المساعدة القضائية وهو نظام اعتمده المشرع لمساعدة من اجتمعت لديه عاهتين من اصل ثلاث عاهات اصم ابكم اعمى أو المصاب بعجز جسماني شديد للتعبير عن ارادتهم وذلك من خلال تعين مساعد قضائي لهم ولقد اختلفت التشريعات في نوع هذه الحماية فمنهم عين مساعد قضائي ليساعده في التعبير عن ارادته فجعل من هذه الإصابة مانع من موانع الاهلية ومنهم نصب عليه وصي كالقانون العراقي وحجر عليه حيث جعل المشرع العراقي المساعد القضائي بحكم النائب وجعل المصاب بهذه العاهات وكأنها عارض من عوارض الاهلية لذلك كان على المشرع العراقي ان يعين له مساعد قضائي لان الوصي يعبر عن ارادته وليس إرادة المصاب بعاهة مزدوجة او مصاب بعجز جسماني شديد بينما عند تعين المساعد القضائي له فهو يساعده في التصرف محل المساعدة القضائية أي إرادة الأصيل موجودة وهو المساعد قضائياً لأنه يشارك المساعد القضائي في ابرام التصرف محل المساعدة القضائية ، ولكي يتقرر المساعدة لابد ان يكون هناك شخص مصاب بعاهة مزدوجة او عجز جسماني شديد ويكون كامل الاهلية لكن تمنعه الإصابة من التعبير عن ارادته وان المشرع العراقي نص على حالة ذوي العاهتين ولم ينص على حالة المصاب بعجز جسماني الشديد في المادة (104) من القانون المدني العراقي من اجل ذلك تهدف الدراسة الى تعديل المادة (104) من القانون المدني العراقي فضلاً عن اقتراح نصوص اخرى تتعلق بموضوع الدراسة .
تُعنى هذه الدراسة تحديدًا بالتوظيف الساخر للتناص في أدب الكاتب الليبيّ الصادق النيهوم، وليس في سائر أدبه، وقد سعينا من خلال الدراسة إلى إعطاء نبذة مختصرة عن الصادق النيهوم بصفته كاتبًا ليبيًّا ساخرًا، والوقوف على مصطلح التناص، وتناول الدوافع التي جعلت النيهوم يستدعي النصوص السابقة في أدبه الساخر، ودرسنا المصادر التي استقى منها موادّه التناصيّة الدينيّة منها والأدبيّة، فسبرنا أغوار أدب النيهوم الساخر، وفصّلنا القول في أشكال التناص التي ظهرت في نصوصه الساخرة، وآليّات توظيف النصوص التي استدعاها من المصادر الدينيّة (القرآن الكريم، والحديث النبويّ الشريف، والكتب السماوية الأخرى)، ومن المصادر الأدبيّة (الشعر، والأمثال)، فوقفنا على التناص الموافق والمضاد، وعلى آليّات الترصيع، والبتر، والإيجاز، والتشويش، والقلب، وبيّنا الوظيفة الساخرة التي اضطلع بها التناص في أدب النيهوم.
This study is concerned particularly with the satirical use of intertextuality in the literature of the Libyan writer, As Sadeq An Naihoum. Through this study, we strived to introduce a brief overview of the writer as a Libyan satirical writer, to identify theintertextuality term, and to address the motives that made An Naihoum apply the previous texts in his satirical literature.Moreover, the study investigates the sources from which the writer drew his religious and literary intertextual materials. The satirical An Naihoum's literature has been studied in-depth and detailed the forms of intertextuality that appeared in his satirical texts, and the mechanisms of using the texts he recalled from religious sources (the Holy Qur’an, the Prophet’s hadith, and other divine books ), and literary sources (poetry, proverbs). Also, the study addresses the corresponding and opposite intertextuality, the mechanisms of inlay, amputation, brevity, confusion, and reverse. Additionally, the satirical function played by intertextuality is highlighted in AnNaihoum's literature

لم تتفق القوانين والتشريعات المقارنة حول تحديد الأنموذج القانوني للجرائم الاقتصادية ، فالبعض يتوسع في مفهوم تلك الجرائم لتشمل كافةالاعتداءات التي تمس النظام الاقتصادي والسياسة الاقتصادية في الدولة، بينما يحصر البعض مفهوم تلك الجريمة في الجرائم المتعلقة بالأسواق والتبادلات الاقتصادية فقط دون غيرها. وفي إطار بيان الأنموذج القانوني للجريمة الاقتصادية فقد قسمنا هذا البحث إلى مبحثين ، المبحث الأول يوضح ماهية الجرائم الاقتصادية، أما المبحث الثاني فيتناول البنيان القانوني للجريمة الاقتصادية وتطبيقاتها، وفي نهاية البحث توصلنا إلى أن الطبيعة الخاصة للجرائم الاقتصادية جعل لها طابع قانوني خاص، سواء من حيث أركانها التي تقوم عليها أو من حيث قواعد المسؤولية الجنائية عن تلك الجرائم والعقوبات المقررة فيها، فتلك الطبيعة الخاصة جعلت تلك الجريمة تخرج في كثيراً من الأحيان على المبادئ العامة القانونية المطبقة في الجرائم الجنائية الأخرى، كما أوصينا كلا من المشرع العراقي والمصري بإصدار قانون العقوبات الاقتصادي ليكون خاص بتجريم كافة صور الجرائم الاقتصادية وتقرير الأحكام والعقوبات التي تتفق وطبيعة تلك الجرائم.
يعالج المقال ظاهرة التناص الشعري عند محمد جربوعة، حيث انطلق من مفهوم المصطلح ثم وقف عند تجلياته في شعره داخليا و خارجيا، ليعرج إلى طريقة الشاعر في محاورة النصوص الشعرية السابقة لإعادة إنتاج نصوص شعرية جديدة متكئة على ما سبقها. وبالاعتماد على المدونة الشعرية للشاعر محمد جربوعة ، و بتطبيق آليات المنهج الأسلوبي سنحاول الوقوف على هذه الظاهرة الشيقة بأبعادها وخلفياتها، لبناء نص جديد بصور جديدة ودلالات مختلفة.
This article deals with the phenomenon of poetic intertextuality at Mohamed Djarbouaa, where he started from the concept of the term and then stopped at its manifestations in his poetry internally and externally, to refer to the poet’s method in the dialogue of previous poetic texts to reproduce new poetic texts based on what preceded them. Relying on the poetic blog of the poet Mohamed Djarbouaa, and applying the mechanisms of the stylistic approach, we will try to stand on this interesting phenomenon with its dimensions and backgrounds, to build a new text with new images and different connotations.

يؤدي مبدأ قابلية التوقع دورًا هامًا في القانون الدولي الخاص، لاسيما في ميدان تنازع القوانين بوصفه من الموجهات الاساسية لقواعده القانونية، فلا حديث عن قيمة اي قاعدة قانونية إلّا بالنظر إلى درجة استقرارها ومدى حمايتها للحقوق والمراكز القانونية، وما يستتبع ذلك من ثقة الناس في النظام القانوني ككل على نحو يمكن القول معه إن جوهر مبدأ قابلية التوقع للاشخاص هو عنصر الثقة المشروعة المتمثل بحماية توقعاتهم المتعلقة بتحديد القانون الواجب التطبيق، والعلم بمضمونه، وفي اطار تنازع القوانين إذا كانت قاعدة الاسناد، قادرة على تحقيق المستوى الأول من التوقع القانوني، فإنها تعجز عن توفير المستوى الثاني، لكونها قواعد حيادية غير مباشرة قد يطبقها القاضي دون العلم بمضمونها، فالاخير يجري اختيارًا وهو معصوب العينين دون أية معرفة للحدود الحقيقية لتلك القواعد، لذا؛ فإن إعمالها يثير العديد المسائل التي تؤثر بشكل أو بآخر بعمل مبدأ قابلية التوقع في مرحلة تحديد القانون الواجب التطبيق، كالاحالة، والمسائل الأولية، كما قد تحدث حالات يتعذر بموجبها تطبيق القانون الأجنبي الواجب التطبيق بالشكل الذي يؤدي إلى إنهيار البناء النظري والمنهجي لقاعدة التنازع، ومن ثم إنهيار دعائم التوقع القانوني القائم فيها، كما في حالة إستبعاد تطبيق القانون الاجنبي الواجب التطبيق بسبب مخالفته للنظام العام في قانون القاضي، أو إستحالة معرفة مضمونه.
يسعى هذا البحث الموسوم بسيميولوجيا الشخصيات الروائية في رواية "الغول الذي يلتهم نفسه" لـــ "الزهرة رميج" لفك شفرات ودلالات الخطاب الروائي للتعرف على ما تخفيه الرواية المغربية من جمالية وانزياح، كون هذا العمل من الأعمال التي تشغل عالم الأبحاث الأدبية والنقدية أي عالم الكتابة، إضافة إلى استنطاق الشخصية من منظور سيميائي كونها علامة احتلت مكانة بارزة في عالم الرواية، وللتعرف على الملامح والأبعاد المختلفة التي تحملها ثنايا الشخصية الواحدة من خلال حياتها في عالم العلامات.
This research, tagged with the semiology of the narrative characters in the novel "The Ghoul Who Devoured Himself" by "Al-Zahra Ramij", seeks to decipher the codes and implications of the narrative discourse to identify what the Moroccan novel hides of aesthetics and deviation, as this work is one of the works that occupy the world of literary and critical research, ie the world of writing. In addition to examining the character from a semiotic perspective, as it is a sign that occupied a prominent position in the world of the novel, and to identify the different features and dimensions that one character carries through her life in the world of signs.

الجنسية هي الأعلى وأبعد ما تكون عن كونها ورقة أو وثيقة تصدر بموجب القانون. بل هو الارتباط الروحي للفرد بالوطن، وهو معيار عالمي لكل دولة في العالم لتحديد عمود الشعب في الدولة، وتمييز مكوناتها من الأجانب والمواطنين، وكذلك للتمييز بين الوطنيين الأصلي والطارئ. لذلك فإن الجنسية هي الأداة التي تحدد حصة كل دولة من الأفراد الذين يتكون منهم الشعب، ولها أهمية كبيرة بالنسبة للفرد والمجتمع والدولة والمجتمع الدولي بشكل عام نظرا لضرورتها الاجتماعية وضرورة وما يترتب عليه من آثار قانونية من حيث الحقوق والالتزامات العامة والخاصة. ولذلك فإن ازدواجية أو تعدد الجنسيات هو أن يكون الفرد يحمل جنسيتين أو أكثر حتى يصبح وطنيا في أكثر من دولة، ولكل دولة أسس وقواعد وتشريعات تختلف من حيث الفرض والاكتساب والخسارة والخسارة. التعافي من الدول الأخرى حسب ظروفها ومصالحها، والحقوق العامة متعددة، وسنقتصر هذه الدراسة على الحقوق السياسية التي يتمتع بها مزدوجو الجنسية دون غيرهم. الحقوق العامة الأخرى، بالإضافة إلى دراسة أسباب وحالات الازدواجية، ولا شك أن هناك مشاكل كثيرة تنجم عن مسألة ازدواج الجنسية، خاصة عندما يشغل منصبا رفيعا. مسؤول أو ضابط أمني رفيع المستوى، وقد بينت هذه الدراسة هذه المشاكل وغيرها، وكيفية معالجتها من خلال القوانين الوطنية والاتفاقيات الدولية، مع أن الحقوق السياسية تدخل في نطاق القانون العام من حيث تنظيمها وشروط الحصول عليها. ممارستها، ولكن طبيعة البحث تقتضي دراستها في نطاق القانون الخاص. والأساس القانوني لهذه الحقوق هو الجنسية.
فرض عصر التطور التكنولوجي على العديد من الأدباء و المبدعين التوجّه إلى كتابة الأدب الرّقميّ،و لا شكّ في أنّ فنّ الرواية قد عرف طريقه نحو الرّقمنة ،حيث صارت مختلف البرامج و التطبيقات المساعدة في صناعة هذا النوع من الأدب مطلوبة من طرف الروائيين المعروفين أو غيرهم من الكتّاب المهمشين الذين لم يجدوا طريقا للنشر و الترويج لرواياتهم ،لتفتح الشابكة مختلف نوافذها و فضاءاتها الرقمية لاحتضان الرواية الرقميّة/التفاعلية التي تميّزت بخصائص و تقنيات سرديّة وإخراجية مختلفة ،سواء من ناحية المضامين ،أو من الناحية الشكلية ؛ التي تخص فنيّات العرض البصري للمحتوى اللساني و المحتوى التشكيلي للمدوّنات الروائية.

The postmodern poem is a picture of a new human and cognitive cultural system. It is a new being with a new name and a special, independent identity that inherits from the other; But not belonging to him, this identity of hers is realized by digital literature that transcends oral and paper.

بشكل عام يعتبر مبدا الشفافية من المصطلحات الحديثة نسبياً في المجال الإداري فرضته متطلبات التنمية ، اذ ان الفعل أو النشاط يعد شفافاً إذا كانت المعلومات الخاصة به متوفرة وواضحة ،وذلك يتيح لمن لهم مصلحة أن يكون لهم دور في الكشف عن عيوب النشاط محل الشفافية وبالتالي حماية مصالحهم ،اذ ان جوهر الشفافية يقوم على العلانية والوضوح ووفرة المعلومات الخاصة بالعمل هذا من جانب، ومن جانب اخر يعد عيب الانحراف من العيوب الخفية الذي يصعب الكشف عنه ويتمثل باستغلال المنصب لتحقيق أهداف شخصية على حساب الصالح لعام ،ومن هذا وذاك يبدو ان هناك علاقة مباشرة بين علنية الشفافية وتستر عيب الانحراف بالسلطة وهي علاقة عكسية ، فكلما ارتفعت مؤشرات الشفافية انحصرت صور عيب الانحراف بالسلطة وانكشفت على نحو اسرع، لان هذا العيب لا ينمو إلا في ظل عدم الشفافية ، أو كانت دون المستوى المطلوب.
تهدف هذه الدراسة إلى بيان مدى ارتباط الشعر العربي بالموسيقى ارتباطا وثيقا، بحيث لا يمكن الاستغناء عنها في عمليتي الإبداع والتلقي. كما تسعى إلى إبراز دور شعراء المهجر وبخاصة شعراء الرابطة القلمية في تجديد موسيقى الشعر العربي بالدعوة إلى التحرر من قيود الخليل بن أحمد. تبين من خلال هذه الدراسة أن تجديد الموسيقي الذي دعا إليه شعراء الرابطة القلمية لم يجد القبول الكامل من شعراء الرابطة أنفسهم، وأن جهودهم لم تأت بنظام موسيقي بديل لنظام الخليل، نظام مغاير تماما لموسيقى الشعر العربي القديم؛ لذلك بقيت دعوتهم للتجديد محدودة قيد النظرية، ولم ترق إلى مستوى التطبيق الفعلي.
This study aims to show to what extent the Arab poetry is closely connected to rhythmical poetry, in such a way it is impossible to do without both in innovation and poetry reading. We also, aim to show the rôle of expatriate poets, mainly those affiliated with the Pen League, calling to be freed from the meters of the rhythmical poetry of Al-Khalil ibn Ahmad al-Farahidi. It cornes out from this study that calls, from the Pen League poets to renew the rhythmical poetry did not find acceptance even among the League poets itself. Ail their efforts did not bring an alternative to the established system, that would be entirely différent from the ancient rhythmical poetry. For this, their calls for change did not find echoes and stayed at the theoretical level.

يهدف هذا البحث الى توضيح دور طاقم الطائره وفقا لطبيعة البيئة التي تعمل فيها الطائرة وهي الفضاء الجوي ، وبُعدها عن سطح الأرض وعن الرقابة المباشرة لسلطات الدولة عليها أثناء الرحلة الجوية ، لذى لابد من وجود سلطة تعمل على حفظ النظام في تلك الأداة ، وقد تمثلت هذه السلطة بقائد الطائرة. ولقائد الطائرة مركز قانوني ذو طبيعة خاصة، إذ أوكلت الاتفاقيات الدولية والقوانين الوطنية إليه سلطات واسعة ، فهو الذي يتولى مهمة قيادة الطائرة ، والإشراف على الطاقم الذي يتولى تنفيذ المهام الفنية والخدمية اللازمة لعمل الطائرة في الفضاء ، وله الإشراف على الركاب واتخاذ القرارات الملائمة إذا ما تعرضت الطائرة لظروف طارئة . تنبع أهمية هذا البحث من أهمية الدور الذي يقوم به قائد الطائرة ، واضطلاعه بمهام جسيمة تتعلق بحماية حياة الركاب وباقي أفراد الطاقم والمحافظة على سلامة البضائع أو الأمتعة التي تتولى الطائرة نقلها ، فضلاً عن تأمين سلامة الطائرة بوصفها من قبيل المنقولات باهظة القيمة. تتمثل مشكلة الدراسة في أن القوانين الوطنية والاتفاقيات، وعلى الرغم من حرصها على تنظيم الجوانب المتصلة بعمل قائد الطائرة، ومنها ما يتعلق بالشروط الواجب توافرها فيه وتحديد صلاحياته وواجباته ، إلا أنها أغفلت تنظيم الكثير من المسائل، ومنها ما يتصل بالجوانب التفصيلية المتصلة بمسؤوليته عن أعماله ، هذا فضلا عن ندرة الدراسات القانونية التي عالجت المركز القانوني لقائد الطائرة. إن هذه الدراسة تهدف إلى بيان كل ما يتعلق بالمركز القانوني لقائد الطائرة ، والتي تتمثل بتحديد مفهوم قائد الطائرة ، وبيان طبيعة العقد الذي يربطه بالمستثمر.
لقد نالت الاستعارة اهتمام البلاغيين منذ القديم، فعملوا على دراستها وتعريفها واظهار حسنها وجماليتها، وبيان بلاغتها وتباروا في تقسيمها وتوضيح الهدف منها وبيان العلاقة بينها وبين الصور البلاغية الأخرى، فللاستعارة أهمية كبيرة في العمل الأدبي، نظرا لما تنطوي عليه من وظائف تكسب المعنى قيمة جمالية إلى جانب قيمتها التعبيرية إضافة إلى هذا فقد عدّت الاستعارة ضمن النظرية اللسانية الحديثة (الحجاجية) أداة من أدوات الإقناع لما لها من أثر في اللغة والفكر على حد سواء. وتسعى هذه الدراسة لربط الموروث البلاغي ممثلا في الاستعارة البلاغية، بالدرس اللساني الحديث ممثلا في الاستعارة الحجاجية التداولية التي تدخل ضمن الوسائل اللغوية التي يستغلها المتكلم بغرض توجيه خطابه، وبقصد تحقيق أهدافه الحجاجية، والاستعارة الحجاجية هي النوع الأكثر انتشارًا لارتباطها بمقاصد المتكلمين وبسياقاتهم التخاطبية والتواصلية.
The metaphor has aroused the interest of rhetoricians since antiquity, so they strove to study it, define it, show its aesthetic side, present its rhetorical force with a rivalry to divide it into subcategories, clarify its purpose by showing its relationship to other figures of speech. Indeed, metaphor has a great importance in the literary work because of the functions that it contains and which give the meaning an aesthetic and expressive values. Moreover, the metaphor is introduced in modern linguistic theory (argumentative) as a means of persuasion in view of its effect on language and thought. The aim of this study is to join the rhetorical heritage represented by the rhetorical metaphor, with modern linguistics represented in the argumentative and pragmatic metaphor, contained in the linguistic means that the speaker uses in order to orient his speech and to achieve its argumentative objectives. Thus, the argumentative metaphor is the most common type since it is closely related to the intentions of the speakers and their contexts of communication

تُعد المسؤولية المدنية من أهم الموضوعات القانونية التي اهتم بها الفقه والقضاء منذ بداية القرن العشرين ولا زال هذا الاهتمام في تصاعد ولعل السبب في ذلك يرجع إلى ظهور طوائف جديدة من العقود مما يثير في كل مرة مسألة المسؤولية المدنية على أطراف تلك العقود ، ومن هذه العقود عقد الاشتراك بخدمة المولدات الكهربائية الاهلية الذي ظهر منذ فترة ليست بالبعيدة .فالمسؤولية بوجه عام هي ( نظام لتعويض الضرر الناجم عن الاخلال بالتزام مترتب في ذمة المسؤول) ، والالتزام بالتعويض يكون عن الأضرار الذي يحدثها الإنسان بفعله أو بفعل الأشخاص التابعين له أو بفعل الأشياء التي تحتاج الى عناية خاصة أو نوع من الحراسة او نتيجة عدم تنفيذ التزام عقدي ما ، وقد يكون مصدر هذا الالتزام عقدا يربطه بالمضرور فتكون مسؤولية عقدية ويحكمها ويحدد مداها العقد من جهة والقواعد الخاصة بالمسؤولية العقدية من جهة أخرى ، وقد يكون مصدر هذا الالتزام القانون في صورة تكاليف عامة يفرضها على الكافة وعندئذ تكون مسؤولية تقصيرية الذي يستقل بحكمها ويحدد مداها القانون ، والمسؤولية التي تخص موضوع بحثنا هي المسؤولية العقدية الناجمة عن إخلال احد طرفي العقد بالتزاماته او امتناعه عن تنفيذها ، وما يرتبه هذا الاخلال من اضرار قد تصيب تلك الأطراف الامر الذي يستلزم البحث في أساس هذه المسؤولية واركانها .
كانت البلاغة العربية وعلى مدى قرون ترمى بالجمود في قواعدها ومنهجها وعدم قدرتها على مواكبة المستجدات وخاصة في هذا العصر الذي شهد تطورا كبيرا في العلوم والمناهج وتطورا أيضا في الآداب والفنون، لذلك كان لزاما على البلاغة أن تواكب هذا التطور وتساير هذه الأحداث؛ فتجديد البلاغة العربية كان ولا يزال من القضايا الهامة في الحياة الأدبية والثقافية العربية، ورغم ما كتب فيه إلا أنه لا يزال جديرا بالبحث، لذلك فإن هذه الدراسة ترمي إلى الكشف عن أهم دعوات التجديد البلاغي في الساحة العربية وتقديم قراءة في أسبابها ودوافعها وأهدافها بغية معرفة ما قدمته على الصعيدين النظري والتطبيقي.
Over centuries, Arabic rhetoric was accused of stagnation in its rules and method, as well as not being able to keep up with the updates of the current era that is witnessing a huge development in sciences, approaches, literature and arts. Therefore, it was a must for this latter to keep up with this development and get along with these events. Renewing Arabic rhetoric was, and still is, one of the important issues in Arabic life, literarily and culturally. Despite all what was written on it, it is still in need of research that is why, this study’s aim is to discover the most important calls in the rhetorical renewing in Arabian area and to present a study in its reasons, motives and goals, in order to know what it presented in the theoretical side and the applied one.

إنَّ من دَعَائِم العدل الأساسيّة في المجتمعِ هي تَكريسُ سِيادَة القانون بوصفهِ معياراً يُقاس به تحقيق الأمْنُ القانونيّ والقضائيّ في الدولة، فضلاً عن جودة الأحكام القضائية وإستقرارها في ميدانِ العمل القضائي، ومن هذا المنطلق تتجه فكرة الدراسة نحو بحث الأمْنُ القضائيّ من خلالِ بيان صلتهِ بمفاهيمٍ قانونيَّة أخرى تَتمثَّل بالأمْنُ القانونيّ من جهة النِّظامُ القانونيّ، وبالإجتهادِ القضائيّ وإستقراره من جهة النِّظامُ القضائيّ، وتتخلَّلَ الدراسة الوقوف على مقوماتِ كلا المفهومين المُؤثِّرة بالأمْنِ القضائيّ ومدى إسهامها في تحقيقِ الأمْن للمتقاضين تجاه السلطة القضائية والإحكام أو القرارات الصادرة عنها، وبيان الآثار الإيجابيَّة الناتجة عن إستقرار المبادئ القضائية أو القانونيَّة الصادرة عن المحاكم العُليا من جهةِ القضاءِ العادي في القضايا المدنية المُماثلة في الوقائع على نحوٍ يُكرس فكرة الأمْنُ القضائيّ.
تسعى هذه الورقةُ البحثيَّةُ إلى الحديثِ عن الملامحِ العامَّةِ لمشروعِ التربيَّةِ الرُّوحيّةِ والدِّينِيَّةِ لجمعيةِ العلماءِ المسلمينَ الجزائريِّينَ من خلالِ المدارسِ والمعاهدِ والمطابِعِ والمجلاتِ والجرَائدِ والمساجدِ والنوادِي والكتاتِيبِ القُرآنِيَّةِ. إذ تعدُّ هذه الأخيرةُ محورَ دراستنا في هذه الورقةِ البحثيَّةِ؛ مُحاولينَ الوقوفَ على أبرزِ الجوانبِ الإصلاحيَّةِ والطُّرُقِ التَّرْبَوِيَّةِ لهذه المدرسة من خلال الكتاتيب التي أسهمت بشكل كبير في تحقيقِ النُّهوضِ الإسلاميِّ والحفاظ على طابعِ الهويّة الإسلاميّة ومبادئ اللغة العربيّة، فكانت -بحقٍّ- مدرسةً نهضويَّةً تجديديّةً صاعدةً هزّتِ النُّفوسَ الرَّاكِدَةَ وحرَّكتِ العقولَ الجامِدَةَ. حيث استمدّ علماؤها أعمالهم من صميم جذورنا العربيّة الإسلاميّة وفق خطةٍ تربويةٍ دينيّة روحيّةٍ: قاعدتُها الإسلامُ والعروبَةُ؛ قِوَامُهَا العملُ الجماعِيُّ؛ صراطُها التَّوعِيَّةُ والتَّرْبِيَّةُ؛ هدفُها الوِحْدَةُ والحُرِّيَّةُ؛ منهاجُهَا القرآنُ والسُّنَّةُ؛ فأعدُّوا لها -بحقٍّ- بناءً متينًا واستعدُّوا لها بالعلمِ والعملِ، وأزهرتْ غَرْسًا طَيِّبًا، وبزغَ مجدُها في العالمِ الإسلامِيِّ أجمعْ؛ فكانتْ جذوةً وسراجًا منيرا يَهتدِي بهِ المُصلحُونَ، من أجل إحياء الناشئة في تعلّمه ومدرسته ونظامه وأساليبه...؛ جملة من القضايا نحاول التطرق إليها.
This research paper seeks to talk about the general features of the project of spiritual and religious education of the Association of Algerian Muslim Scholars through schools, institutes, printers, magazines, newspapers, mosques, clubs and Qur’an writings. As the latter is the focus of our study in this research paper; Trying to find out the most important aspects of reform and the educational methods of this school through the writings that contributed greatly to achieving the Islamic revival and preserving the character of the Islamic identity and the principles of the Arabic language. Its scholars derived their work from the core of our Arab and Islamic roots, according to a spiritual, religious, educational plan: the basis of which is Islam and Arabism. Its strength is collective action; Its path of awareness and education; Its goal is unity and freedom; Its curriculum is the Qur’an and Sunnah; So, rightly, they prepared for it a solid building and prepared for it with knowledge and work, and it blossomed by good planting, and its glory dawned in the entire Islamic world. It was a flame and a luminous lamp that guided the reformers, in order to revive the young in his learning, his school, his system and his methods ... A number of issues we are trying to address.

أصبحت جريمة الاتجار بالبشر بمختلف صورها وأشكالها موضوعاً خصباً وثرياً كونها تنتهك بصورة أساسية حقوق الإنسان وكرامته وحريته، وعلى رأسها حقه في أن يكون متحرراً من كافة أشكال سوء المعاملة والاستغلال، وتتسم بأنها جرائم واقعة على الإنسان ذلك أن محل هذه الجرائم وموضوعها هو الإنسان نفسه، وهي ليست مقصور على جنس معين أو سن معين، بل تشمل الأطفال والنساء والرجال وتمتد إلى جميع الفئات البشرية وتشمل جميع الفئات العمرية، فهي جريمة تمس حياة الأفراد والمجتمعات عموماً وتؤدي إلى الانهيار الاجتماعي والاقتصادي والثقافي لدى مختلف الشعوب، ومما زاد في تعقيدها تطور صورها ووسائل ارتكابها بين الحين والأخر، خاصةً وان هناك الآلاف من الرجال والنساء والأطفال الذين دفعتهم ظروفهم الاجتماعية أو نتيجة للكوارث الطبيعية والحروب والأزمات الاقتصادية والظروف المعيشية الصعبة إلى أن يكونوا فريسة سهله للوقوع في عمليات الاتجار بالبشر من قبل العصابات الإجرامية التي تتولى غالباً الإشراف على تنظيمها ومراقبة تنفيذ عملياتها المختلفة، وذلك عن طريق تجنيد الضحايا ونقلهم واستلامهم وتسليمهم واستقبالهم وإيواؤهم بصورة مشروعة أو غير مشروعة وسواء داخل حدود الدولة نفسها أو عبر حدودها الوطنية إلى دولة أخرى، بغرض استغلال الضحايا في أعمال السخرة والخدمة القسرية أو أعمال الدعارة وسائر صور الاستغلال الجنسي أو نزع الأعضاء البشرية والمتاجرة بها وغيرها من صور الاستغلال بغرض تحقيق أرباح ومنافع مادية أو معنوية، ويستوي في ذلك أن يكون استغلال الضحية طواعية باستخدام وسائل الاحتيال والتغرير أو قسراً عن طريق الإكراه باستعمال القوة أو التهديد بها أو الاختطاف وغيرها من الوسائل، وغالباً ما تتسم أفعال السلوك الإجرامي في جرائم الاتجار بالبشر بأنها أفعال مادية مختلفة الصور والأشكال تبعاً لاختلاف الوسائل المستخدمة من قبل الجناة والتي يتم من خلالها تحقيق النتيجة المجرمة المتمثلة في الاستغلال والاتجار بالبشر ، ويُشكل كل فعل من تلك الأفعال جريمة مستقلة ومنفردة بذاتها، كما أن الوسائل المستخدمة لارتكاب أفعال السلوك الإجرامي في جرائم الاتجار بالبشر تتنوع بحسب أداه التنفيذ فقد تكون وسائل مادية أو وسائل معنوية وقد تكون وسائل قسرية وأخرى غير قسرية، لذلك كان علينا كباحثين أن نتطرق لهذه الجريمة بصورها وأشكالها ووسائلها المختلفة والمتطورة وصولاً إلى المساهمة في إيجاد الحلول والمعالجات المناسبة للتصدي لهذه الجرائم والحد من انتشارها وتوسعها,
يعدّ الإصلاح التربوي أُسّا من أسس تقدّم المنظومات التربوية في أي بلد؛ إذ يمكن أن يعكس هوية المجتمع وثقافته، وحتى سياسته وفلسفته في التعامل مع شتى مجالات الحياة. ولقد شهدت جل دول العالم حركات إصلاحية تربوية هدفت إلى تجديد النظام التربوي بجميع مضامينه لأسباب متعددة (تاريخية، سياسية، أو مواكبة لمستجدات التقدم التكنولوجي...). ولم تختلف أهداف المنظومة التربوية الجزائرية عن بقية دول العالم في مساعيها ومراميها، وتوالت نماذج الإصلاحات على المنظومة التربوية الجزائرية، على طول هذه السنوات، حتى طالعتنا السلطات الوصية في السنوات الأخيرة بمجموعة إصلاحات سميت بــــــ "مناهج الجيل الثاني" أو "المناهج المعاد كتابتها "، والتي حاول من خلالها علماء اللغة العربية استثمار مضامينها في تعليمية اللغة العربية بجميع مستوياتها بخاصة المعجمية والتركيبية منها؛ أي اكتساب المتعلم لثروة لغوية جيدة، إضافة إلى تعلم قواعد هذه اللغة نطقا وأداء في مختلف المواقف التعليمية؛ فإلى أي مدى يمكن لهذا المستجد التربوي أن يسهم في تعليمية اللغة العربية بجميع مستوياتها؟
Educational reform is seen as one of the foundations for the advancement of education systems in any country. It can reflect the identity and culture of the community and even its policy and philosophy of treatment in various areas of life. Most countries in the world have seen educational reform movements aimed at renewing the education system for all its content and for multiple reasons (Historical, political, or in phase with the evolution of technology ...). The objectives of the Algerian education system do not differ from the rest of the world in its efforts and objectives; The reform models of the Algerian education system have continued throughout these years, until the supervisory authorities presented us in recent years with a set of reforms called "the second-generation model" or "the rewritten model". Through which Arab linguists have tried to invest its contents in the teaching of Arabic at all levels, especially lexical and syntactic, which means the acquisition by the learner of a good linguistic wealth, in addition to learning the rules of this language in terms of pronunciation and performance in various educational situations. To what extent can this educational innovation contribute to the teaching of the Arabic language at all levels?
