The completion of this study requires extensive information gathering and research. In order to address the main research question effectively, this study will be relied on both analytical and critical methods. The focus of the analysis will be on the UN convention on contracts for the international sale of goods and its prospects for the concept of fundamental deprivation as an element of fundamental breach. This approach requires the assessment of both the positive and negative sides in this convention. However, some issues relating to the fundamental breach will not be discussed in this study, such as matters related to the avoidance. Finally, this topic has been subjected to development and codification by some scholars. Proponents of transitional justice assert that this justice is exercised in exceptional periods of people's history, particularly when traditional criminal justice is unable to achieve its objectives. Transitional justice can fill this deficit occurring in the national justice system, especially if the crimes committed were of a very general, systematic and serious nature. This would raise a specific question about the capacity of this transitional justice to be an alternative to traditional criminal justice in order to eliminate the violations that occurred in Libya for more than half a century. This question, in turn, leads us to another question that we consider more important, linked to the extent of possibilities, the success of transitional justice tools to achieve reconciliation in a country like Libya in light of the events that have occurred and are occurring. There is no doubt that electoral disputes are a reflection of the stages that the electoral process goes through. Therefore, the research sought to accurately understand electoral disputes and the appeals against them by analyzing the texts of Law No. 1 of 2021 AD regarding the election of the President of the State. Almaorahi, Abeer Date A point or period of time associated with an event in the lifecycle of the resource 2023-12-31 Description An account of the resource إن مصطلح التجريد والعمومية التي يتصف بها القانون يختلف مضمونة داخل فروع القانون الداخلي عنه في القانون الدولي, فإذا كانت القواعد الدولية تحمل هذه الصفة في إطارها النظري فإن هذه القواعد تتسم بالنسبية عند تطبيقه؛ إذ إن القواعد التي يتضمنها النظام القانوني الدولي ليست قواعد عامة، وإنما يختلف مضمونها ومداها وما تفرضه من التزامات أو تقرره من حقوق من حالة إلى أخري، فما تنظمه القواعد الدولية يتناسب مع طابع العلاقات الدولية, أي أن العلاقات بين أشخاص قانونية دولية متعددة ترنو إلى تحقيق أهداف تتعلق بالصالح العام للجماعة الدولية، وترتبط قواعد القانون الدولي بإرادة الدول، وتغليب الاعتبارات الموضوعية على الشكلية من أجل تمكين النظام الدولي من أداء وظائفه، حيث تتنوع القواعد الدولية في قيمتها بين القواعد القائمة حاليا والقواعد التي يؤمل الوصول إليها، مما يستدعي التنسيق بينها. وقد حاول ميثاق الأمم المتحدة فيما يتعلق بتنظيم عمل مجلس الأمن ايجاد التوازن المطلوب إلا أن هذه القواعد اتسمت بالغموض، مما جعلت وظيفة مجلس الامن غير مكتملة وهو ما حاولنا تسليط الضوء عليه في هذه الدراسة. The term generality that characterizes the law is different in terms of its content within the branches of domestic law than in international law. If international rules bear this characteristic in their theoretical framework, then these rules are characterized by relativity when applied. As the rules contained in the international legal system are not general rules, what is regulated by international rules is consistent with the nature of international relations, that is, the relations between multiple international legal persons aim to achieve goals related to the public interest of the international community. The United Nations Charter, attempted to find the required balance, but these rules were characterized by ambiguity and absolute generality, which made the function of the Security Council incomplete, which is what we tried to highlight in this study.
