تعتبر الشراكة بين القطاعين العام والخاص إحدى أهم الآليات الحديثة في حل مشكلة تمويل المشاريع الكبرى في ظل قصور الجهات التمويلية وتنامي الحاجيات الأساسية للجهات الحكومية، وبموجب هذه الدراسة ستتم إزالة اللبس عن مصطلح الشراكة من خلال تحديد التعريف اللغوي وكذا التعريف الاصطلاحي من خلال تحديد مفهوم فقهي وتشريعي وارد في مختلف الدول، وكذا تعريف دولي، ثم التركيز على الطبيعة القانونية لعقود الشراكة بين القطاعين من خلال التكييف القانوني ثم الآثار المترتبة عن تحديد الطبيعة القانونية لعقود الشراكة بين القطاعين العام والخاص.
لتخلص الدراسة لتحديد مدى مساهمة عقود الشراكة بين القطاعين العام والخاص رغم الصعوبات والعوائق التي تعترض تنفيذها إلى أنها أداة فعالة مساهمة في تقليص نفقات الدولة، كونها تعزز الخبرات بين القطاعين مم يسمح بخلق بيئة مستقرة تنتج اقتصاد قوي.
The partnership between the public and private sectors is one of the most important modern mechanisms in solving the problem of financing major projects in light of the shortcomings of the financing agencies and the growing basic needs of government agencies. It is included in various countries, as well as an international definition, then focus on the legal nature of partnership contracts between the two sectors through legal adaptation and then the implications of determining the legal nature of partnership contracts between the public and private sectors.
The study concludes to determine the extent of the contribution of partnership contracts
between the public and private sectors, despite the difficulties and obstacles to their implementation, that it is an effective tool that contributes to reducing state expenditures, as it enhances experiences between the two sectors, allowing the creation of a stable environment that produces a strong economy.

تلقى المجلس الدستوري الجزائري (حاليا المحكمة الدستورية) دفعا بعدم دستورية المادة 496 فقرة 6 من قانون الإجراءات الجزائية التي تمنع الطعن بالنقض في القرارات الجزائية الفاصلة في الجنح بغرامة لا تتجاوز 50.000 دج. وقد صرح بدستورية المادة المطعون فيها، معتبرا بذلك أن الحق في الطعن بالنقض ليس أساسيا.
تهدف الدراسة إلى مناقشة حجج المجلس الدستوري باتباع منهج تحليلي مقارن، وقد خلصت إلى أساسية الحق في الطعن بالنقض بالنظر لمكانته في الفقه والقضاء الدستوري المقارن والقانون الدولي لحقوق الإنسان.
The Algerian Constitutional Council, currently named ‘Constitutional Court’, was seized of an exception of unconstitutionality with regard to article 496, paragraph 6, of the code of criminal procedure, which prohibits appeals in cassation in the criminal matter, against court
decisions ruling on misdemeanors by a fine not exceeding 50,000 Algerian dinars. The Council declared that the text object of the appeal is constitutional, considering that the right of appeal in cassation is not fundamental.
This study aims to discuss the arguments of the Constitutional Council, using an analytical-
comparative approach. This study ascertains the fundamentality of the right to appeal in cassation in this type of cases, given its place in the constitutional doctrine and
jurisprudence, as well as in the international human rights law.

حاولنا من خلال هذه الورقة البحثية تسليط الضوء على المسـؤوليات التـي ألقاهـا المشـرع علـى عـاتق الموظـف الـعـام أمـام هيئـات مكافحـة الفسـاد، وتتعلـق هـذه المسـؤوليات بالالتزامـات الواجـب علـى الموظـف العام القيـام بـهـا، من تصـريح بممتلكاتـه، سواء التصريح الأوّلـي، وكـذا التجديـدي والنهـائي، والمسـاهمة فـي الإبـلاغ عـن جـرائم الفسـاد وكشـف مرتكبيهـا، ومسـاعدة الجهـات المختصـة فـي الحصـول علـى أي معلومـة أو وثيقـة بهـذا الخصوص، وفي المقابل جرّم عدم الالتزام بهذه الواجبات تحت طائلة العقوبات.
Through this paper, we have sought to highlight the responsibilities that the legislator has placed on the public official before anti-corruption bodies. These responsibilities relate to the obligations of the public official, whether to declare his or her initial, regenerative or final recipients, as well as to contribute to the reporting of corruption offences and the detection of their perpetrators, and to assist the competent authorities in obtaining any relevant information or document.

تهدف دراسة مبدأ تسبيب الأحكام الدستورية باعتبارها أساسا شكليا ودعامة موضوعية في بناء الأحكام الدستورية إلى بحث آثارها على السلطات الدستورية وتأثيرها في مبدأ تدرج الأحكام، وأهم نتائج البحث الذي اعتمدنا فيه المنهج الوصفي هي: اعتبار التسبيب إلتزاما دستوريا وقانونيا، وعدم تحديد جزاء قصوره أو غيابه، توسيع الكتلة الدستورية، وإقرار قيمة معيارية لبعض القواعد بما يحدث تجديدا في تدرج قواعد القانون، مع تقييد سلطة البرلمان في وظيفته التشريعية والرقابية.
The study of the principle of causation of constitutional judgments, as a formal basis and an objective pillar in the construction of constitutional judgments, aims to examine its effects on the constitutional authorities and on the principle of gradation of provisions. The most important results of the research in which we adopted the descriptive approach are:
Considering causation as a constitutional and legal obligation, whitout specifying the penalty for his shortcomings or absences, expanding the constitutional bloc, and approving a normative value for some of the rules, which will bring about renewal in the hierarchy of the rules of law, restricting the parliament’s authority in its legislative and oversight function.

وبناءً على ذلك، فقد خلصت الدراسة إلى أنّه استنادا إلى واقع البيئة السياحية السليمة، مرهونة بكفاءة النظام الإعلامي في توحيد الأفكار وفقا للبيئة السياحية المناسبة والتصدي لكل المعلومات التّي من شأنها أن تؤثر على أفكار الجمهور تجاه البيئة السياحية .
This study aims to provide a discussion about the ability of the system information on the policy environment safe, especially with the proliferation of incidents and crimes that affect the tourism environment, and in the mechanisms of the information system that have the ability to enhance the tourism environment safe, by planning media messages appropriate with the conditions of the surrounding environment of the tourist. Accordingly, the study concluded that, based on the reality of the tourism environment healthy, depends on efficient information system in the consolidation of ideas according to the environment within the region and all information that would affect public ideas about the tourism environment .

هدف البحث معرفة فاعلية أسلوب العرض التركيبي بتنمية كل من الأداء التحصيلي مادة ال PLC "Programmable Logic controller" في قسم الأجهزة الطبية، ولتحقيق أهداف الدراسة تم اعتماد المنهج التجريبي، جرى اختيار العينة من متعلمي ومتعلمات قسم الأجهزة الطبية، وهم (60) متعلم ومتعلمة، تم تصميم اختبار تحصيلي في مادة ال PLC "Programmable Logic controller.
وتوصل البحث إلى النتائج الآتية:
فاعلية استراتيجية العرض التركيبي في تنمية التحصيل الدراسي للمتعلمين في مادة ال PLC "Programmable Logic controller في قسم الأجهزة الطبية.
انعدام الفروق الإحصائية بين متعلمي مجموعة التجريبية بالأداء التحصيلي في مادة ال PLC "Programmable Logic controller" وفق الجنس.
وتم تقديم مجموعة من الاقتراحات والتوصيات
يعتبر حق التفاوض الجماعي حق أساسي يجد مصدره في الاتفاقية رقم 98 المتضمنة حق التنظيم والمفاوضة الجماعية والقانون رقم 90-11 المتعلق بعلاقات العمل. وتتكون اللجان المتساوية الأعضاء للتفاوض من عدد مساو من الممثلين النقابيين للعمال وعدد من المستخدمين، وتقوم بالتفاوض الجماعي على مجموع شروط العمل والتشغيل كالأجور والمكافآت والتعويضات. وأحاط المشرع ممارسة حق التفاوض الجماعي بضمانات كحماية المندوبين النقابيين، ومع ذلك فتبقى هذه الضمانات غير كافية لممارسة هذا الحق.
Assessing Collective Bargaining as a Fundamental Right
Collective bargaining is considered as a fundamental rightrooted in Convention No 98 on the Right to Organize and Collective Bargaining and in the Labour Relations Act No 90-11 of 21 April 1990.
Joint committees for collective bargaining, which comprise an equal number of representatives from employer and employees, negotiategeneral terms of employment. These terms include salaries, allowances, bonuses and working conditions.
Although legislators have done their utmost to bothpromote collective bargainingand protect union delegates, such provisions have not been enough to secure full exercise of this right.

هدفت الدّراسة إلى الكشف عن معوقات استخدام المواقع الإلكترونيّة في تدريس مادّة علم الأحياء في مدارس ناحية الحردانيّة أنموذجًا.
لتحقيق أهداف الدراسة استخدم الباحث المنهج الوصفي ، واشتمل مجتمع الدراسة الأصلي على جميع مدرّسي الأحياء في الحردانيّة البالغ عددهم 64 مدرّسا ومدرّسة ، وتكوّنت عينيّة استطلاعيّة للدراسة من 14 مدرّسا ومدرّسة من أفراد المجتمع الأصلي ، بينما تكوّنت العينيّة الميدانيّة من 64 مدرّسا ومدرّسة ، أي جميع أفراد المجتمع الأصلي .اعتمد الباحث الإستبانة كأداة لجمع المعلومات والبيانات اللاّزمة للإجابة على الأسئلة والتي تضمّنت كلّ ما يتعلّق بالعوامل الشخصية وكذلك ما يتعلّق بالمعوقات .وقد تمّت المعالجات الإحصائيّة من خلال استخدام برنامج الرزم الإحصائيّة .
ومن أبرز نتائج الدراسة:
1- لا توجد فروق دالّة احصائيا في تقديرات أفراد عيّنة الدراسة لمعوقات استخدام المواقع الإلكترونيّة في تدريس مادّة علم الأحياء تعزى لمتغيري النوع الإجتماعي و سنوات الخبرة.
2- تتعدّد معوقات استخدام المواقع الإلكترونية في تدريس مادة علم الاحياء من وجهة نظر المدرسين
وقد ترك الباحث مجموعة من التوصيات بعد الإنتهاء من الدراسة ومن أبرزها:
إجراء المزيد من الدراسات في مجال المواقع الإلكترونية واستخداماتها وأهميّة تفعيلها في العمليّة التعليميّة-التعلميّة في العراق.

عقد دورات تدريبية لمدرّسي المواد التعليمية المختلفة ولمادّة علم الأحياء بضرورة إنشاء وتصميم مواقع إلكترونية تعليميّة
تهدف الدراسة إلى إلقاء الضوء على تشكيلة المحكمة الدستورية التّي جاء بها التعديل الدستوري لسنة 2020، الذي بدى من خلال نصوصه أنه غيّر في تركيبة تشكيلة المحكمة الدستورية مقارنة مع المجلس الدستوري سابقا، حيث استحدث ضمانات وشروط جديدة لتولي العضوية بالمحكمة الدستورية؛ تكرس استقلالية وحياد أعضائها تبرز بصفة خاصة في اشتراطه للخبرة والكفاءة في القانون للتعين فيها، وحرصه على إقرار الحصانة للأعضاء، فضلا على اعتماده التنوع في التركيبة العضوية للمحكمة الدستورية.
وعلى الرغم من الجهود التّي بذلها المؤسس الدستوري في سبيل تكريس استقلالية أعضاء المحكمة الدستورية ، تبقى الضمانات التّي تكرس الإستقلالية الفعلية لأعضائها غائبة في ظل تدخل رئيس الجمهورية في تعيينهم وانتخابهم.
The study aims to highlight the composition of the Constitutional Court, as set out in the Constitutional Amendment of 2020, which, through its texts, appeared to be not in the composition of the Constitutional Court compared with the previous Constitutional Council. He has introduced new guarantees and conditions for membership of the Constitutional Court that enshrine the independence and impartiality of its members, which are particularly prominent in his requirement of expertise and competence in law for appointment s immunity, as well as its diversity in the composition of the Constitutional Court.
Despite the constitutional founder's efforts to enshrine the independence of the members of the Constitutional Court, guarantees of effective independence for its members remain absent under the interference of the President of the Republic in their appointment and election.

يعد الشعر الجاهلي جزءًا مهمًا من الثقافة والأدب العربي قبل الإسلام. هناك العديد من القصائد التي كتبها شعراء الذين عاشوا في أجزاء مختلفة من شبه الجزيرة العربية قبل الإسلام. تساعد هذه القصائد على فهم التاريخ والبيئة الاجتماعية والقيم الأخلاقية والأفكار حول الإجتماع، وعادات وتقاليد الثقافة العربية.
تكمن أهمية الشعر الجاهلي في أنه يقدم معلومات حول التراث الفني والثقافي والتاريخي للمجتمع العربي الجاهلي. تشكل هذه القصائد أيضًا أساس الشعر العربي ما بعد الإسلام وساهمت في تطوير الأدب الإسلامي. بالإضافة إلى ذلك ، تعتبر قصائد الجاهلية تقليدًا شعريًا مؤثرًا في الأدب العربي.
يحتل الشعر الجاهلي أيضًا مكانة مهمة من حيث الفن الأدبي وعلم الجمال. قبل الإسلام كان العرب يتمتعون بمهارات عالية في الشعر، وكانت تقاليدهم الشعرية جزءًا مهمًا من ثقافتهم. وهذ الأمر كان يسهل على العرب فهم الآيات القرآنية.

تظهر أهمية الشعر في التفسير في عملية شرح وتفسير معاني آيات القرآن. يمكن أن يقدم الشعر وجهات نظر مختلفة في التفسير، لأنه يحتوي على بنية لغوية رشيقة ومليئة بالصور وشكل جمالي للتعبير.
يتم استخدام تعبير شعري في بعض آيات القرآن، ويجب مراعاة تأثير اللغة الشعرية من أجل فهم معنى هذه الآيات بشكل كامل. يمكن أن تساعد اللغة الشعرية في تكثيف السرد ونقل المشاعر بشكل فعال مما يمنح المفسرين فرصة لتحليل معنى الآيات بشكل أعمق.
من أهم مميزات شركات الأموال وبالخصوص شركة المساهمة؛ أنها تقوم على الاعتبار المالي، هذا المنظور تراجع مؤخرا بصورة كبيرة، في ظل التطورات الاقتصادية في مجال المال والأعمال، وذلك بامتداد الطابع الشخصي بجلاء إلى شركات المساهمة، من خلال مجموعة المظاهر التي تختلف من موضع إلى آخر، والتي تعد في مجملها تجسيدا لتعايش الاعتبار الشخصي في هذا النوع من الشركات.

يستخلصُ الباحثُ من خلال بحثه الموسوم بـ"ترجيحات الإمام العليمي في تفسيره "فتح الرحمن في تفسير القرآن" إلى أنَّ الترجيح لحُكمٍ أو رأيٍ أو قراءةٍ قرآنيَّةٍ يكونُ بالاعتماد على النصّ القرآنيّ نفسه أو القراءة القرآنيَّة التي يراها مُرجّحةً لرأيِه، أو بالاعتماد على الحديث النبويّ الذي يُفصِّلُ ما أجمله القرآن أو يشرحُ ما غَمُضَ معناهُ، كذلك بالاعتماد على ما يُسمَّى بالناسخ ليكونَ هو المُرجّح، أو بالاعتماد على اللغةِ العربيَّة من خلال معاني الألفاظ والعبارات والبلاغةِ فيها، لتكونَ مُرجّحةً لذاك الحُكم، وكذلك لا ننسى ظاهرَ النصّ أو حقيقةَ الألفاظ التي نأخذُها أوّلًا، فإن تعذّرت نأخذ المجاز، مع الكثير من المُعتمَدَات التي أخذ بها المُفسِّرون في ترجيحاتهم، ثمَّ اعتمدها الشيخ العُليمي -رحمه الله-، سيَّما وأنَّهُ حنبليُّ المذهب، غيرُ متعصبٍ له غالبًا.
وخُلاصةُ القولِ أنَّ المرجِّحات للرأي الذي يراهُ العليمي كثيرة، كان أهمّها القرآن بالقرآن نفسه، ثُمَّ القراءات المتواترة، ثُمَّ السنَّة النبويَّة، ثُمَّ غيرها ممَّا نبشْنا أمثلتها في القرآن الكريم.
يستلزم نظام بنك الجزائر رقم 02 لسنة 2020 من أجل فتح شباك يعنى بالصيرفة الإسلامية على مستوى بنك تقليدي ضرورة الحصول على شهادة مطابقة من الهيئة الشرعية الوطنية، وترخيص مسبق من مجلس النقد والقرض لتسويق منتجات صيرفة إسلامية متوافقة مع أحكام الشريعة، حسب الخصائص التقنية لتنفيذها المحددة بموجب التعليمة رقم 03-2020 الصادرة عن بنك الجزائر.
فتم من خلال هذه الدراسة النظر في ما مدى كفاية قواعد ممارسة العمليات البنكية الاسلامية المستحدثة لتطوير الصيرفة الإسلامية في الجزائر، وفق محورين تمثل الأول في تنظيم شباك الصيرفة الإسلامية، والثاني في دراسة مختلف المنتجات المصرفية التي يقدمها الشباك، وصولا إلى نتيجة رئيسية تكمن في توفير الإطار القانوني لعمليات الصيرفة الإسلامية المنشئ لهيئة شرعية عليا على البنوك احترام آرائها في مدى مطابقة عملياتها للشرع من شأنه أن يقضي على تضارب الفتاوى بخصوصها، والذي سيؤدي لرفع مستوى الوعي الادخاري للجمهور خاصة برفع الشبهة الربوية لها مما سيؤدي إلى القضاء على السوق الموازية.
The Bank of Algeria Regulation No. 02 of 2020 in order to open a window concerned with Islamic banking at the level of a conventional bank requires obtaining a conformity certificate from the national Sharia board, and a prior authorization from the Monetary and Credit Board to market Islamic banking products in compliance with the provisions of Sharia, according to the technical characteristics of their implementation specified in accordance with Instruction No. 03-2020 issued by the Bank of Algeria.

مع التطورات المتسارعة في عالم التكنولوجيا وسهولة الاتصال والتواصل وكسر الحواجز المادية في عصر القرية الواحدة، استفحل الإجرام المستحدث وعملت الدول على الوقاية منه ومكافحته، وبرز إلى السطح مصطلح عولمة القانون الجنائي عند الفقه العربي خاصة.
تبني مثل هذا المفهوم يعني أن الإجرام المستحدث وآليات الوقاية والمكافحة والتعاون الدولي ما هي إلا إملاءات من قبل الدول العظمى على الدول الضعيفة.
ومن هذا المنطلق تبلورت الإشكالية التي تهدف إلى وضع الحدود بين مفهوم العولمة ومفهوم عالمية القانون الجنائي، لأن تكنولوجيا الإعلام والاتصال هي التي سهلت الإجرام المستحدث بمختف أنواعه، وما العولمة إلا بيئة تكوٌن فيها هذا الإجرام وربما بيئة تحتية لهذا النوع من الإجرام.
With the rapid developments in the world of technology, ease of communication and breaking physical barriers in the era of one village, the newly created crime has become rampant and countries have worked to prevent and combat it, and the term globalization of criminal law has emerged in Arab jurisprudence in particular.
Adopting such a concept means that emerging crime, prevention and control mechanisms, and international cooperation are nothing but dictates by the great powers on the weak ones.
From this standpoint, the problem has crystallized, which aims to set the boundaries between the concept of globalization and the concept of the universality of criminal law, because it is information and communication technology that facilitated the various types of crea ed crime, and globalization is only an environment in which this crime is formed and perhaps an underlying environment for this type of crime.
