Competition aims to achieve economic development by improving products and services and ensuring the proper functioning of the market. This requires the creation of a competitive environment within the market and is a fundamental objective of economic policy. For the safety of this climate, it is required that competition take place within the framework of a project, but the latter may be exposed to anti-competitive practices such as agreements and groupings that lead to their obstruction. After the issuance of Ordinance 03-03 related to competition, the rules regulating this were established to achieve competition within a specific and legitimate framework. The Competition Council was created as an independent body that prohibits anti-competitive practices and has advisory and other deterrent powers represented in imposing a financial fine and issuing orders against its perpetrators, while it is concerned with Judicial authorities to nullify prohibited practices, compensate the victim for the resulting damages, or arrange penal penalties. The aim of this study is to expose the legislator's position on anti-competitive practices and the measures that can be taken to get rid of them. Creator An entity primarily responsible for making the resource مصطفى خطاب شهاب محمد أ.د. خالد قرحاني بلعيد, إلهام Date A point or period of time associated with an event in the lifecycle of the resource 2023-12-02 2022-06-17 Description An account of the resource يتناول هذا البحث المظاهر الحضارية والعلمية لمدينة أصبهان من خلال كتاب (تاريخ أصبهان) للمؤرخ أبي نعيم الأصبهاني 430ه/1038م, فقد تفرد أبو نعيم الأصبهاني بذكر الكثير من العلماء من أهل أصبهان أو ممن نزلوا أصبهان، لم نقف لهم على تراجم في كتب الرجال والتراجم والطبقات. ويمكن القول أن تاريخ أصبهان يعد خطوة مبكرة في كتابة التاريخ المحلي، وإن كان الأصبهاني نهج في كتابه منهج المحدثين من حيث الترتيب والطبقة وتعديل وتجريح الرواة.   تناول المظاهر العلمية لمدينة أصبهان من خلال كتاب تاريخ أصبهان, تناولنا خلاله علماء الحديث, الفقهاء, القضاة. وقد توصل الباحث إلى عدد من النتائج منها: اتبع أبو نعيم الأصبهاني في كتابه أخبار أصبهان منهج ترتيب التراجم حسب الترتيب الألفبائي، لم يراع أبو نعيم سنة الوفاة أو الطبقة في ترتيب التراجم. إن الجريمة ظاهرة اجتماعية نسبية مرتبطة ارتباطا وثيقا بالمجتمع الذي نعيش فيه، وهي نابعة من عاداته وتقاليده ومتغيراته، هذه الأخيرة تؤثر في السلوكات الإنحرافية وفي طبيعتها. في أواخر القرن الماضي، ومع بداية ظاهرة العولمة حدثت تغيرات كثيرة من تقدم علمي وصناعي وتكنولوجي أدت إلى بروز مفاهيم دولية جديدة غزت جميع دول العالم وأدت إلى ظهور أنماط مستجدة من الإنحراف والإجرام خاصة بعد تطور مجال تقنية المعلومات وغزو البيئة الإلكترونية بمختلف وسائل الإتصال بها، فبرزت بذلك الجرائم المنظمة، والجرائم الإلكترونية وصور عديدة من الجرائم العصرية (مثل: غسيل الأموال أو تبييض الأموال، المخدرات، الإرهاب، الإختطاف...إلخ) اصطلح على تسميتها الجرائم المستحدثة. وتكمن خطورة الجريمة المستحدثة في صعوبة تداركها بسبب التطور والإنتشار السريع والمستمر لها مع وجود عجز للسلطات القضائية الوطنية والدولية وعدم قدرتهم على احتواء هذه الجرائم وتقنينها بشكل يتماشى مع التطور الرهيب لها. وعليه سنحاول في هذا المقال طرح مفهوم الجرائم المستحدثة وخصائصها، وعلاقتها بالجرائم التقليدية، بالإضافة إلى معرفة أنواع الجرائم المستحدثة بما فيها الجرائم المنظمة والجرائم الالكترونية (أغلب الجرائم المستحدثة هي جرائم منظمة والكترونية في نفس الوقت)، وكذا حجمها ومدى انتشارها، وأخيرا آليات مكافحتها والحد منها في المجتمع الجزائري. Crime is a relative social phenomenon closely related to the society in which we live, it stems from its customs, traditions and variables, the latter affecting drift behaviours and their nature At the end of the last century, with beginning of phenomenon of globalization, there were many changes in scientific, industrial and technological progress that led to the emergence of new international concepts that invaded all countries of world and led to emergence of new patterns of delinquency and criminality, especially after development of field of information technology and the invasion of electronic environment by various means of communication with it. Thus, organized crimes, electronic crimes and many forms of modern crimes (e.g: money laundering or money laundering, drugs, terrorism, kidnapping...etc.) has been termed new crimes. The seriousness of new crime lies in difficulty of redressing it because of rapid and continuous development and spread of crime, with inability of national and international judicial authorities and their inability to contain and codify such crimes in line with their terrible development. In this article, we will therefore try to present concept and characteristics of new crimes, their relationship to traditional crimes, as well as types of crimes developed, including organized and electronic crime (most of crimes developed are organized and electronic crimes at the same time), as well as their size and prevalence, and finally the mechanisms for combating and reducing them in Algerian society. Doctrine and jurisprudence have repeatedly tried to admit electronic writing as a means of proof, broadening the legislative exceptions of the general rules to protect the rights of operators. However, the recognition of all its value as evidence raises the question of the notion of general rules that allow for the possibility of considering electronic writing before the judge and up to what limit can it be admitted? And by researching in doctrine and jurisprudence the attempts to recognize the electronic writing as a means of proof on the basis of the general rules one discovers clearly the limits of the applicability of these rules on the electronic writing, and the impossibility to give it the full legal value of writing on paper, because of their differences which necessitated the importance of legislative intervention for the amendment of the general traditional rules of evidence in writing so that they adapt with the electronic form. Creator An entity primarily responsible for making the resource رحاب فاضل عبد العباس د. رفيف الصلح مسعودي, حسام حجاج, محمد الهاشمي Date A point or period of time associated with an event in the lifecycle of the resource 2023-10-02 2022-06-17 Description An account of the resource هدفت هذِه الدراسة التعرف على (تطبيق استراتيجية الفصل المعكوس لتدريس الفيزياء وأَثرها في التحصيل لدى مُتعلمات الصف الثاني المتوسط )، ولتحقيق أهداف الدراسة قامت الباحثة بصياغة فرضيّة بديلة، حيث اِعتمدت على التصميم التجريبي لقياس الاختبار البعدي للتحصيل، واِشتملت عينة الدراسة على طالبات الصّف الثاني المتوسط كَجزء من مُجتمع الدراسة المتمثل بمتوسطة الاعتماد للبنات في مركز مُحافظَة بابل في العراق، وتم اِختيار شُعبتين بصورة عشوائيّة ( ج ، د )، لتمثل شُعبة ( ج ) المجموعة التجريبية التي خضعت لتجربة الصّف المقلوب وتكونت من ( 42 ) طالبة أما الشعبة ( د ) تُمثل المجموعة الضابطة التي خضعت للطريقة التقليديّة في التدريس وتكونت من ( 42 ) طالبة، ولإعداد أَسئلة الاختبار التحصيلي حددت الباحثة ( 72 ) هدف سُلوكي تضمنت مُستويات بلوم الأربعة في المجال المعرفي والتي شملت ( المعرفة والاستيعاب والتحليل والتطبيق )، وبعد الانتهاء من بناء أداة الدراسة المتمثل بالاختبار التحصيلي والذي تضمَّنَ ( 24 ) فقرة، لقياس تحصِيل الطالبات، وتوصلت الباحثة إِلى إِنَّ اِستخدام استراتيجية الفصل المقلوب زاد من تحصيل الطالبات، لِذا اِقترحت الباحثة تطبيق هذِه الاستراتيجيّة لمراحل دراسيّة مُختلفة ومواد مُختلفة كمادتي ( الرياضيّات والأَحياء ). تهدف الدراسة إلى إبراز الأثر الإيجابي لابتكار منتج جديد ممثلا في الإسمنت المقاوم للأملاح(CPA-CEM I 42,5 ES) على أداء شركة إسمنت عين التوتة (باتنة) ممثلا في حجم المبيعات، وأثبتت النتائج المتحصل عليها أنّ المنتج الجديد المبتكر قد أسهم في رفع حجم المبيعات والنتائج المالية. قدم الباحثان بعضا من المقترحات أبرزها: أن تحاول المؤسسة العمل على توسيع تجربة إنتاج الإسمنت المقاوم للأملاح ليشمل مناطق أخرى في الجنوب الجزائري وخاصة التي تعاني من ظاهرة صعود المياه الجوفية، بالإضافة إلى تطوير بقية وحدات إنتاج الرمل والحصى للعمل وفق الشروط البيئية. The study aims to highlight the positive impact of the innovation of a new product represented by the salt-resistant cement (CPA-CEM I 42,5 ES) on the performance of Ain Touta Cement Company (Batna) represented in the volume of sales, and the results obtained showed that the innovative new product has contributed to raising the volume of sales and financial results. The two researchers presented some proposals, the most prominent of which are: The corporation should try to work on expanding the experience of producing salt-resistant cement to include other regions in the Algerian south, especially those suffering from the phenomenon of the rise of groundwater, in addition to developing the rest of the sand and gravel production units to work according to environmental conditions. Each State determines the criteria for granting its nationality and the conditions for registering vessels flying its flag. The first control a ship must undergo is that of the flag state, which must ensure the seaworthiness of the ship throughout its life. The concept of democratic transition has been the subject of intensive academic research, giving rise to a sub-discipline of political science: Transitology. While Transitology has made significant heuristic contributions, some of its assumptions are nonetheless laden with confusion, nuances, and many philosophical and political unsaid. The objective of this paper is to raise questions, explore avenues of reflection and analysis surrounding transitology, highlighting its heuristic contributions, but more importantly, its limits of interpretation. Indeed, transitology has often presented globalizing models that were supposed to be applied to any context, without taking into account the local specificities. However, accumulated experiences have shown that the success of any transition relies on adapting the chosen means to the specific context of each situation and the uniqueness of the terrain. The transition to democracy cannot be seen as a universal phenomenon that obeys general rules, but rather as a specific process inherent to a determined socio-historical context. Therefore, the major challenge is not to find the ideal path to build a Western-style democracy, but to identify, based on existing resources, the types of regimes that can emerge. Le concept de transition démocratique a fait l’objet de recherches académiques intensives qui ont donné naissance à une sous-discipline de la science politique: La transitologie. Si la transitologie a eu des apports heuristiques considérables, certains de ses postulats sont néanmoins porteurs de confusion, de nuances et de non-dits philosophico-politiques. L’objectif de cet article est de tenter de soulever des questionnements, des pistes de réflexion et d’analyse autour de la transitologie, en mettant en exergue ses apports heuristiques mais surtout ses limites d’interprétation. La transitologie a en effet souvent présenté des modèles globalisants devant être appliqués à tout contexte, sans la moindre prise en compte des particularités locales. Or, les expériences jusque-là cumulées ont démontré que la réussite de toute transition résulte de l’adaptation des moyens choisis au contexte propre à chaque situation et à l’unicité du terrain. La transition à la démocratie ne peut être appréhendée comme phénomène universel, susceptible d’obéir à des règles générales, mais plutôt un processus particulier inhérent à un contexte sociohistorique déterminé. L’enjeu majeur n’est donc pas de trouver la voie idéale pour construire une démocratie de type occidental, mais d’identifier, à partir des ressources existantes, les types de régimes qui peuvent émerger. Uncertainty is inherent in all human activity, its reduction is the primary objective of any operational information system within an organization.
