عند مراجعتنا قرار محكمة التمييز الاتحادية المرقم بالعدد( 5238/ الهيئة المدنية/ 2019)،وجدنا أنّ المحكمة تجيز للشخص المتجاوز على العقار تملكهُ مقابل تعويض،فالمحكمة تجيز التجاوز على ملكية العقار،ولكن لا نجد للمحكمة أساس في إستناداها عليهِ،فقط للضرورة في منطوق كلامها الضرورات تبيح المحضورات،ولكن عند دراستنا لموضوع الملكية الخاصة ولقاعدة الضرورات تبيح المحظورات لانجد ما يبيح للمحكمة نزع ملكية العقار،لأنّ حق الملكية حق مقدس ومصون وايضاً أنهُ حق دستوري وهذا الحق الدستوري لا يجوز نزعهُ الإ لأغراض المنفعة العامة،ووفق تعويض عادل،وبالتالي سنتبع قرار المحكمة أعلاه وقبل التعليق عليهِ والمسائل التي يثيرها القرار،لابد انّ نوضح معنى الملكية الخاصة،ومعنى قاعدة الضرورات تبيح المحضورات التي أستندت عليها المحكمة في بيان مدى إمكانية صحة قرار المحكمة اعلاه وننتهي بذلك الى خاتمة نوجز أهم ما توصلنا اليهِ في مراجعة قرار المحكمة.
تناول البحث مقامات (ما) النافية عاملة ومهملة، مهّد للكلام ببيان إشكالية البحث وفرضيته، وبتحقيق القول في نسبة النحاة العاملة إلى الحجاز، والنافية إلى تميم، وأورد الأدلة النقلية والعقلية على بطلان هذه النسبة، ثم أدار الحديث على السياق الذي تستعمل فيه كل صورة من صور استعمال (ما)، والمقام الذي ترد فيه، فبدأ بالحديث عن مقام (ما) العاملة، وأورد الشواهد من القرآن والشعر والأمثال المؤكدة له، ثم انتقل إلى الكلام على المهملة بصورها المتعددة والمقام الذي تستعمل فيه كل صورة منها، ثم تحدث عن مقام (ما) المتأرجحة بين الإعمال والإهمال بصورها الثلاثة والمقام الذي تستعمل فيه كل واحدة منها، ثم ختم بأبرز النتائج التي توصل إليها، والمصادر والمراجع التي أفاد منها.
The research dealt with the negative cases that used and neglected of “ma”. The research began by explaining the problem of the research and its hypothesis, The research dealt with the negative cases of “ma” that used and neglected. The researcher began his research with a statement of the problem of the research and its hypothesis. He tried to prove the grammarians’ saying about the attribution of “ma” that used to the Hijaz, and the neglected one “ma” to Tamim. In addition, he mentioned the transmitted and mentality evidences on the invalidity of this attribution. Furthermore, he turned to the context in which it is used “ma” and the place that it appears in. He started by talking about the location that uses “ma”, and mentioned the evidences from the Holy Qur’an, poetry, and proverbs that confirming it. Then, he talked about the neglecting “ma” in its various forms and the places in which each are used. After that, he talked about a place of used and neglected "ma" between its three forms and the place in which each one of them is used. Then, he concluded with the most prominent results he reached and the sources and references he referred to.

جعل الله الكلمة واللغة والبيان هي نقطة انطلاق، وبدء الحياة والحركة، وبناء الحضارة، وإقامة العمران، وتحقيق الاجتماع البشري، فهي مفتاح الحياة، ووعاء الفكر، ووسيلة الإقناع، ففي البدء كانت الكلمة منها ما هو معتدل، ومنها ما هو متشدد تؤدي إلى الغلو، فكانت ظاهرة الغلو ظاهرة متجددة عبر العصور، وإن اختلفت أشكالها، وتعددت أساليبها من وقت إلى آخر، فهي لا تمت إلى الدين بصله، وإنما تعبر عن قدرة المجتمع، ومدى تأثره وتفاعله مع ممارسة هذه الظاهرة، التي كان لها تأثير سلبي كبير على المجتمع، وبهذه الظاهره تأثرت الكثير من فئات الشعوب العربية والإسلامية ، بسبب الفقر والجهل بأحكام الشرع، فمعظم اختلافنا اليوم يُعزى إلى عوج في الفهم، وتوارث علة النفوس من الكبر والعجب بالرأي، والطواف حول الذات، والافتتان بها، واعتقاد أن الصواب والزعامة وبناء الكيان، إنما يكون باتهام الآخرين بحق أو بغير حق، الأمر الذي تطور حتى وصل إلى الفجور والخصومة بقدرٍ لا يطاق، وإن ما يحصل في وطننا العربي والإسلامي وبلادنا الحبيبة، من افتتان، واقتتال، ودمار، ومعانة يعود لهذه الظاهرة الخبيثة، التي هي الغلو في الفكر الديني والسياسي؛ لذلك كان من الواجب علينا كباحثين وضع الحلول مناسبة -وفق حوار بناء- في معالجة هذه الظاهرة، والحد منها.
يتحدث هذا المقال عن كلمة " غير " في النحو العربي, من الجانبين: الصرفي والتركيبي. ويحاول إعادة تصنيفها من جديد, من خلال اتباع منهج لساني, يصف الظاهرة ويفسرها. وتكمن أهمية الموضوع في كونه موضوعا جديدا لم يدرس من قبل, وفي كونه يجد حلولا لبعض الأوجه الإعرابية المختلف فيها. والفرضية الأساسية التي ينطلق منها البحث هي أنّ " غير " حرف وليست اسما ولا صفة. ولإثبات هذه الفرضية عرضنا " غير " على مفهوم الاسم وخصائصه, ثمّ على مفهوم الصفة وخصائصها, ثمّ على مفهوم الحرف وخصائصه. وخلص البحث إلى أنّ " غير " حرف من حروف المعاني, تؤدّي معان أسلوبية في التركيب.
This article talks about the word "gayr" in Arabic grammar, from both sides: morphological and syntactic. And he tries to reclassify it again, by following a linguistic approach, describing and explaining the phenomenon. The importance of the topic lies in the fact that it is a new topic that has not been studied before, and that it finds solutions to some of the different syntactic aspects. The basic premise of the research is that “gayr” is a letter and is not a noun or an adjective. To prove this hypothesis, we presented “gayr” to the concept of a noun and its characteristics, then to the concept of an adjective and its characteristics, then to the concept of a letter and its characteristics. The research concluded that “gayr” is one of the letters of meanings, which performs stylistic meanings in the structure.

التكنولوجيا الحديثة والصناعات المتقدمة تهدد حياة الإنسان ، والأضرار التي لحقت بالنباتات والكائنات الحية ، وتسبب وقت المواد الطبيعية لتسبب أضرارًا كبيرة للبيئة. لقد أدى انتشار الحرب في الشرق الأوسط وأوروبا الشرقية إلى أضرار بيئية ضخمة. هذا لا يقتصر على مناطق الصراع ، ولكن تأثيرها يمتد إلى مناطق أخرى ، وخاصة مناطقها المجاورة ، ولكن مجالات الحرب والصراع لا تزال مباشرة متأثرًا بالبيئة. مثل العراق وسوريا واليمن ، تأثروا أخيرًا في أوكرانيا. أصبح التلوث البيئي تهديدًا لجميع البلدان في العالم ، وبالتالي فإن البلاد بدأت تنفذ في البيئة ، ويعقد الاجتماع على المستوى الداخلي (البلد) أو المستوى الإقليمي أو المستوى العالمي. الغرض من هذه الاجتماعات هو استخدام الوسائل القانونية وآليات حماية البيئة ومنع الهجمات ، خاصة وأن المشكلات البيئية هي قضايا الكون عبر الحدود ؛ الاستجابة لها تتطلب الوحدة والتعاون بين البلدان. عندما يتم تكثيف المشكلات البيئية ، تصبح البلاد أكثر وعياً بهذا الخطر ، وهي مقتنعة بأن المشكلات البيئية قد تعمقت ، ووضع سلسلة من الإجراءات لهذا الغرض
يُعد الصوت اللغوي ظاهرة مهمة من ظواهر اللغة، وعنصر فعال من عناصر التحليل اللساني، وهو أولى لبنات النص الشعري و به ترتبط جمالياته ذلك لأن الأصوات بما تحمله من ملامح تميزية (جهر، همس، شدة، رخاوة، احتكاك انفجار، صفير....) تعكس الواقع النفسي للشاعر، وكذا الواقع الدلالي للنص الشعري فهي كالمرآة العاكسة لما يجول في خاطره من أفكار، يود الإفصاح عنها، و إيصال دلالاتها إلى المتلقين في أكمل صورة.
The linguistic Voice is an important phenomenon of language, and an effective élément of the linguistic analyse is of the poetic text, and it is the first building block of the poetic text and its aesthetics are related to it, as the sounds with their distinctive features (loudness, whispering, intensity, looseness, friction of an explosion, whistling ... ..) It reflects the semantic reality of the poetic text, and the psychological reality of the poet, as it is like a mirror that reflects what he wanders in his minds of ideas that he wishes to disclose and convey its connotations to the recipients in the most complete way.

تناول هذا البحث موضوع تأثير الاعتبارات الشخصية على العاملين , حيث تعتبر العقود الإدارية من أهم الوسائل التي تستخدمها إدارات العقود في تنفيذ البرامج والمؤسسات التي تحتاجها الدولة بشدة ، خاصة في العصر الحديث ، كما أن العقود الإدارية تتميز عن العقود المدنية وترجع أهم أوجه الاختلاف والتمييز بين الطائفتين السابقتين إلى ناحيتين : الناحية الأولى: تتمثل في النظام القانوني الذي تخضع له كل طائفة .الناحية الثانية : تتمثل في الاختصاص القضائي .كما يعتبر الاعتبار الشخصي من أهم الأفكار الأساسية في العقود العامة ، ويمكن أن يكون سمة من سمات العقد ، لذلك له طبيعة معينة وله شروط خاصة به ، والاعتبار الشخصي يختلف عن العقود الأخرى. ويتميز الاعتبار الشخصي عن الأوصاف القانونية الأخرى كالتحفظ الضمني في التعاقد ، والشرط والسبب.وعلية تضمن البحث مطلبين نتناول في المطلب الاول العقود التي ترد على العمل ,اما المطلب الثاني سوف نتناول فيه تنفيذ العقود التي ترد على العمل والقائمة على الاعتبار الشخصي.
تستند هذه الدراسة على أبرز مؤلفين في علوم القرآن وهما كتاب البرهان في علوم القرآن للزركشي والإتقان في علوم القرآن للسيوطي ، وقد سعت إلى إبراز بعض مظاهر الانسجام الصوتي في القرآن الكريم من خلال عرضهما لعدة قضايا متعلقة بالتناسب بين فواصل القرآن الكريم وانسجامها من الناحية الصوتية ، ومن أجل تحقيق هذه الغاية سلكت منهج اللسانيات النصية في تحليل النصوص واقتصرت على المستوى الصوتي في ذلك .
This study is based on two most prominent books on the sciences of the Quran; these are: al-Burhan fi Ulum al-Quran by al-Zarkachi and Al-Itqan fi ‘Ulum Al-Qur’an by al-Suyuti. The two mentioned books explore various issues related to the correspondence between the ending words of the Quranic verses from the vocal perspective. Thus, this study is an attempt to highlight some features of the vocal harmony in the holy Quran. To achieve this aim, this study has followed the textual-linguistics methodology to text analysis limiting itself to the vocal level.

رئيس جمهورية العراق وحسب المادة (67) من دستور عام 2005 ( هو رئيس الدولة ورمز الوطن يمثل سيادة البلاد ويسهر على ضمان الالتزام بالدستور) وهو يتمتع بصلاحيات واختصاصات عدة نصت عليها المادة (73) من الدستور المذكور منها المصادقة على أحكام الإعدام.نتحدث في هذ البحث عن صلاحية من صلاحيات رئيس الجمهورية وفق ما نص عليها دستور العراق النافذ لسنة 2005، وهي المصادقة على عقوبة الإعدام، وسيكون حديثنا موزعاً على مبحثين اثنين وأربعة مطالب ، المبحث الأول سيكون حول مفهوم عقوبة الإعدام والخلاف حولها بين من يؤيد الإبقاء عليها وبين من يطالب بإلغائها، وسنقسم الحديث في هذا المبحث الى مطلبين ، نشرح في المطلب الأول مفهوم عقوبة الإعدام ونعرّفها لغة واصطلاحاً، وفي المطلب الثاني نتوقف عند اختلاف الفقهاء حول عقوبة الاعدام بين قائل بالإبقاء عليها وبين طالب بإلغائها مع سرد الحجج التي يستند عليها كل طرف. أما في المبحث الثاني فسنتحدث في المطلب الأول منه عن وضع عقوبة الإعدام في العراق من قانون حمورابي قبل ما يقارب الألفي عام قبل الميلاد مروراً بعهد الفتح الاسلامي وحقبة الدولة العثمانية وتأسيس الدولة العراقية انتهاءً بالاحتلال الاميركي في عام 2003 ووصولاً الى الدستور الدائم في عام 2005، أما في المطلب الثاني فسيكون جوهر حديثنا حول صلاحية رئيس جمهورية العراق بالمصادقة على أحكام الإعدام في ظل ما نص عليه دستور العراق لسنة 2005.
تعتبر الإستراتيجية التلميحية من أهم أنواع الإستراتيجيات التخاطبية التي يتوخاها المرسل بغية تحقيق أهدافه التواصلية، وتسعى هذه الورقة البحثية إلى تحديد آليات هذه الإستراتيجية (التلميحية) في الخطاب القرآني وفق القواعد الحوارية التداولية التي وضعها صاحب نظرية الاستلزام الحواري، وقد أريد بهذه القواعد أن تنزل منزلة الضوابط التي تضمن الإفادة وتبلغ الغاية في الوضوح، حيث يتم من خلالها تحديد آليات الانتقال من المعنى الحرفي إلى المعنى المستلزم، إذ يستثمر المتكلم كفاءته التداولية عند إنتاج خطابه باستعمال الإستراتيجية التلميحية مدركا أن هناك طرقا عديدة لتقول شيئا ما وأنت تعني به شيئا آخر، فما المقصود بالإستراتيجية التلميحية؟ وكيف يتم الانتقال من المعنى الحرفي إلى المعنى إلى المعنى المستلزم في الخطاب القرآني؟ وما الآليات التي تيم الاعتماد عليها أثناء عملية الانتقال؟
The hint strategy is one of the most important types of conversational strategies that the speaker employs to achieve his goals, This research aims to study the hint strategy in the Qur’anic discourse, Based on pragmatics conversational rules, These rules laid down by the founder of the theory of conversational implicature, and these rules try to control the dialogue in order to convey the intent and achieve the conversational goals, where the research aims to determine the ways to move from the literal meaning to the hidden meaning,what is meant by hint strategy ?How is the transition from the literal meaning to the hidden meaning ? and what are the mechanisms used in this process ?

هدفت السياسات الدولية والـوطـنية في مجال الحفاظ على البيئــة وتنظيم الأنشطة والسلوكيات البشرية وتعزيز إجراءات المحافظة عليها لحماية الوسط الطبيعي الذي يعيش فيه الإنسان، وبيان الأنشطة التي تؤدي إلى إحداث اختلال في التوازن الإيكولوجي، ولا يكون ذلك إلا من خلال بيان مفهوم البيئــة كمدخل أساسي لفهمها، وبذلك فإن البيئــة لها أكثر من مفهوم من حيث اللغة أو من حيث الاصطلاح وحتى من حيث المفهوم القـانـوني، وذلك من خلال تقسيم هذا البحث إلى مبحثين في الأول سيتم التطرق إلى مفهوم البيئــة والتنمية الــمسـتدامـة ومجالاتها، أما المبحث الثاني فسنخصصه لدراسة الحماية القـانـونية الدولية والـوطـنية للبـيـئـة وسبل تحقيق التنمية الــمسـتدامـة.
The documentation of sources, or simply referencing, is both professional and ethical. On the professional level, it demonstrates the researcher's research skills (identification of relevant sources, library skills, summarizing, and paraphrasing, etc.). On the ethical level, on the other hand, it discards unprofessional practices such as plagiarism by giving credit to other contributors whose research has supported the researcher's assertions. All referencing systems across the board are meant to evaluate evidence put forward and the identification of the sources of the information, which eventually adds to the credibility of the research. The current paper aims to ease researchers, particularly novice ones, into the different referencing systems and recent innovations (namely APA 7th edition)

Le présent article aborde l’évolution conceptuelle et méthodologique dans l’analyse des discours numériques. Comment l’activité discursive se développe-t-elle dans un environnement numérique ? A quel point et de quelle façon la numérisation influe-t-elle sur l’exercice de cette activité ? Les nouvelles pratiques langagières numériques imposent aux linguistes et analystes de discours de repenser leurs concepts et leurs méthodes. Pour être à jour avec le développement numérique, il faut revisiter certaines conceptions théoriques et méthodologiques des sciences du langage. قد يعترض ذلك الاشخاص ضعيفي الخصوبة الذين يشكلون مصدر تهديد للمجتمع إذا لم يتم علاج ذلك ، فضعف الخصوبة هو عدم القدرة على الانجاب مؤقتاً لأي سبب من الاسباب ، لذلك يعتبر عقم نسبي يتم علاجه اذا شخص سببه ، بعكس العقم فهو عدم القدرة على الانجاب مطلقاً ، ونتيجة للتطور العلمي في المجال الطبي والعلاجي والجراحي ، أصبح من الممكن معالجة حالات كانت مستعصية وغير قابلة للعلاج ، ومن هنا ظهرت الحاجة إلى انشاء مراكز لتشخيص العقم وضعف الخصوبة والمساعدة على الانجاب التي لا يقتصر أثر انشائها على الجوانب الصحية والنفسية فقط ، بل تتعداها إلى جوانب شرعية وقانونية من اباحة وتحريم .
Aujourd’hui, l’utilisation du code switching à l’université algérienne est une réalité aussi incontournable que problématique. Cette pratique plurilingue tend même à se généraliser à toutes les filières, y compris à celles relevant des sciences humaines et sociales.
Aussi, le présent article tente-t-il d’apporter un éclairage sur l’emploi de cette stratégie didactique dans ce genre de sciences. Le but est de relever les raisons mais surtout l’impact tant positif que négatif de cette stratégie dans la transmission des savoirs, la promotion de l’interculturalité et la valorisation des idées de tolérance et du vivre ensemble
Nowadays, the use of code-switching at the Algerian university is a reality asunavoidable as it is problematic. إن الأهلية شرط لانعقاد جميع التصرفات القولية والفعلية إذ بدونها لا يكون للتصرف أي أثر قانوني وشرعي، وبذلك يرتبط التصرف القانوني والشرعي بالأهلية وجودا وعدما فهي تجمع بين مفاهيم التمييز والإدراك والإرادة، وهذه الأمور لا بد منها لقيام التصرف القانوني ونفاذه وبما أن الزواج تصرف قانوني فانه يكون محكومة بالقواعد العامة للأهلية، والكلام عن احكام أهلية الزواج في ضوء قانون الاحوال الشخصية العراقي لابد أن يسبقه الكلام عن الأهلية بشكل عام على النحو الذي نبينه في موضوع بحثنا هذه .
تهدف هذه الدراسىة الى التعرف على مستقبل المسرح في ضوء تحديات الفضاءات الرقميىة .حيث شهد المسرح الحديث عبر تاريخه تطوّرا ملحوظا من خلال استثماره للتقنيات الرقمية التي ساهمت في تحقيق الجماليات المشهدية، والخلق الفنّي في العرض. كما لعبت دور الوسيط بين النّص والعرض والمتلقّي. هذا المتلقّي الذي أصبح له دوره الفعّال في المسرح الرقمي بعدما كان متلقيا ساكنا في صالات العرض، إذ ينتهي دوره بالتصفيق عند انتهاء المشهد وسدل الستار. والآن في ظل هذه الثورة الرقمية أصبح مبدعا ثانيا يتحكم في الشخصيات، والأحداث، ويختار النهايات للمسرحية .
This study aims to identify the future of theater in light of the challenges of digitalspaces. Throughout its history, modern theater has witnessed a remarkabledevelopment through its investment in digital technologies that contributed toachieving scenic aesthetics and artistic creation in the show. It also played the role ofmediator between the text, the presentation, and the receiver. تعد مشاهدة المحضون واصطحابه من المشاكل التي تثار بشكل ، او بأخر بحكم كثرة حالات الطلاق التي ينتج عنها ضياع المحضون وبالرغم من ذلك لم ينص المشرع العراقي على تنظيمه ضمن نصوص مواد معينه ،اذ ان مشاهدة المحضون واصطحابه امر مهم خاصة لشخص المحضون ، ففي حالة تنظيمه نخلص الى نتيجة مهمه ، وهي ابعاد المحضون عن دائرة الصراع المثار بين كل من والديه وتجنيب المحضون من الوقوع تحت طائلة الاثار السلبية المترتبة على وقوع الطلاق قدر الامكان، وبالمقابل وفي ظل هذا النقص التشريعي لم يغفل القضاء العراقي عن بيان المعالجة في العديد من قراراته محاولا قدر الامكان حل المسائل المتعلقة بمشاهدة المحضون واصطحابه من خلال بيانه للعديد العديد من الضوابط التي يمكن استخلاصها من تلك القرارات التي وجدت في البعض من احكام الفقه الاسلامي اساسا لها ، فضلا عن مراعاتها لطبيعة تطور نواحي الحياة ، من حيث امكانية الحصول على هذا الحق ووسائل تنفيذه التي قد لا تقتصر في الوقت الحالي على الاتفاق بين الاطراف على ما يتعلق بوقت استحصال هذا الحق وزمانه وعدده ، ولا على ماتقره المحاكم من قرارات وانما تعدتها وفي سبيل تحقيق الغاية المرجوة من اعمال المشاهدة والاصطحاب للاعتداد بالوسائل الالكترونية ، ومكاتب التوجيه الاسري في سبيل التقليل قدر الامكان من اثار الطلاق ، وذلك من خلال العمل على تحقيق مشاهدة المحضون واصطحابه في اطار ضوابط معينة ينبغي مراعاتها كي لا تفقد الغاية من المشاهدة والاصطحاب من تحقيق اهدافها ، وهو ما سيتوضح من خلال المقارنة بين قانون الاحوال الشخصية العراقي وبعض التشريعات العربية.
تهدف هذه الورقة إلى الكشف عن نشاط الهاشتاغ عبر مواقع التواصل الاجتماعي في إدارة الأزمات وحل المشكلات المرتبطة بالمجتمع افتراضيا؛ بوصفه من أهم الوسائل والطرق التي تمكن المجتمعات من التفاعل مع القضايا الاجتماعية و الإنسانية وغيرها عبر العالم أجمع. إن الأحداث التي تجري في البلاد وتجذب الرأي العام، تفرض وجودها في الوسوم وانتشارها بشكل كبير، وفي نهاية المطاف يتصدر الوسم قائمة اهتمامات المغردين في الموقع، و انتشار الوسم قد يكون مخططا له في بعض الأحيان، وأحيانا لا يتطلب الأمر تخطيطا مسبقا،مثل هاشتاغ مهسا أميني وهو محل الدراسة من خلال تحليل ووصف نشاطه عبر موقعي تويتر وأنستغرام، بوصفه الهاشتاغ المسؤول عن الثورة والانتفاضة الموجودة بالشارع الإيراني جراء مقتل الكردية مهسا أميني على يد شرطة الأخلاق الإيرانية، ومعرفة كيفية إدارة ومعالجة هذه الأزمة المتشابكة العناصر .
This paper aims to reveal the activity of the hashtag through social networking sites in crisis management and solving problems related to society by default as one of the most important means and ways that enable communities to interact with social, humanitarian and other issues around the world, that the events taking place in the country, attract public opinion, impose its presence in the hashtags and spread Amini, who is the subject of the study through the analysis and description of his activity via Twitter and Instagram, as The hashtag responsible for the revolution and uprising on the Iranian street as a result of the murder of a Kurdish woman touched by Amini at the hands of the Iranian morality police, and to know how to manage and deal with this crisis, the elements are intertwined
