تهدف الدراسة إلى تحديد مدى تطبيق مبادئ حوكمة الجامعة، ودراسة ما إذا كان هناك اختلاف مهم إحصائياً في مدى تطبيق مبادئ حوكمة الجامعات في كليات التربية البدنية في العراق بسبب المتغيرات الديموغرافية من وجهة نظر أعضاء هيئة التدريس في كليات التربية البدنية في العراق.
يعتمد البحث على طريقة المسح المطبقة، سواء المنهج الوصفي والتحليلي المستخدم في هذه الدراسة باستخدام استبيان ذاتي الإدارة يستخدم كأداة بحثية. وتم توزيع ما مجموعه (320) استبيانا (294) تم جمعها (3) من الاستبيانات التي تم تجاهلها بسبب عدم التمكن من الردود، و 291 استبياناً كانت بيانات مناسبة للاختبار.
وأشارت النتائج إلى وجود متوسط درجة من عناصر الحوكمة المطبقة في الجامعات العراقية. كما أشارت النتائج إلى أن هناك اختلافًا كبيرًا بشكل ثابت في مدى تطبيق مبادئ حوكمة الجامعة من وجهة نظر أعضاء هيئة التدريس في كليات التربية البدنية في العراق بسبب الخبرة، وكانت اتجاهات هذه الاختلافات للتجربة (10- أقل من 15 عامًا).
وبحسب النتائج، يوصي الباحث بتحسين مستوى الحكم في الجامعات العراقية من خلال هيكل حاكم واضح مع أدوار ومسؤوليات محددة، يجب أن يكون الطلاب كأفراد مركز الاهتمام الأساسي لأعضاء هيئة التدريس، يجب أن يكون هناك احترام متبادل بين المعلمين والطلاب.
يجب على أعضاء هيئة التدريس قبول الحوار والمناقشة واحترام الحلول البديلة من الطلاب.
تبرز أهمية العقار الفلاحي باعتباره أحد أهم القطاعات الرئيسية في البناء الاقتصادي، الاجتماعي والسياسي لمعظم الدول، خاصة وأنه يلعب دوراً هاماً في التنمية الاقتصادية، حيث لا يهدده الزوال الذي تتعرض له الثروات الأخرى مثل المحروقات، ما جعل من المشرع الجزائري يبادر إلى إعادة الاعتبار له من خلال أحكام القانون رقم 10-03، يحدد شروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، محاولةً منه إلى تفعيل استغلاله بطريقة تعمل على الارتقاء به، في مقابل احتفاظ الدولة بملكيته، باعتباره ملكا للجماعة الوطنية، لا يقبل التنازل ولا الكسب بالتقادم.
تستهدف الدراسة الوقوف عند مختلف القوانين الناظمة للعقار الفلاحي والتركيز على نمط الامتياز المستحدث بموجب القانون رقم 10-03، وإبراز أهم العقبات التي تحول دون الاستقرار على سياسية ناجحة وناجعة لاستغلال العقار الفلاحي بالجزائر، وإن أكدت الدراسة أن الاعتبارات السياسية تتصدر أهم دوافع تغيير هذه السياسة من فترة لأخرى دون الأخذ بعين الاعتبار النتائج الاقتصادية المرغوب التوصل إليها، ما أثر سلبا على القطاع الفلاحي عامة.
The importance of agricultural real estate is highlighted as one of the most important sectors in economic, social and political, especially because it plays an important role in economic development, where it is not threatened by the demise of other wealth.
So the Algerian legislature has rehabilitated it through the provisions of Act No. 10-03, this lawdefines the terms and conditions for the exploitation of the peasant land belonging to the State's private property, in a way that elevates it.In return for the State's retention of ownership, as the property of the national community, neither the waiver nor the earning.

إن الحياة العلمية من أهم فروع الدراسات التاريخية والفكرية والحضارية، فهي تبرز النشاط العلمي والفكري في التراث الإسلامي.
مدينة نيسابور واحدة من أشهر مدن العالم الإسلامي الواقعة في بلاد خراسان، وإحدى الحواضر الإسلامية العريقة في التاريخ والحضارة، والعلم والدراسة، والثقافة والفكر، وذلك على مدى ستة قرون كاملة، إذ كانت نيسابور عاصمة لمقاطعة خراسان قديمًا، وتعد من أشهر مراكز الثقافة والتجارة والعمران، وهي من أهم وأبرز مراكز العلم من بين مدن خراسان، إذ إنها وصِفت بأنها مدينة العلم ومعقل من معاقل أشهر علماء الإسلام؛ لأنها تميزت عن غيرها من مدن خراسان بالنشاط العلمي والفكري والحضاري بفضل الجهود الكبيرة لحكامها وعلمائها الذين كان لهم الأثر الواضح في تكوين تاريخها وأصبحت أيضًا من أهم المدن سياسيًا واقتصاديًا فضلاً عن أنّها علميًا ندًا قويًا لأشهر المدن الإسلامية في المشرق والمغرب.
وُيعدّ الحافظ ابن عساكر من أبرز المؤرخين الذين كان لهم الأثر في التأليف التاريخي للمدن، فقد نال شهرة واسعة لعلميته وللمصنفات التاريخية الكبيرة التي قدّمها للمكتبات والتي يأتي في مقدمتها (تاريخ دمشق) الذي عُدّ أكبر مؤلفات التراجم التي أُلفت في التاريخ، إذ تميز هذا الكتاب بالشمول والتفصيل؛ لأنه ضمّ المحدّثين والفقهاء والقرّاء والمؤرخين والأدباء وعلماء اللغة وغيرهم، فضلًا عن كون هذا الكتاب بحرًا يجد كل دارس ما يبتغي فيه فيغرف منه العلم الكثير.
كان المنهج التاريخي الوصفي التحليلي هو المُتّبع في هذه الدراسة وذلك باستقراء المادة العلمية والتاريخية لمدينة نيسابور من بطون الكتب المختلفة، ودراسة علمائها من خلال كتاب (تاريخ دمشق) لابن عساكر وجمع تراجمهم وتنظيمها وتحليل ما دوّنه ابن عساكر في كتابه من هذه التراجم والروايات التاريخية، وذلك باللجوء إلى المصادر الأخرى إن استوجب الأمر، وجمع تراجم علماء نيسابور الذين ورد ذكرهم في كتابه .
ساهمت مدينة نيسابور بدور كبير في النشاط الفكري والعلمي، بوصفها أحد معاقل العلماء، إذ نبغ منها العديد من العلماء، فضلا عن الرحلات العلمية إليها ومنها، وكتاب (تاريخ دمشق) أبرز الكتب والمصنفات في تاريخ المدن، فقد احتوى على تراجم لكثير من العلماء على اختلاف الجنسيات والاختصاصات، فقد ذكر علماء نيسابور ودورهم البارز وإنجازاتهم، وإنّ من أهم فروع الدراسات التاريخية والحضارية هي دراسة الحياة العلمية عند المسلمين، إذ إنها تهتم بإبراز النشاط العلمي والفكري للتراث الإسلامي، فينبغي الاهتمام بهكذا دراسات والتشجيع عليها.
أضحى موضوع الوقاية من ظاهرة الفساد ومكافحتها محور اهتمام الدولة الجزائرية لاسيما فيما يتعلق بتعزيز آليات التصدي، وعلى الرغم من حداثة هذا الموضوع نسبيا في التشريع الجزائري إلا أنه يُعد من المواضيع المتجددة التي شكلت حيزا كبيرا في مجال الدراسات القانونية الأكاديمية.
تهدف هذه الدراسة إلى تسليط الضوء على أهم الإصلاحات المستحدثة لمجابهة جرائم الفساد والحد من آثارها السلبية، والمتمثلة أساسا في تطور الدور الوقائي للمجتمع المدني كأهم مستجدات التعديل الدستوري الجزائري لسنة 2020.
إن من أهم ما تضمنه التعديل الدستوري هو تعزيز دور ومكانة المجتمع المدني وتكريس عدة ضمانات دستورية قصد تمكينه من أداء هذا الدور على النحو المتطلب قانونا، إلا أن ما ينبغي التأكيد عليه هو أن فعالية مؤسسات المجتمع المدني كأحد أطراف استراتيجية الوقاية من الفساد تبقى مرهونة بمدى التجسيد الفعلي لأدواره المستحدثة، لاسيما في مجال التوعية بخطورة ممارسات ظاهرة الفساد وانعكاساتها السلبية على المجتمع، لما تستهدفه جرائم الفساد من تقييد حوافز التقدم الاقتصادي وعرقلة مسار التنمية المستدامة.
The issue of preventing and combating corruption has become the focus of the Algerian state's attention, especially with regard to strengthening coping mechanisms. Despite the relatively newness of this topic in Algerian legislation, it is one of the renewable topics that have formed a large space in the field of academic legal studies.
Where this study aims to shed light on the most important reforms introduced to confront corruption crimes and limit their negative effects, namely the development of the preventive role of civil society as the most important developments in the Algerian constitutional amendment 2020.
One of the most important contents of the constitutional amendment is to strengthen the role and status of civil society and to devote several constitutional guarantees in order to enable it to perform this role as required by law. However, what should be emphasized is that the effectiveness of civil society institutions as one of the parties to the strategy to prevent corruption remains dependent on the extent of its new roles embodiment, especially in the field of awareness and education about the seriousness of corruption and its negative repercussions on society, as corruption crimes aim to restrict the incentives for economic progress and obstruct the path of sustainable development

هدفت هذه الدّراسةُ إلى التّعرُّفِ على واقع التعليم الثانوي الرسمي في ظل الأزمة الإقتصادية والإجتماعية وتأثيرها على الأساتذة في محافظة عكار، والتّعرُّف على درجةِ تأثيرِ مُتغيّرات الجنس والعمر وعدد الأولاد والتعلم عن بعد وأزمة كورونا على التعليم الثانوي الرسمي.
استعملت الطالبة المنهجَ الوصفي، وتكوَّنَتْ عَيّنة الدّراسة من(300) أستاذ وأستاذة في( 7) ثانويات الرسمية في نطاق جغرافي وديموغرافي متنّوع على محافظة عكار، أي بنسبة(100%) من أفراد مجتمع الدّراسة الأصلي، واعتمدت الإستبانة المكوَّنة من(27) فقرة ومقسَّمة على محورين(الوضع الإقتصادي – الوضع الإجتماعي للأساتذة) ، واستخدمت برنامج(SPSS) لمعالجة البيانات، وأظهرت النّتائج ما يلي:
- إن أغلب الأساتذة في ثانويات عكار تأثروا بالأزمة الإقتصادية والإجتماعية.
-هناك تأثير كبير للأزمة الإقتصادية والإجتماعية الأمر الذي أدّى إلى هجرة بعض أساتذة ثانويات عكار.
- لا توجد فروق ذات دلالة إحصائية حول تأثر الواقع التعليمي في ثانويات عكار في ظلّ الأزمة الإقتصادية والإجتماعية عند مستوى الدلالة 0.05 تعزى لمتغير الجنس.
- توجد فروق ذات دلالة إحصائية حول تأثر الواقع التعليمي في ثانويات عكار في ظلّ الأزمة الإقتصادية والإجتماعية عند مستوى الدلالة 0.05 تُعزى لمتغيّر العمر.
وإنتهت الدّراسة بتقديم عدّة توصيات ومُقترَحات في ضوءِ نتائجِ الدّراسة المُستخلَصة.
إنَّ حماية المستهلك اصطلاح يجمع بين الفقه والاقتصاد والقانون، تسعى هذه الإطلاقات مجتمعة إلى حمايته في مواجهة المنتج والبائع، وتهدف الدِّراسة إلى تحليل إمكانية الوصول لآليات مشتركة لحمايته، وما دور أجهزة الرَّقابة الحديثة؟ وتمَّ التَّوصل إلى نتائج منها: قواعد لا ضرر ولا ضرار، والضَّرر يزال تمثِّل الإطار الفقهي العام الذي يحقِّق حماية وترشيد المستهلك بالرَّقابة الذَّاتية والمؤسسيَّة. إلى جانب الآليات الحديثة وخاصَّة: الَّتشريع، المواصفات القياسيَّة، الرَّقابة الحكوميَّة، المجتمع المدني، والقضاء. وضرورة تفعيل الدَّور المحوري لمصلحة قمع الغش من خلال الحملات التحسيسيَّة والخرجات الميدانيَّة، إلى جانب الجمعيَّة الوطنيَّة لحماية المستهلك بتنشيط حملات المقاطعة لرفع مستوى الوعي الاستهلاكي.
Consumer protection is a term that combines jurisprudence, economics and law. Together, these releases seek to protect it against the producer and the seller. The study aims to analysis the accessibility of common mechanisms for its protection, and what is the role of modern watchdogs? Results have been reached: no harm, no harm, and damage remains the general jurisprudence framework that protects and rationalizes consumers' self and institutional control. Besides modern mechanisms, especially: legislation, standards, government oversight, civil society, and the judiciary. The need to play a pivotal role in favors of the suppression of fraud through sensitization campaigns and field grades, together with the National Consumer Protection Association, by activating the province's campaigns to raise consumer awareness

تناولت الدراسة نموذج مقترح لتفعيل المراجعة الخارجية في النظام المحاسبي المالي و السياسة الإقتصادية بالصومال . حيث تمثلت مشكلة الدراسة في السؤال الرئيسي التالي : هل ممكن اقتراح نموذج لتفعيل المراجعة الخارجية لتحقيق جودة مخرجات النظام المحاسبي و الموثوقية النظام المالي بما يكفل جودة المعلومات المالية كمدخلات لسياسة الاقتصادية . هدفت الدراسة الى اقتراح نموذج لتفعيل المراجعة الخارجية يمكن معه التأكيد على ايجابيتها على النظام المالي دون الاضرار بالسياسات الاقتصادية الصومالية . توصلت الدراسة الى النتائج منها : تفعيل ممارسة المراجعة الخارجية على السياسة الاقتصادية ضرورة لضبط الاداء المالي والانفاق القومي والرقابة عليه بشكل جيد . أوصت الدراسة بتوجيه الفكر المحاسبي لإجراء مزيد من الدراسات التي من شأنها تقديم تفسيرات إضافية بشان أثر تفعيل المراجعة الخارجية على كل من النظام المحاسبي المالي وكفاءة السياسة الاقتصادية في الصومال .
الشراكة المجتمعية هي إحدى أدوات تفعيل الديمقراطية في المجتمع وأداة للتغيير يمكن من خلالها الإسهام في بناء مجتمع ديمقراطي حر وعادل، تدار فيه الشؤون العامة من خلال المواطنين ومن اجلهم على أساس احترام الكرامة الإنسانية وتحقيق العدالة الاجتماعية والمساواة بين جميع المواطنين، وبالمشاركة يتم تحريك همم وطاقات المواطنين للإسهام في مواجهة تحديات التنمية البشرية، فعلى المستوى المحلي فان الشراكة بين المجتمع المدني المحلي والقطاع الخاص المحلي والمواطن المحلي، هي شراكة مجتمعية مكملة للإدارة الحديثة وتكريس لمبادئ الحوكمة المحلية التي إذا طبقت النهج الصحيح حققت في الأخير ما يعرف بالتنمية المحلية، وهناك عدة نماذج كرست مبدأ الشراكة المجتمعية وحققت فعلا نجاحا متميزا كاليابان وغيرها من النماذج التي سيتم تناولها في هذه الدراسة.
Community partnership is one of the tools for activating democracy in society and a tool for change through which it is possible to contribute to building a free and just democratic society, in which public affairs are managed through and for citizens on the basis of respect for human dignity, social justice and equality among all citizens, and through participation, the determination and energies of citizens are mobilized. To contribute to facing the challenges of human development At the local level, the partnership between the local civil society, the local private sector, and the local citizen is a community partnership complementary to modern management and a dedication to the principles of local governance. If you apply the correct approach, you will eventually achieve what is known as local development. There are several models that enshrine the principle of community partnership and achieve a distinguished success, such as Japan. Which was adopted in the field of police... and other models that will be dealt with in this study.

كان الغرض من الدراسة هو تحديد مدى تأثير استراتيجية المندوب المتنقل على طلاب المرحلة الإعدادية في مدرسة الرسول الثانوية للبنين ، بالإضافة إلى تحديد درجة العلاقات بين الكفاءات في أبعادها المختلفة (الكفاءة الاجتماعية). ، الكفاءة البدنية ، الكفاءة الأكاديمية ، كفاءة الألعاب البدنية ، الجاذبية العاطفية ، الكفاءة في السلوك ، التقدير الذاتي الكلي) وبين المجموعات التجريبية ، والضابطة ، والاختبار البعدي كلها استخدمت التصميم التجريبي مع التحكم الجزئي. تم اختيار القسمين (أ) و (ب) اللذين يمثلان المجموعة الضابطة والمنهج التقليدي على التوالي من قبل الباحث عشوائياً لتمثيل المجموعة التجريبية الأولى واستراتيجية المندوب المتنقل على التوالي. تكونت العينة من تلاميذ المرحلة المتوسطة من مدرسة الرسول الثانوية للبنين بمنطقة بيسان. دعمت نتائج الدراسة حقيقة أن هذا التكتيك الجديد تم استخدامه إلى حد ما لكنه لم يقدم أي معلومات جديدة. من حيث وظيفتها وتأثيرها على الكفاءة الذاتية ودوافع الإنجاز ، فقد كشفت عن معلومات أكثر مما كان متوقعًا.
كثيرا ما يتبادر إلى الذهن حال سماع مصطلح الأقليات ان مسألة الأقليات ثانوية، ولا تتعلق الا بمصير جزء صغير من سكان الدولة، ولكن الواقع يؤكد ان المشكلة لا تخص الدولة فقط بل النظام العالمي أيضا. ان خصوصية حقوق الأقليات دفعت بمنظمة الأمم المتحدة إلى تبني اتفاقيات وإعلانات دولية تعني بهذه الفئة، فاحترام حقوق الانسان يمنح استقرار الدول داخليا، ويدعم الامن والسلم الدوليين
We often think that the question of minorities is subsidiary and touches a small part of population in a country but the reality confirms that the subject don’t concern only a state but so a mondial system .
The specifity of human rights has induced the united states to adopt agreements and international statements for these minorities .
The respects of human rights ensures the internal stability of states and supports international peace and security .

هدفت الدراسة إلى الكشف عن أثر مختبر الفيزياء المدرسي في تنمية حب الاستطلاع واكتساب المفاهيم العلمية لمادة الفيزياء لدى متعلمي الصف الثاني متوسط، ولهذا الغرض استخدمت الباحثة المنهج التجريبي على عينة مؤلفة من 60 متعلمًا مقسمين إلى مجموعتين؛ بحيث 30 متعلمًا يمثلون المجموعة التجريبية التي ستدرس عن طريق استخدام المختبر المدرسي، و30 متعلمًا يمثلون المجموعة الضابطة والتي ستتلقى دروس الفيزياء وفق الطريقة المعتادة. وقد قامت الباحثة شخصيًا بتدريس المجموعتين وفق خطة تدريسية لكل مجموعة أعدتها لتحقيق أهداف الدراسة الراهنة، وقد استخدمت الاختبار القبلي والاختبار البعدي لبيان الفروق بيم المجموعتين وإظهار مدى فعاليّة استخدام المختبر المدرسي في تنمية حب الاستطلاع لدى المتعلمين واكتسابهم للمفاهيم العلمية، وتوصلت الدراسة إلى وجود فروق ذات دلالات إحصائية بين المجموعتين (التجريبية والضابطة) تعزى إلى استخدام مختبرات العلوم في اكتساب المفاهيم العلمية لمادة الفيزياء لدى متعلمي الصف الثاني متوسط، ويعزى سبب ذلك إلى إسهام استخدام المختبر المدرسي -لمتعلمي المجموعة التجريبية- في زيادة استيعابهم للمادة العلمية، وبالتالي إلى اكتساب المفاهيم العلمية في مادة الفيزياء نتيجة إجرائهم للتجارب العملية، وأن استخدام المختبر قد سمح للمتعلمين بإبداء آرائهم ومناقشة أفكارهم وتطبيقها الأمر الذي أدى إلى زيادة اكتسابهم للمفاهيم العلمية. كما تبين وجود فروق بين المجموعتين التجريبية والمجموعة الضابطة تعزى إلى استخدام مختبرات العلوم وتنمية حب الاستطلاع في مادة الفيزياء لدى متعلمي الصف الثاني متوسط، ويعزى السبب إلى فاعلية استخدام مختبرات العلوم التي استخدمتها الباحثة في تدريس المجموعة التجريبية، وضمان استخدام مختبرات العلوم استيعاب المتعلمين للمفاهيم العلمية وحب الاستكشاف والاستطلاع. وبعد عرض النتائج عرضت الباحثة جملةً من التوصيات منها: تأهيل وتجهيز مختبرات العلوم الموجودة في المدارس والتي تعاني من النقص في المعدات والأدوات، إدراج الأعمال التطبيقية في المختبر كجزء أساس من البرنامج السنوي المدرسي، دعم المختبرات وتزويدها بالأجهزة والأدوات اللازمة لإتمام المنهاج الدراسي.
نص القانون على جريمة التعدي على الملكية العقارية بموجب نص المادة 386 من قانون العقوبات، هذا النص وبالإضافة إلى الأركان العامة للجريمة، اشترط عنصرين آخرين لقيامها، وهما عنصري الخلسة والتدليس، إلا أنه ونظرا لوجود لبس وعدم وضوح المقصود بهذين العنصرين، تدخل الاجتهاد القضائي المتمثل في العديد من القرارات القضائية، هذه الأخيرة لم تستقر على توجه واحد في تفسيرها لهذين العنصرين.
لذلك ومن خلال هذا المقال العلمي أردت تسليط الضوء على العناصر الخاصة المكونة لجريمة التعدي على الملكية العقارية طبقا للنص التشريعي وهو نص المادة 386 من قانون العقوبات وكذلك وفقا للاجتهاد القضائي للمحكمة العليا
Article 386 of the Algerian Penal Code deals with the crime of real estate property infringement. Along with the general elements of the crime, this legal text stipulates two other crucial elements; surreptitiousness and fraud (deception). However, due to the lack of clarity of the meaning of these two elements, the jurisprudence in the form of many judicial decisions (case-law) had to intervene but could not settle on a single approach in its interpretation of these two elusive elements. Therefore, this paper attempts to shed light on the distinctive elements of the crime of real estate property infringement, according to the legislative text (Article 386 of the Penal Code) as well as the jurisprudence of the Supreme Court.

دور المرأة في المجتمع الإسلامي لقد جاء الإسلام للناس كافّة، بمختلف منابتهم وأشكالهم وألوانهم صغارا وكبارا، ذكورا وإناثا، فلا فرق بينهم، ولقد أولى الإسلامُ منذ بداية الدعوة المرأة اهتماما خاصا، كما أنه اهتم بحقوق المرأة وكرَّمها، وجعل لها كلمةً مسموعةً في كل وقتٍ وحين، فالمرأةُ كانت قبل الإسلام، تُقتلُ وهي صغيرة؛ لئلّا تجلب لهم العار، هذا زعمُ أهل الجاهلية، لكن جاء الإسلام وأنصفها وأنقذها من مستنقع الجهل ذاك. وقد بين الإسلامُ أن للمرأة دورا هامّا في المجتمع الذي تعيش فيه، فهي مسؤولةٌ مسؤوليةً تشاركيّة مع زوجها في إنشاء جيلٍ مسلمٍ، مؤمن بالله، ذو أخلاقٍ سامية، قدوته رسول الله -صلى الله عليه وسلّم-، فلو أن كلَّ أُسرةٍ عملت بذلك لتغير المجتمع إلى أحسن ما يكون. ومن دور المرأة في المجتمع وهو في العمل أن تختار المجال الذي يُناسب مكانتها والرسالةَ التي تحملها لترتقي بالمجتمع إلى درجةٍ عالية من السمو والأخلاق، وبذلك تكون قد أدت الأمانة الأخلاقية، فتكون مثالًا يُحتذى بهِ للأجيال الصاعدة في مجالات العمل المختلفة كالتعليم والطب والمدرسة.وللمرأة دورٌ في أن تُحافظ على نفسها من أن تكون كما يُروّج أصحاب النفوس المريضة، فهم يُنادون بتحرر المرأة، ولا يريدون من ذلك إلّا حرّية الوصول إلى المرأة، فيجب أن تحذر من هؤلاء الذين يُحرّضون على فساد المجتمع بنشر الشهوات والمنكرات والدعوة إليها. نماذج لدور المرأة في المجتمع الإسلامي سأذكر بعض النماذج للمرأة المسلمة فيما يأتي: دور أم سلمة -رضي الله عنها- في المشورة على رسول الله -صلى الله عليه وسلم- عندما عادوا من صلح الحديبية وكانت نيتهم الحج فعقدوا الصلح، فانتكس الصحابة -رضوان الله عليهم- فما كان من أم سلمة إلا أن تشير على رسول الله بأن يفعل كما لو أنّه عاد من الحج، ففعل ذلك، ففعل الصحابة ذلك وبهِ تغيرت الأجواء وعمت السعادةُ والرضى. دور ذات النطاقين أسماء -رضي الله عنها- عندما كانت تُخاطر بنفسها لتوصل الطعام إلى رسول الله - صلى الله عليه وسلّم- ووالدها أبي بكر، فكانت تسير مسافة بعيدة والأرض شاقة ووعرة والشمس حارقة، فضحت في سبيل الله نُصرةً للدعوة ولنهضةِ المجتمع. دور السيدة خديجة في حمل أعباء الدعوة عن الرسول -صلى الله عليه وسلّم- وكانت من أوائل الذين أسلموا من النساء والرجال، فوقفت مع الرسول-صلى الله عليه وسلم- في الشدة قبل اليسر، فحملت عنه أعباء الدعوةِ ومشاقّها، وجاهدت في سبيل الله بنفسها ومالها -رضوان الله عليها-. مكانة المرأة في الإسلام لقد أولى الإسلام المرأة مكانة عظيمة، وأكرمها بما لم يكرمها به دينٌ آخر، فالنساء في الإسلام شقائق الرجال، فالمسلمة في طفولتها لها حق الرضاع، والرعاية، وإحسان التربية، وما زالت مجتمعات المسلمين، تولي المرأة اهتماما شديدا، وترعاها رعايةً خاصة، امتثالًا لوصايا رسول الله بالنساء وبحفظ المرأة وإكرامها والإحسان اليها.
يُعتبر الأمن القانوني من أهم المبادئ التي تسعى الدُول لتحقيها، وذلك بهدف الحفاظ على استقرار المراكز القانونية للأفراد عند وضع تشريعاتها المتعلقة بالحقوق والحريات، وهو ما دفع بالمشرع الجزائري لتكريسه طبقا لنص المادة 34 من التعديل الدستوري الأخير لسنة 2020، لكن بالرجوع إلى ما يتطلبه التشريع في مجال القانون الجنائي للأعمال من السرعة للتَّكيف مع واقع الأعمال قصد حماية المال العام، والحفاظ على الأمن الاقتصادي للدولة والذي أَطلق عليه الفقه مصطلح تطويع القاعدة التشريعية، إلا أن هذا التطويع قد يحُول دون تحقيق الأمن القانوني، وهو ما تهدف إليه هذه الدراسة من خلال التطرق لمفهوم الأمن القانوني وأهميته وكذا الأسس التي يرتكز عليها، ثم محاولة بيان أهم مظاهر المساس بمبدأ لأمن القانوني في ظل خصوصية جرائم الأعمال.
ومن أهم النتائج التي توصلنا إليها أنه بالرغم من سعي المشرع الجزائري إلى تكريس مبدأ الأمن القانوني دستوريا، إلا أن تحقيقه في ظل خصوصية التشريع لجرائم الأعمال يبقى نسبيا فقط باعتباره قانونا مرنا وسريع التأثر والتطور بهدف حماية الأمن الاقتصادي
Legal security is one of the most important principles that states strive to achieve, with the aim of maintaining the stability of the legal positions of individuals when developing their legislation related to rights and freedoms, which prompted the Algerian legislator to devote it according to the text of Article 34 of the last constitutional amendment of 2020. However, with reference to what the legislation requires in the field of criminal law for business, it is quick to adapt to the reality of business in order to protect public money and maintain the economic security of the state, which jurisprudence calls the term "adapting the legislative base". Nonetheless, this adaptation may prevent the achievement of legal security. This study aims at addressing the concept of legal security, its importance, and the foundations on which it is based. Then, there is an attempt to show the most important aspects of violating the principle of legal security in light of the specificity of business crimes.
One of the most important findings that we have reached is that despite the Algerian legislator’s endeavor to establish the principle of legal security constitutionally, its achievement in light of the specificity of the legislation for business crimes remains only relatively, as it is considered a flexible, vulnerable, and rapidly developing law with the aim of protecting economic security.

تعد القيم الاجتماعية من المواضيع العالمية لارتباطها بالبناء الاجتماعي والحياة الإنسانية الخاضعة لمظاهر التغير بمختلف أشكاله. و قد فتحت هذه المسألة العامة مجالا واسعا بغية تأصيله وإزالة اللبس والغموض عنه عند العلماء رغم تداخل الآراء والاتجاهات فيما بينهم، حيث أفرزت هذه المجهودات كما معرفيا وتراثا نظريا ساعدنا لتناول موضوع عنوانه القيم الاجتماعية في مجتمع المدينة في ضوء القرآن الكريم" سورة التوبة انموذجاً، وذلك لمعرفة طبيعة التغيرات الاجتماعية والثقافية التي وقعت على كل من مفهوم القيم الاجتماعية في المدن وكيفية التعامل معها. كما تعد المدينة مجالا خصبا لطرح المواضيع القابلة للتغير بشكل سريع ودائم، وقد حاولنا التركيز في هذه الدراسة على أهم النقاط التي تجدر الإحاطة بها، وذلك بالتركيز خاصة على ربط كل من مفهوم القيم الاجتماعية بالقرآن الكريم ليتشكل موضوعا جديدا قابلا للبحث والتفصيل ومن هنا تبرز لنا الأهمية الملحة للموضوع في الكشف عن طبيعة القيم الاجتماعية في الوسط الحضري الذي يحظى بتنوع في القيم الاجتماعية بشكل دائم ومستمر، وقد كان الهدف الأساسي للدراسة هو معرفة مدى محافظة المجتمع على قيمه وعاداته الاجتماعية في ظل موجة التغير الاجتماعي والثقافي وذلك بالتركيز على دور الأسرة باعتبار أنها من أهم المؤسسات الاجتماعية التي تقوم بعملية التنشئة الاجتماعية والتربية الدينية والخلقية.
تحاول هذه الدراسة تسليط الضوء على آلية تفويض المرفق العام في الجزائر، كأسلوب جديد للتسيير، والذي جاء نتيجة العيوب المسجلة في ظل التسيير العمومي للمرافق العامة، ليضع بذلك حدا لاحتكار القطاع العام لمهمة تسيير المرفق العام من جهة، وفتح المجال للقطاع الخاص لتولي هذه المهمة من جهة أخرى، وهو ما اضطلع به المشرع الجزائري من خلال المرسوم الرئاسي رقم 15-247 المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام، واتبعه أكثر تفصيلا المرسوم التنفيذي رقم 18-199 المتعلق بتفويض المرفق العام، بهدف التطبيق الناجح والسليم لهذا الأسلوب، كنمط مواكب للتطورات وبغية تطوير وتحسين جودة الخدمة العمومية
study attempts to shed light on the mechanism of authorizing the public utility in Algeria, as a new method of management, which came as a result of the defects recorded in the light of the public management of public utilities, to put an end to the monopoly of the public sector on the task of managing the public utility on the one hand, and to open the way for the private sector to take over this task on the one hand. On the other hand, this was undertaken by the Algerian legislator through Presidential Decree No. 15-247 related to the organization of public transactions and public utility mandates, and was followed in more detail by Executive Decree No. 18-199 related to public utility authorization, with the aim of the successful and proper application of this method, as a pattern keeping pace with developments and in order to Develop and improve the quality of public service.

تم استخدام المنهج الوصفي التحليلي في هذا البحث لدراسة درجة انخراط معلمي اللغة العربية في المرحلة المتوسط في مهارات التعلم الذاتي.
وشكلت العينة ثلاثة وتسعون معلم لغة عربية للمرحلة المتوسطة من مدارس محافظة واسط بمنطقة العزيزية. تم اختيار هؤلاء المدربين بشكل عشوائي من بين مجموعة معلمي اللغة العربية في العينة.
يتم تتبع مقدار تقنيات التعلم الذاتي التي يستخدمها مدرسو اللغة العربية من خلال استبيان.
أظهرت النتائج أن مدرسي اللغة العربية يستخدمون تقنيات التعلم الذاتي بمعدل متوسط، ويتخذون خطوات مثل إنشاء جداول زمنية مناسبة للأهداف التعليمية ومستويات الطلاب بالإضافة إلى تقنيات التعلم الذاتي.
وبحسب عوامل الجنس ودرجة التعليم وسنوات الخبرة، تشير النتائج إلى عدم وجود فروق بين ممارسات التعلم الذاتي للمعلمين والمعلمات في موضوع اللغة العربية.
قدم البحث العديد من الاقتراحات والأفكار من خلال النتائج.
إن تقدير الضررالمعنوي كمسوغ قانوني للحكم بالتطليق لصالح الزوجة كالطرف المتضرر، وبموجب ما نص عليه قانون الأسرة الجزائري، هي من أهم الوقائع التي تطرح على القضاء اليوم، مع ما تفرضه من التطورات في مجرياتها وحيثياتها، فاستلزم تداخل الأضرار مع المصالح بالنظر إلى نتائجها المتوقعة عند التصور للتكييف المناسب للقرارات والأحكام القضائية، وفق تقدير الضرر المسوغ لمنح الحكم بالتطليق. والحالات والصور تختلف، فكل حالة بما يناسبها، ما يتطلب تكييف الوقائع وفق ما يفرضه الواقع الجزائري بمعطياته المستجدة، والمتطورة على الدوام، وبما يحقق أهداف التشريع والمصالح العامة للدولة، والتي تلزم إقرار الحكم تأسيسا على النظرة القانونية في ضوء موازنة علمية دقيقة، تتقيد بقواعد تضبط حجم الضرروفق الاعتبار الشرعي والقانوني نحو الحفاظ على الاستقرار الأسري، والصالح العام في نطاق فقه الواقع ومقاصد التشريع الإسلامي وكلياته الضرورية.
Estimating the moral harm as a legal justification for ruling in favor of the wife in divorce cases, in accordance with Algerian family law, is one of the significant issues currently facing the judiciary. This issue poses challenges due to its evolving nature and intricacies, thus necessitating a careful examination of the interplay between damages and interests, considering the anticipated ramifications when envisioning appropriate adaptations of judicial decisions and judgments. Consequently, it is imperative to align damages with interests within the Algerian context, which is characterized by emerging and evolving dynamics, while simultaneously achieving the legislative objectives and public interests of the state. Accordingly, rendering judgments based on a meticulous scientific balancing act, rooted in legal and Islamic principles, becomes essential. Such an approach abides by regulations governing the magnitude of harm, as per both legal and Sharia considerations, in order to uphold family stability and the greater public good, within the purview of the practical jurisprudence and essential tenets of Islamic legislation.

تهدف الدراسة الحالية إلى التعرف على (الاثر الذي تحققه استراتيجية مفاتيح المعرفة في رفع مستوى تحصيل متعلمي الصف الرابع عند دراسة مادة التاريخ).
ولتحقيق هدف البحث اعتمد الباحث اجراءات المنهج التجريبي، إذ تضمنت هذه الاجراءات اختيار التصميم التجريبي، إذ اعتمد تصميم المجموعات المتكافئة ذات الاختبار القبلي والبعدي ، وتضمن التصميم مجموعتين احداهما تجريبية والاخرى ضابطة تدرس مجموعة البحث التجريبية باستعمال استراتيجية مفاتيح المعرفة، بينما تدرس مجموعة البحث الضابطة بطريقة التدريس الاعتيادية، إذ تم اختيار ثانوية (الحسن بن علي) عشوائيا، لتكون مكاناً لأجراء التجربة، إذ بلغ عدد المتعلمين لعينة البحث (60) متعلماً، وبواقع (30) متعلماً في مجموعة البحث التجريبية، و(30) متعلماً، في المجموعة الضابطة، وتم اجراء التكافؤ بين مجموعتي البحث في عدد من المتغيرات التي أشارت الدراسات السابقة والأدبيات المتخصصة عن احتمال تاثيرها في نتائج التجربة وهي (مستوى الذكاء ، اعمار المتعلمين ، المعرفة السابقة ، مستوى التحصيل الدراسي للامهات والأباء)، ثم حاول الباحث السيطرة على عدد من العوامل الدخلية، التي من الممكن أن تؤثر في متغير التجربة التابع، وهي ليست متغيراً مستقلاً.
وقد قام الباحث بتدريس المجموعتين للبحث الحالي بنفسه، وقد شملت المادة التعليمية الفصول الاربعة الاخيرة من الكتاب المقرر لتدريس مادة التاريخ الاسلامي لمتعلمي الصف الرابع الادبي للسنة الدراسية (2022-2023م).
وقد اعد الباحث اختباراً تحصيلياً مكوناً من (50) فقرة، وقد تأكد من صدق وثبات الاختبار التحصيلي، وأستخرج معامل الصعوبة لفقراته، وقوة التميز لفقراته، ثم طبقه على عينة البحث المجموعتين (التجريبية والضابطة)، بعد إكمال اجراءات التجربة التي استغرقت مدة تطبيقها كورسا دراسيا كاملاً. وقد أستعمل الباحث الوسائل الاحصائية المناسبة لتحليل البيانات، وبعد تحليل البيانات اسفرت الدراسة عن تفوق متعلمي مجموعة البحث التجريبية على متعلمي مجموعة البحث الضابطة في اختبار التحصيل البعدي. ومن خلال هذه النتائج، توصل الباحث الى عدد من الاستنتاجات وسيعرضها كما يلي:
1- كان لاستراتيجية مفاتيح المعرفة الأثر الواضح في رفع مستوى تحصيل متعلمي الرابع الادبي بمادة التاريخ الاسلامي.
2- ان استراتيجية مفاتيح المعرفة ساعدة متعلمي الرابع الادبي على تذكر واسترجاع المعلومات الخاصة بمادة التاريخ بسرعة كبيرة مع الاحتفاظ بها لمدة اطول.
وقد قدم الباحث بعض التوصيات التي سيذكرها بعضاً منها كما يأتي:
1- ضرورة تدريب مدرسي ومدرسات مادة التأريخ في المرحلة الاعدادية على استعمال استراتيجية مفاتيح المعرفة، وكيفية الإفادة منها في تدريس المادة.
2- توفير الكتب والمصادر والمعدات والاجهزة التعليمية المعاصرة في المدارس الاعدادية والثانوية لتسهيل استعمال الاستراتيجيات الحديثة في التعليم.
واقترح الباحث اجراء عدد من الدراسات المكملة للدراسة الحالية كم يأتي:
1- معرفة أثر استراتيجية مفاتيح المعرفة في اكتساب المفاهيم التأريخية وتنمية التفكير الاستدلالي لدى متعلمي المرحلة الاعدادية في تاريخ الاندلس.
2- معرفة فاعلية استراتيجية مفاتيح المعرفة في تعلم المفاهيم التاريخية وتنمية التفكير التصوري لدى طلبة كلية التربية للعلوم الانسانية قسم التاريخ في تاريخ العصر العباسي.
توضح معظم الدراسات الفقهية بلا شك مسألة عدم الاستقرار المفاهيمي لخطاب الكراهية، وهذا بالنظر إلى عوامل متعددة تؤثر بشكل مباشر على الاصطلاح المتبنى تشريعيا أو قضائيا أو فقهيا، منها ما يرجع إلى الاختلاف القانوني، ومنا ما يعود لإرهاصات الإرث التاريخي، ومنها ما هو متعلق ببنية المجتمع، وغير ذلك من الأسباب التي صبت في وضع مفاهيم متضاربة، حيث ركزنا في هذه الورقة البحثية على المقاربة المفاهيمية المرتبطة بالإصطلاح الفقهي لخطاب الكراهية، وحاولنا الإجابة على تساؤل رئيسي يدور حول كيفية الوصول إلى تحقيق مبنى مفاهيمي سليم لخطاب الكراهية، وذلك من خلال الوقوف على الاختلافات الاصطلاحية بين المفهومين الضيق والموسع لخطاب الكراهية، ثم تحديد أهم المرتكزات التي ينبغي أن يبنى عليها تعريف خطاب الكراهية
Most doctrinal studies undoubtedly illustrate the conceptual instability of hate speech in view of multiple factors directly affecting legislative, judicial or juridical terminology, They are due to legal difference and to the legacies of the historical legacy, Among them are those relating to society's structure and other reasons for developing conflicting concepts, In this paper, we focused on the conceptual approach associated with the jurisprudence of hate speech. And we tried to answer a key question about how to achieve a sound conceptual building for hate speech, By identifying the terminological differences between the narrow and expanding concepts of hate speech and then identify the most important pillars on which the definition of hate speech should be based.
