Creator An entity primarily responsible for making the resource يوسف كاظم حمادي د. يوسف الجاجية بوتلجة, حسين Date A point or period of time associated with an event in the lifecycle of the resource 2023-12-02 2023-06-15 Description An account of the resource تناول هذا البحث الشوائب التي دخلت كتب التفسير في القرن الرابع عشر الهجري، حيث بين البحث أولاً أهم الأسباب التي أدت إلى دخول الشوائب في تفاسير هذا القرن مبيناً مناهج أصحابها والأسس التي استندوا عليها في تفاسيرهم وفي إدخال الشوائب في كتب التفسير، كما تناول البحث جملة من الشوائب المنتزعة من كتب التفسير في هذا القرن في جملة من القضايا العقدية والقضايا الاجتماعية والاقتصادية، فبين أصولها وطرق معالجتها ومواردها والرد عليها بالاستشهاد بنصوص الوحي وبالأحاديث النبوية الشريفة إلى جانب مصدر التشريع الأخرى كأقوال الصحابة والتابعين، والإجماع وما سواها من المصادر التشريعية المنبثقة من صميم الشريعة للإسلامية. وكان من جملة القضايا التي عالجها هذا البحث معاجز الأنبياء عليهم السلام جميعاً والقصص القرآني ومسألة خلق الإنسان، حيث بين البحث كيف حاول أصحاب التفاسير بشوائبهم التقليل من معاجز الأنبياء والتعلق بالماديات عبر تأويلات مفترضة بعيدة عن روح اللغة ولا يحتملها النص القرآني، كما فرغوا القصص القرآني من مضمونها حتى غدت عندهم بمثابة قصص أدبية تتم معالجتها بالطرق الأدبية المعروفة، وهذا ما فيه استهانة بكلام الله جل وعلا ومساواته بكلام المخلوقين، وكذلك تناول البحث جملة من القضايا الاجتماعية والاقتصادية المتصلة بشكل مباشر بحياة الإنسان، كالطلاق وتعدد الزوجات والقمار وما سواها من مسائل نتج عن الشوائب التي أدخلها المفسرون في معالجتهم لها وتفسير الآيات المرتبطة بها  تحليل ما حرم الله وتحريم ما حلله متلبسين بلبوس الدعوة إلى الإصلاح والتجديد وكمجاراة أحكام النهضة، فكان هذا كله بالنتيجة بعيداً عن روح الإسلام ومخالفاً لتعاليمه، ومناقضاً لأحكامه ومعارضاً لنصوص الوحي والسنة النبوية الشريفة. نسعى من خلال هذه الدراسة إلى بيان مختلف التدابير القانونية المتخذة من قبل الجزائر للامتثال لاتفاق باريس حول المناخ، بحيث تتمثل هذه التدابير على المستوى الداخلي في تدابير التخفيف من الإنبعاثات من الغازات الدفيئة والتكيف للتغيرات المناخية، كما أن الجزائر ملزمة بالخضوع للرقابة وذلك بالوفاء بإطار الشفافية المحدد في اتفاق باريس، كما أن امتثال الجزائر ليس مرهون فقط بإتخإذ تدابير مختلفة على المستوى الداخلي ولكن متوقف كذلك على المساعدات التكنولوجيا وبناء القدرات، والمالية الواجب توفيرها من قبل اتفاق باريس، ضف إلى ذلك تمكين الجزائر من المشاركة في آلية التنمية المستدامة بما يسمح لها بتحقيق مجهودات التخفيف الواردة في مساهماتها المؤقتة المحددة على المستوى الوطني والوصول إلى الامتثال لاتفاق باريس حول المناخ Many legal measures taken by Algeria in compliance with the Paris climate agreement, which we seek to show through this study. Creator An entity primarily responsible for making the resource رائد حروش ابراهيم د. نسرين مرعب د. سامر البيضا براحلية, زوبير Date A point or period of time associated with an event in the lifecycle of the resource 2023-12-02 2023-06-15 Description An account of the resource هدفت الدراسة إلى التعرف على أثر استخدام استراتيجية KUD في تنمية التفكير التباعدي في مادة الكيمياء. ولتحقيق أهدافها، تم اعتماد المنهج شبه التجريبي، وقد جرى اختيار العينة بطريقة عشوائية وشملت (69) متعلماً ومتعلمة من متعلمي الصف الخامس العلمي في إعدادية خانكي المختلطة. تمثلت أدوات الدراسة باختبار للتفكير التباعدي للصف الخامس العلمي، من أجل التعرف على أثر استخدام استراتيجية KUD. توصلت الدراسة إلى النتائج الآتية: وجود فروق ذات دلالة إحصائية بين متوسطي درجات متعلمي المجموعة التجريبية بين التطبيقين القبلي والبعدي في اختبار التفكير التباعدي، لصالح التطبيق البعدي. وجود فروق ذات دلالة إحصائية بين متوسطي درجات طلبة المجموعتين التجريبية والضابطة في التطبيق البعدي المباشر على اختبار التفكير التباعدي، لمصلحة متعلمي المجموعة التجريبية. عدم وجود فروق ذات دلالة إحصائية بين متوسطي درجات طلبة المجموعة التجريبية على اختبار التفكير التباعدي تبعاً لمتغير الجنس. وفي ضوء هذه النتائج قدمت الدراسة عدداً من التوصيات والمقترحات. استحدث المشرع الجزائري أسلوب جديد لإستغلال الآراضي الفلاحية التابعة للأملاك الوطنية الخاصة، عرف بالإمتياز الفلاحي وهذا بموجب القانون رقم 08/16 المتضمن قانون التوجيه الفلاحي أين تم تجسيده بموجب القانون رقم 10/03 المحدد لشروط وكيفيات إستغلال الآراضي الفلاحية التابعة للأملاك الخاصة للدولة، وتفاديا للثغرات التي كانت في التنظيمات السابقة حاول وضع آليات تضمن حمايته من جهة وضمان عدم خروجه عن الأهداف المسطرة له، ومن بين أهم الآليات التي رصدت لحماية عقد الإمتياز في إطار القانون10/03 هي؛ الحماية الإدارية والمتمثلة أساسا في الدور الرقابي الذي يمارسه الديوان الوطني للأراضي الفلاحية على استغلال هذه الأملاك، بالإضافة إلى الحماية القضائية من خلال بسط الجهات القضائية رقابتها على كل إخلال في تطبيق أحكام القانون10/03، سواء من جانب المستثمر صاحب الإمتياز أو الدولة أو حتى الغير ويكتسي هذا الموضوع أهمية بالغة كونه يرتبط بأحد القطاعات الحساسة ذات البعد الاقتصادي والاجتماعي The Algerian legislator introduced a new method for the exploitation of agricultural lands belonging to private national property, known as the agricultural concession, and this is in accordance with Law No. 08/16 that includes the Agricultural Guidance Law, where it was embodied in accordance with Law No. 10/03 that specifies the conditions and modalities for the exploitation of agricultural lands belonging to the private property of the state, and In order to avoid the loopholes that were in the previous regulations, he tried to put mechanisms in place to ensure his protection on the one hand, and to ensure that he does not deviate from the goals set for him, and among the most important mechanisms that were allocated to protect the concession contract within the framework of Law 03/10 are; Administrative protection, mainly represented in the oversight role exercised by the National Office of Agricultural Lands on the exploitation of these properties, in addition to judicial protection through the extension of judicial authorities oversight of every breach in the application of the provisions of Law 03/10, whether by the concessionaire investor, the state, or even third partie ; This issue is of great importance as it is related to one of the sensitive sectors with an economic and social dimension. Woman plays an important role in transnational organized crime regardless of her status and circumstances. Evidence has shown that women have been and still active as members and leaders of criminal organizations around the world and in different periods of history, casting a shadow over the prevailing notion: the “sudden rise” of the woman’s power where her activities and role have changed. After being a victim, she became a perpetrator, a member and then a leader, which provides a changing character for transnational organized crime and new criminal agents and more complex markets for woman. Consequently, governmental and non-governmental organizations seek, in coordination with states, to dismantle them and return woman to her feminine natural nature in exchange for protecting and defending her and trying to integrate her into society. In order to regulate investment, in particular foreign investment, the Algerian legislator has established bodies responsible for investment in accordance with Ordinance No. 01-03 on the development of partially cancelled investment and Act No. 16.09 on promotion of investment, consisting of the National Agency for Investment Development and the National Investment Council, which carry out prior monitoring of foreign investment, which is reflected in the Agency'guidance and rationalization of foreign investors and its follow-up on the completion of the investment project. The study found that, under the 16-09 Act on Promotion of Investment, the legislator relaxed the control of investment agencies in order to attract foreign investment, but nevertheless did not find acceptance from foreign investors due to shortcomings in the investment laws. Creator An entity primarily responsible for making the resource كريم حسين محمود الجبوري د. نوال يوسف عطار , فاضل مباركي, دليلة Date A point or period of time associated with an event in the lifecycle of the resource 2023-12-02 2023-06-15 Description An account of the resource الحمد لله حمدًا يليق بجلاله، وعظمة سلطانه، وواسع رحمته، نحمده حمدًا كثيرًا طيّبًا مباركًا فيه، ونستغفره ونتوب إليه، والصّلاة والسّلام على نبيّنا محمد، وعلى آله وصحبه أجمعين، فهو المبعوث رحمةً للعالمين. أما بعد: فقد شرّفنا الله سبحانه وتعالى ، وهدانا بكتابه العزيز، الذي أنزله على خير البشر، وأفضل الخلق، وسيّد الكونين، وخاتم الأنبياء والمرسلين محمد بن عبد الله عليه أفضل الصّلاة وأتمّ التّسليم. التّربية في القرآن الكريم، هي تربية ربّانيّة، منهجها من عند الله تعالى، فقد جاء الحثّ عن طريق القرآن الكريم، ونحن البشر علينا التّفكير والتّدبّر، فالمهج الإسلاميّ شاملًا لحياة البشر في دنياه وآخرته، و نظم علاقة الإنسان مع جميع ما في الكون حتّى مع نفسه. واتّسمت التّربية الإسلاميّة بالوضوح في مجالات الحياة كافّة، السّياسيّة، والدّينيّة، والاجتماعيّة، والاقتصاديّة. إنَّ أهميّة تعلّم القرآن وتعليمه، هي من أشرف المهن؛ ولهذا، نحن ملزمون كمسلمين أن نتعلّم كلّ ما يحتويه، وأن نلتزم بكلّ ما فيه من أوامر ونواهي، فهو الدّستور الأعظم، إذا أردنا أن نعيد أمجادنا وحضارتنا وقوّتنا وهيبتنا، فعلينا أن نربّي جيلًا واعيًا ملتزمًا بتعاليم القرآن، فالتّربية السّليمة على النّهج الصّحيح، هي الوسيلة لتحقيق ذلك. فالقرآن الكريم هو كلام الله سبحانه وتعالى، مهما أجرينا عليه الدّراسات، وبحثنا فيه، فلن نصل إلى قاع بحره المليء بالجواهر الثّمينة، فالعلم كلّه في محتواه يعجز العقل البشريّ عن تدبّر كلّ ما فيه، فقد احتوى الدّنيا والآخرة، والماضي والحاضر والمستقبل. إنّ ما يميّز به هذه الأمّة عن سواها، أنّها خير أمّة أخرجت للنّاس، قال سبحانه: (كُنْتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنْكَرِ وَتُؤْمِنُونَ بِاللَّهِ وَلَوْ آمَنَ أَهْلُ الْكِتَابِ لَكَانَ خَيْرًا لَهُمْ مِنْهُمُ الْمُؤْمِنُونَ وَأَكْثَرُهُمُ الْفَاسِقُونَ)([1])، كما أنّه بُعث فيها خاتم الأنبياء والمرسلين، وسيّد الثّقلين، محمد r. وسورة العصر، هي إحدى السّور المكيّة، وعدد آياتها ثلاث آيات فقط، وتوجد في الجزء الثّلاثين من المصحف، وفيها يقول المولى U؛ بعد "بسم الله الرّحمن الرّحيم: (وَالْعَصْرِ (1) إِنَّ الْإِنْسَانَ لَفِي خُسْرٍ (2) إِلَّا الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ وَتَوَاصَوْا بِالْحَقِّ وَتَوَاصَوْا بِالصَّبْرِ (3))([2]). وفي هذه السّورة القصيرة، تكمن الكثير الكثير من المعاني التي تبرز منهج متكامل للحياة البشريّة، فيما فيها من مضامين تربويّة وأخلاقيّة، فهي تعلّم الإنسان أنّ النّجاة من النّار بالإيمان، وهي منهج متكامل من التّربية على النّهج السّليم، فقد قال فيها الإمام الشّافعي: "لو ما أنزل الله تعالى حجّة على خلقه إلّا هذه السّورة لكفتهم"، لما لها من فضلٍ، وما احتوت من علمٍ، على الرّغم من صغرها، فقد احتوت على معانٍ كثيرة من قيم ومبادئ وأهداف تدخل بحياة الإنسان من جميع النّواحي، ممّا يدفع فضول طلبة العلم البحث في ما تضمّنته هذه السّورة لمعرفة ما فيها من علمٍ، ومدى تأثيرها على المجتمع الإسلاميّ، ودراسة ما تضمّنته من مضامين تساهم بالنّهوض بالواقع التّربويّ.   ([1]) سورة آل عمران، الآية 110. ([2]) سورة العصر، الآية 1-3. تشهد السياسة الجزائية في السنوات الأخيرة، أزمة حقيقية نتيجة لتفاقم الظاهرة الإجرامية وتشعب صورها، ما أثر سلبا علي عمل جهاز العدالة والأجهزة التابعة لها، فمنه ما هو راجع للعقوبة في حد ذاتها التي لم تعد تؤدي أهدافها ومنه ما هو راجع لإجراءات ممارسة الدعوى العمومية، مما جعل جل الدول تبحث عن إجراءات بديلة للدعوى العمومية، تكفل سرعة الفصل في القضايا وتفك الخناق عن جهاز العدالة الذي يعاني من تضخم في نسب القضايا المعروضة، مما أثر في فعالية ونجاعة العمل القضائي الذي يهدف للحد من الظاهرة الإجرامية In recent years, the criminal policy has witnessed a real crisis as a result of the worsening of the phenomenon of crime and its various forms, which has had a negative impact on the functioning of the justice system and its affiliated institutions. Some of the issues are related to the punishment itself, which no longer achieves its objectives, and others are related to the procedures for practicing public prosecution. This has made most countries look for alternative procedures to the public lawsuit that ensure speedy resolution of cases and relieve the burden on the justice system, which suffers from an inflation in the number of cases presented, affecting the defectiveness and efficiency of the judicial work aimed at reducing crime.
