This research  aims  to study the critical rooting in contemporary historical writings,  by standing on the features of critical rooting at "Akram  Zia Al-Omari", after reading his historical writings in which Al-Omari tried to set an original critical approach, as he sought to establish a new vision in studying and writing Islamic history and dealing with Islamic heritage, in which he adopted a new critical approach to writing and verifying Islamic history, in order to apply the modernist approach in criticizing and scrutinizing historical narratives. Perhaps one of the most important tributaries of deriving verdicts from a disciplined legal perspective that is not subject to whims and tastes is the Maslahi Reasoning. As a result, our subject addressed the Maslahi Reasoning from a legal perspective, clarifying the necessary controls that preserve it from departing from the purpose decided by the Legislator, and standing on the truth of the intentions of those who claim to hold on to Maslaha under the pretext of modernization, armored with hidden purposes that lead to diluting the Maslahi Reasoning and discharge it from every constraint which protects it from dangerous slippages, which brought contemporary ijtihaad into an arena of intense conflict and wide controversy. The Almohad state appeared in the Islamic Maghreb during the sixth century AH, which was established by a religious movement. During this period, the Middle Maghreb witnessed a political and military stability, which led to a shift of focus on the cultural and scientific aspects and, thus, many sciences emerged and developed, most notably Sufism. For Muslims, Sufism is a religious, social, and psychological phenomenon that has emerged since the advent of Islam, because the Qur’an and the Sunnah are its main sources. Sufism, it must be noted, became gradually highly recognized in the Islamic societies such as Almohad community and led by many pioneering scholars in several Islamic regions and in Middle Mahreb. Despite the hostile relations that brought together the Caliphate State and the Byzantine Empire, the two countries represented a safe haven for many immigrant elements between the two parties, This paper examines the migration and asylum between the two states during the period from the establishment of the Islamic State until the fall of the Umayyad dynasty in the mid-eighth century. The motives of this phenomenon were multiple and in many cases intertwined and included in general the personal, political and religious raisons. The refugee elements among Muslims and the Byzantines were well received as they were treated with respect in aims to facilitate their integration into the new society, In general the movements of immigration and asylum end in most cases with the permanent residence in the new country, but other cases recorded the return of the refugee elements to their home country after reaching satisfactory arrangement with the authorities.
