتي من الداخل في ضرب أهم عناصره، ألا وهي المرأة، أن الإسلام هو النظام الوحيد الذي كرم المرأة في كل مجالات حياتها، وحافظ عليها وشاركها في كل مفاصل الدولة، إن واقع الحال في عصرنا، وفي مجتمعاتنا العربية من اضطهاد بعض الرجال أو المجتمع للمرأة بسبب عادات سيئة جاهلية موروثة لا يمثل الإسلام في شيء، إنما هو انحلال عن قيم الإسلام الذي جاء بها النبي ﷺ.
تعتبر المساحات الصديقة للطفل عنصر مهم من المساحات الخضراء ومكون ذو تأثير قوي على البيئة الحضرية وعلى مستقبل الطفل داخل المجال العمراني. وبالرغم من أن هذه العناصر أصبحت ضرورة ملحة في وقتنا الحالي باعتبارها جزء أساسي لا يمكن إهماله في المدينة؛ إلا أن الكثير من المخططين و المسيرين يتغاضون عنها ويتم التركيز على العناصر التقليدية المشكلة للجهاز العمراني داخل المدينة (مساحات خضراء مهيأة ،متنزهات، حدائق...). وتهدف الدراسة للبحث في إمكانية إقامة بيئة حضرية متوازنة تلاءم احتياجات الطفل في منطقي الدراسة "المنطقة الحضرية زواغي بعين الباي و الوحدة الجوارية 16 بالمدينة الجديدة علي منجلي" وذلك من خلال دراسة المنطقتين من الناحيتين التصميمية والتخطيطية. سنتطرق خلال هذه الدراسة إلى تشخيص الواقع الحقيقي للمساحات الصديقة للطفل للمنطقتين المدروستين وإجراء مقارنة بين ما هو موجود بالواقع و ما تم التخطيط له باعتباره المكان المؤثر على تكوين شخصية الطفل بهدف تلبية احتياجاته و أولوياته. كما اعتمدنا على منهجية تحليلية لهذه الدراسة لمعرفة ما يرغب به الأطفال و أولياء أمورهم و بين ما هو موجود بهدف الوصول إلى رؤية حقيقة واقعية لمجالي الدراسة. وكذلك معرفة الوسيلة و المنهجية المناسبة للتحول نحو نموذج المدينة الصديقة للطفل، فهي البيئة التي تسمح للأطفال وبقدر عال من التفاعل في المدينة.

عندما يتعدد المالكون فإن الملكية في هذه الاحوال تسمى الملكية على الشيوع ،وهي ملكية ذات طبيعة خاصة ، اذ تنص المادة (1061/1) من القانون المدني العراقي النافذ على انه :اذا ملك اثنان او اكثر شيئا فهم شركاء فيه على الشيوع وتحسب الحصص متساوية اذا لم يقم الدليل على غير ذلك. فبناء على ما تقدم يعتبر شراكة العقار النموذج الأمثل لشركة الأشخاص لأنها تحتوي علي جميع مميزات هذه الشركات فهي تنشأ علي أساس الاعتبار الشخصي وتنقضي بانقضائه وقد يكون فيه اما عن وراثة او ازالة الشيوع ويحق للشريك التصرف منفردا في العقار بعد ازالة الشيوع وهي من الدعاوى التي كثيرا ما تقام امام القضاء والغرض منها انهاء حالة الشيوع بين الشركاء وسواء كان المال منقولا او عقارا وسواء كان مسجلا بأسماء الشركاء او بأسماء مورثهم وان اجراءات هذه الدعوى تكون على مرحلتين مرحلة تنظرها محكمة البداءة بصفتها محكمة ومرحلة تنظرها وتباشر بها بصفتها مديرية تنفيذ وقاضيها بصفة منفذ عدل .
إن المدينة هي مكان تجمع للأنشطة و السكان، و بما أن الموارد البشرية الثروة الحقيقية لأي مدينة، يعدّ الأطفال على رأس تلك الثروة لكونهم جيل المستقبل، من هنا يتضح أن معالجة مجال الأطفال في المدينة هو ضرورة ملحة، حيث يجدون في المدينة و خاصة في مجالها العمومي المليء بمختلف التجارب و الدروس إجابة لكثير من احتياجاتهم. هذه المقالة تتعرض إلى إشكالية تتعلق بالتهميش و الإهمال الذي يتعرض له الأطفال بفعل غياب مجالات لعب آمنة و الذي يعكس تجاهل الهيئات المسؤولة لاحتياجات هذه الفئة ومتطلباتها،من خلال دراسة المدينة الجديدة علي منجلي ،و كعينة للدراسة أخذنا الوحدة الجوارية رقم 07 حيث أثبتت الدراسة أن هذه الأخيرة تفتقر إلى مجالات لعب الأطفال و الموجودة منها تعاني من الإهمال و التلوث و بالتالي فان المجالات المبرمجة في مخططات التهيئة لمجال الدراسة لا توافق ما هو موجود على ارض الواقع، كما أصبحت ممارسات الأطفال للعب و غيرها تتم على مستوى الأرصفة ،مواقف السيارات ،الطرق و المساحات الشاغرة
