تعتبر المعرفة اللغوية من المرتكزات الهامة التي تعتمد عليها العلوم الشرعية ، و من هنا لا يمكننا أن ندعو أنفسنا إلى التساؤل حول قيمتها في التشريع ، بل إننا نؤكد على أن المشرع لا يبني أحكامه إلا انطلاقا مما يمليه التعاقب اللغوي باعتباره المادة الملموسة التي يرتكز عليها
تهدف الدراسة الى التطرق لواقع الإفصاح المحاسبي في بيئة الأعمال الجزائرية، حيث تطرقت الدراسة للأسس النظرية الخاصة بالإفصاح المحاسبي ، بالإضافة الى متطلبات الإفصاح حسب النظام المحاسبي المالي الجزائري، وكذا متطلبات الإفصاح في الإطار المرجعي الدولي المتمثل في معايير الإبلاغ المالي الدولية، وتم خلال هذه الدراسة المقارنة بين الإفصاح في النظام المحاسبي المالي ومعايير الإبلاغ المالي الدولية، وتضمنت الدراسة عملية عرض لواقع الإفصاح المحاسبي في الجزائر من خلال دراسة الإفصاح المحاسبي في شركة رويبة الجزائرية. وخلصت هذه الدراسة لمجموعة من النتائج من بينها:
كون متطلبات الإفصاح المحاسبي حسب النظام المحاسبي المالي الجزائري لا تنطبق تماما مع متطلبات الإفصاح في معايير الإبلاغ المالي الدولية.
The study aims to address the reality of accounting disclosure in Algeria's business environment The study addressed the theoretical bases of accounting disclosure, as well as the requirements for disclosure according to Algeria's financial accounting system. and the disclosure requirements of the International Financial Reporting Standards (IFRS), this study also includes a comparison between the disclosure requirements in the financial accounting system IFRS standards, the study included a presentation of the reality of accounting disclosure in Algeria through the Algerian practices in the company Rouiba. The study produced a series of findings, including:

من المؤكد أن فكر التسامح كان الميزة الأساسية لدى المسلمين الأوائل المتشبعين بالتعاليم القرآنية و السنة النبوية ، لكن " التاريخ الآخر للإسلام " ، أي التاريخ الذي كتبهغير المسلمين ، و بخاصة النصارى ، ، العرب ، و الإغريق و اللاتنيين و بشيء أشكاله و إتجاهاته ، ظل لمدة قرون من الزمن يسجل صفحات داكنة نكاد نجهلها اليوم تماما.
ظهرت الصّحافة لأول مرة على أرض الجزائر مع الاحتلال الفرنسي سنة 1830م، حيث لم يعرف الجزائريون هذ الفنّ من قبل. ورغم ظهور وتطوّر الصحافة الاستعمارية الرسمية وصحافة المستوطنين، فإنّ الباب كان موصدا في وجه النخبة الجزائرية من أجل تكوين صحف خاصة بهم، ونظرا للانتشار الواسع للصحف في العالم العربي وخاصة المشرق، فقد كان هذا الأخير قبلة للجزائريين لممارسة لنشاطهم الصّحفي حيث ساهموا بأقلامهم في الكتابة عبر كبريات الصّحف العربية، كما أنشأوا صحفا خاصة بهم أينما هاجروا نظرا للمناخ الفكري الملائم والنهضة العربية
Journalism first appeared in Algeria during the French Colonization Era in 1830 A.D , the Algerians had never been familiar with that kind of art before. And despite the appearance and the evolution of the official colonial and colonialist journalism , doors were closed against Algerians as they were banned from establishing their own newspapers , and due to the wide spread of newspapers in the Arab World , and especially the Orient , this last was the refuge for the Algerians to practice their press activity as they contributed with their pens in writing in the biggest Arabic newspapers, they also established their own newspapers wherever they migrated thanks to the appropriate intellectual climate and the Arab Renaissance.

يعد الإيقاع خاصية من الخصائص التي يشترك فيها الخطاب الشعري ، و الخطاب النثري ، و إن كان يظهر قي الأول بدرجة أشد كثافة و هو يضفي على الخطاب الأدبي عموما ضربا من التنغيم
لقد سمحت تجربة المحاكمة عن بعد التي أقرها الأمر 20/04 للقضاء للقيام بواجباته المنوطة به، وهذا في إطار التدابير الاحترازية التي فرضتها جائحة كورونا للحفاظ على صحة السجناء وجميع العاملين في السلك القضائي.
لكن الملاحظ من خلال العمل بآلية المحاكمة عن بعد أنه أظهر بشكل جلي إشكالية جوهرية تنصب أساسا حول مدى ملائمة هذا الاجراء للضمانات الدستورية المتعلقة بالمحاكمة العادلة، وقانون الإجراءات الجزائية للشروط والاجراءات القانونية الواجبة لضمان حقوق المتهم الموضوع رهن الحبس المؤقت.
ومن ثم برزت الحاجة الملحة لدراسة هذه التجربة لإبراز دورها في حماية صحة السجناء والصحة العامة بصفة عامة هذا من جهة، وابراز سلبياتها واهدارها للضمانات الدستورية للمحاكمة العادلة من جهة أخرى.
The experience of the remote trial approved by order 20/04 has allowed the judiciary to carry out its duties, as part of the precautionary measures imposed by the Corona Pandemic to preserve the health of prisoners and all judicial personnel. However, by working on the remote trial mechanism, it has clearly shown a fundamental problem, mainly focused on the appropriateness of this procedure to constitutional guarantees relating to fair trial, and the Code of Criminal Procedure for due process and due process to guarantee the rights of the accused in temporary detention. There was therefore an urgent need to examine this experience to highlight its role in protecting the health of prisoners and public health in general, on the one hand, and to highlight its disadvantages and its waste of constitutional guarantees of fair trial on the other.

لقد ظهرت السلطات الإدارية المستقلة سنة 1990 في الجزائر بظهور أول سلطة وهي المجلس الأعلى للإعلام ، وتوالت بعدها السلطات الإدارية تباعا، وهذا نتيجة لتخلي الدولة عن النهج الاشتراكي وظهور مرحلة التعددية السياسية والإعلامية وفتح المجال أمام الخواص، ولقد نشأت قانونا سلطة ضبط الصحافة المكتوبة مطلع سنة2012 كسلطة إدارية مستقلة تتمتع بمجموعة من الصلاحيات المنوطة بها، لكن لا شك أن التعرض لهذه السلطة وجب الخوض في مجال الاستقلالية العضوية والوظيفة وحدودهما ، وكذا التعرض لأهم الصلاحيات التي رسمها لها القانون العضوي للإعلام12 - 05 والتي تتنوع وتتعدد حسب الحالة والظروف.

بدأت الدراسات العربية بداية متداخلة و " لما كان القرآن الكريم هو الحافز الأكبرلنشأة هذه الدراسات عموما كان من الطبيعي أن تنشأ مختلطة متداخلة ، و من الطبيعي أيضا أن يكون أوائل المتصدين لهذه الدراسات ذوي اختصاصات متعددة
تهدف هذه المداخلة إلى محاولة رصد التطور الذي مرت به الصحافة ذات الاتجاه الإصلاحي في الجزائر منذ بداياتها وإلى غاية قيام الثورة التحريرية ، وانطلاقا من هذا جاءت هذه الورقة البحثية لتجيب على التساؤل التالي : كيف تطور الاتجاه الإصلاحي في الصحافة الجزائرية ما بين 1908_1954 م ؟ . وأهم ما توصلنا إليه أن الصحافة الإصلاحية في الجزائر مرت بخمس مراحل أساسية ، المرحلة الأولى هي مرحلة البدايات مع الرواد الأوائل ، والمرحلة الثانية هي مرحلة الشباب المثقف العائد من المشرق ، والمرحلة الثالثة هي مرحلة العمل الموحد تحت مظلة جمعية العلماء المسلمين ، والمرحلة الرابعة هي مرحلة دخول المعترك السياسي ، وأما المرحلة الخامسة والأخيرة هي مرحلة الشباب الإصلاحي .
The aim of this intervention is to monitor the development of the reform-oriented press in Algeria from its inception until the founding of the editorial revolution. Based on this , this research came to answer the fallowing question : How did the reformist trend develop in the Algerian press between 1908_1954 AD ? . Most importantly, Algeria's reform press has gone through five basic stages. The first is about beginnings with the first pioneers , the second is the stage of educated youth returning from the east , the third one is a stage of unified work under the leadership of association of Oulama , the fourth stage is about entering the political fray , while the last is reformist youth .

يُشكٍّلُ العقار الوقفي أحد الآليات الفاعلة التي أثبتت مساهمتها في دفع عجلة التنمية الاقتصادية لاسيما في ظل الانفتاح الاقتصادي الذي رافقه فتح المجال واسعا أمام الاستثمار الوطني والأجني باعتباره أداة لتنمية وتثمين الأملاك الوقفية وضمانة للمحافظة على ديمومتها وحركيتها بما يعود بالنَّفع على الفرد والمجتمع.
وقد أولى المشرع الجزائري مؤخرا أهمية قُصوى للاستثمار في هذا النوَّع من الأملاك الوقفية من خلال تطوير البنية التشريعية المؤطرة لعملية استغلالها لاسيما تلك الموجهة منها لإنجاز مشاريع اقتصادية سعيا منه لتحقيق التنمية الاقتصادية واستقطاب اليد العاملة تزامنا مع الأوضاع الرَّاهنة التي تشهد تزايُدا على سوق العمل ، وهو ما جسَّده المرسوم التنفيذي رقم 18/213 الذي عُدَّ منعرجا حاسما في تجسيد البعد الاستراتيجي لاستغلال العقارات الوقفية العامَّة الموجهة لإنجاز مشاريع استثمارية.
انطلاقا من هذا الطرح تهدِف هذه الورقة البحثية إلى تقييم مدى مساهمة استثمار العقارات الوقفية الموجهة لإنجاز مشاريع استثمارية في تثمين الأملاك الوقفية وتنميتها .
The endowment real estate is considered as one of the most active mechanisms that has proved its contributions in the economic developement mainly in the light of economic openess which accompanied the vast national and foriegn investement which are considered as tools of development and the valuation of endowment properties through the development of the ligislative operation of endowment and its garantee for the sake of the preservation of its permanence and mobility for the benifit of the individual and the society as well .
The algerian lisgislator has recently been aware about the importance of the investement in this type of properties through the development of the ligislative structure which conducts its exploitation mainly those which are oriented to for the of achievement of the economic projects for the sake of the development and the attraction of the handlabour conciding with the recent circumstances .which is embodied by the executive decree number : 18/213 tha is considered as a crucial changing point in the imbodiment of the strategic dimensions of general endowment meant for the achievement of invested projects .
Based on this proposal, this research paper aims to assess the extent to which the investment of waqf properties directed at the completion of investment projects contributes to the valuation and development of waqf properties

إن من أهم رواسب الفلسفات السابقة سواء الحديثة أو المعاصرة ، مشكلة الوجود في العالم ، و هي المشكلة التى حاولت فينو مينولوجيا ميرلوبونتي ، حلها فكانت نقطة الانطلاق هي إزالة ذلك الخط الفاصل الذي وضعه ديكارت بين الوعي و العالم من خلال رفضه الأخذ بما هو محسوس أو ماله علاقة بالجسد
يتمتع الوقف بالشَّخصية المعنوية والاستقلال المالي، ويترتب عن ذلك ثبوت الأهلية الكاملة له في حدود عقد إنشائه، فله حق التصرف والتعاقد مع أي طرف، شأنه في ذلك شأن أي شخص معنوي آخر، لذا قد يتعرض الوقف لحالة الغبن أو الاستغلال، سواء بتواطؤ الناظر و الطرف المتعاقد معه أو من أحدهما أو من أي جهة كانت، لذا كان لا بد من مراقبة هذه العقود لحماية الوقف من النهب والسرقة.
فعقود الوقف تتشابه إلى حد كبير مع العقود الإدارية الصادرة عن الإدارة، وذلك بحكم أن الهيئة المشرفة عليه هي إدارة عمومية من أشخاص القانون العام، لذا كان لزاما تحديد طبيعة عقود الوقف من حيث أنها عقود مدنية أو عقود إدارية، وذلك من أجل تحديد جهة الاختصاص القضائي.
فهي عقود مدنية، على اعتبار أن مؤسسة الوقف تتمتع بالشخصية المعنوية وبالذمة المالية المستقلة عن ذمة مسيِّريه، فهو في نظر القانون من أشخاص القانون الخاص، لذا فالقاضي المدني هو صاحب النظر فيها وما ينشأ عنها من نزاعات.
و يهدف هذا البحث إلى معرفة مدى صلاحيات القاضي المدني في مراقبة عقود الوقف، وكان من نتائجه؛ أن القاضي المدني ليس له السلطة المباشرة في الرقابة إلا بعد طلب من أصحاب المصلحة في ذلك، و يمكن له إبطال أو تعديل العقود الذي قد يكون تعديلا تشريعيا بموجب نصوص تشريعية عامة كالقانون المدني أو خاصة المتعلقة بالأوقاف، أو يكون تعديلا قضائيا بموجب السلطة التقديرية المخولة للقاضي بنصوص صريحة.
The endowment enjoys moral personality and financial independence, and this results in proving its full capacity within the limits of its establishment contract. Therefore, it was necessary to monitor these contracts to protect the endowment from looting and theft.
Endowment contracts are very similar to administrative contracts issued by the administration, due to the fact that the body supervising it is a public administration of public law persons, so it was necessary to determine the nature of endowment contracts in terms of civil contracts or administrative contracts, in order to determine the jurisdiction .
They are civil contracts, given that the endowment institution enjoys a legal personality and financial liability independent of its managers. In the eyes of the law, it is a private law person, so the civil judge is the one who considers it and the disputes arising from it.
This research aims to know the extent of the civil judge's powers in monitoring endowment contracts. That the civil judge does not have the direct authority in oversight except after a request from the stakeholders in that, and he can invalidate or amend contracts, which may be a legislative amendment under general legislative texts such as civil or private law related to endowments, or it is a judicial amendment under the discretionary power granted to the judge with explicit texts.

إن فكرة انحطاط الحضارة الإسلامية ليست بالجديدة ، فقد تطرق إليها العلامة ابن خلدون في كتابه العمران و لاحظ ما أصاب العالم الإسلامي بعد تراجع العصبية العربية و وصول القيادات القبلية الممثلة في الأتراك و البربر إلى قيادة الأمة الإسلامية
رغم النص على تحريم التبني شرعا وقانونا في العديد من الدول الإسلامية، إلا أننا نجد البعض منها أقرت صحته وترتيب آثاره في بعد القانون الدولي الخاص، وذلك تحسبا لوجود العنصر الأجنبي المقيم في إقليمها، كما فعل المشرع الجزائري من خلال المادة 13 مكرر 1 من القانون المدني الجزائري، وعليه بات من الممكن اللجوء إلى القاضي الجزائري للوقوف على صحة العلاقة عند المنازعة بشأنها، وصار بإمكان ذوي المصلحة التمسك بآثار هذه العلاقة أمامه.
وإزاء هذا الموقف الغريب من المشرع الجزائري برزت إشكالية الدفع بالنظام العام في مسألة التبني سواء في الإقرار بصحته أو ترتيب آثاره، خاصة إذا علمنا أن التشريع الداخلي لدولة القاضي حرم التبني شرعا وقانونا من خلال المادة 46 من قانون الأسرة الجزائري، ومن جهة أخرى حتى ولو فرضنا ان العلاقة نشأت صحيحة في بلدها المقر بها فالأكيد أنه يترتب عليها آثار وحقوق، وهنا تطرح فكرة الحقوق المكتسبة الواجبة الاعتبار في بُعد القانون الدولي الخاص، لكن من شأن هاته الحقوق المساس بمبادئ المجتمع كموانع الزواج والإرث والنفقة فما مصير فكرة الدفع بالنظام العام في مسألة التبني عموما؟
Despite the text prohibiting adoption in many Islamic countries, we find that some of them have been validated in private international law, as the Algerian legislator did through Article 13 bis 1 of the Civil Code. Accordingly, stakeholders can adhere to the effects of this relationship before the Algerian judge. The strange position of the Algerian legislator The problem of pushing public order in the matter of adoption arose, especially since he prohibited adoption through Article 46 of the Algerian Family Code. Here the idea of acquired rights is raised in the dimension of private international law, which affects the principles of society, so what is the fate of the idea of pushing public order in the issue of adoption generally?

هذا البحث عبارة عن دراسة مفصلة حول العقود الذكية، التي تمثل تحولًا من اللغة العادية إلى لغة الأكواد، من حيث: (التعريف، الأركان، الشروط، وصولا إلى الحكم)؛ ذلك لأن الفتوى تتغير بتغير الظروف، والأحوال، والأشخاص، وبما أن الشريعة المحمدية صالحة لكل زمان ومكان، كان لزاما على الباحثين في الفقه الإسلامي أن يتصدوا لهذا التطور، الحاصل في مسألة خطيرة من مسائل الفقه، ألا وهي مسألة العقود، ومن بين تلكم الجهود هذا البحث، الذي يركز على الشروط، ومن ثم إسقاطها على هذا النوع من العقود؛ لمعرفة حكم الشرع.
This paper is a detailed study on smart contracts, which represent a transition from normal language to code language (in terms of definition, pillars, conditions, up to judgment); This is because the fatwa changes due to the change of circumstances, conditions and persons, since Islamic sharia is valid for all times and places, it is of great importance for researchers in Islamic fikeh to counter this development as a serious issue of fikeh; which is the contracts issue.
This research is among those efforts, which focuses on conditions, and then dropping them on this type of contracts to know the Islamic judgment.
