The South Tunisian troglodyte architecture is one of the precious and representative heritage in South Mediterranean area. It represents a result of human creative genius,using local natural resources for surviving in an extreme environment. In 2020, this architecture was been included into the Unesco World Heritage Tentative List. Despite this, South Tunisian Troglodyte dwellings are abandoned. Few of their inhabitantsare still living in their surroundings. Only few caves of these troglodytes were folklorically restored for touristic visits. Although, this cultural heritage has remained relatively safe from human degradation and damage for a long time, today it is increasingly exposed to multiple threats that seriously affect it (Khannoussi 2009). The current publication is intended to be an effective contribution to the state of art, to the safeguarding, the valorization and the sustainable development of troglodyte sites, and to the preparation of the nomination file of this architectural heritage for its inscription into the Word Heritage List of Unesco ( WHL). Compte tenu de la reconnaissance actuelle de l'importance de l'architecture vernaculaire qui garantit l'efficacité énergétique et le respect de l'environnement, le patrimoine architectural troglodytique, qui a longtemps été considéré comme une architecture d'habitation inadaptée, présente en réalité des qualités écologiques et des propriétés architecturales et culturelles intéressantes. L'architecture troglodyte du sud tunisien est l'un des patrimoines les plus précieux et les plus représentatifs du sud de la Méditerranée. Elle représente le résultat du génie créatif de l'homme, en utilisant les ressources naturelles locales pour survivre dans un environnement extrême. En 2020, cette architecture a été inscrite sur la liste indicative du patrimoine mondial de l'Unesco. Malgré cela, les habitations troglodytiques du sud tunisien sont abandonnées. Peu de leurs habitants vivent encore dans les environs. Seules quelques grottes de ces troglodytes ont été restaurées de manière folklorique pour des visites touristiques. Bien que ce patrimoine culturel soit resté relativement à l'abri des dégradations humaines pendant longtemps, il est aujourd'hui de plus en plus exposé à de multiples menaces qui l'affectent gravement (Khannoussi 2009). La présente publication se veut une contribution efficace à l'état de l'art, à la sauvegarde, à la valorisation et au développement durable des sites troglodytiques, et à la préparation du dossier de nomination de ce patrimoine architectural pour son inscription sur la Liste du patrimoine mondial de l'Unesco (LPM). تهدف الدراسة الى التطرق لواقع الإفصاح المحاسبي في بيئة الأعمال الجزائرية، حيث تطرقت الدراسة للأسس النظرية الخاصة بالإفصاح المحاسبي ، بالإضافة الى متطلبات الإفصاح حسب النظام المحاسبي المالي الجزائري، وكذا متطلبات الإفصاح في الإطار المرجعي الدولي المتمثل في معايير الإبلاغ المالي الدولية، وتم خلال هذه الدراسة المقارنة بين الإفصاح في النظام المحاسبي المالي ومعايير الإبلاغ المالي الدولية، وتضمنت الدراسة عملية عرض لواقع الإفصاح المحاسبي في الجزائر من خلال دراسة الإفصاح المحاسبي في شركة رويبة الجزائرية. وخلصت هذه الدراسة لمجموعة من النتائج من بينها:  كون متطلبات الإفصاح المحاسبي حسب النظام المحاسبي المالي الجزائري لا تنطبق تماما مع متطلبات الإفصاح في معايير الإبلاغ المالي الدولية. The objective of this research is to contribute to the creation of a specific experience to visitors. To carry out this work, we have adopted an analytical approach. Using experience design, we have conducted a site observation followed by a survey whose purpose is to analyze the visit of a group of experiencers in order to assess the level of their satisfaction. Based on the results obtained, this research proposes the use of the new technology, specifically the augmented reality, as a catalyst to amplify the level of satisfaction of experiencers. It is through experience design and through the integration of new non-destructive technology that the archaeological site of Sbeïtla can be both valorised and preserved. Cet article présente un parcours de recherche intéressant la valorisation du site archéologique de Sbeïtla (Tunisie) par l’outil de design d’expérience. L'objectif de cette recherche est de contribuer à la création d'une expérience spécifique aux visiteurs expérienceurs. Pour mener à bien ce travail, nous avons adopté une démarche analytique. A l'aide de design d'expérience, nous avons mené une observation suivie d’une enquête sur site dont le but est d’analyser la visite d’un groupe d’expérienceurs afin d’évaluer le niveau de leur satisfaction. A partir des résultats obtenus, cette recherche propose l’utilisation de la nouvelle technologue, plus précisément la réalité augmentée, comme catalyseur pour amplifier le niveau de satisfaction des visiteurs. C'est à l’intermédiaire du design d’expérience et à travers l’intégration de cette nouvelle technologie non destructive que le site archéologique de Sbeïtla pourra être, à la fois, valorisé et conservé.         لقد سمحت تجربة المحاكمة عن بعد التي أقرها الأمر 20/04 للقضاء للقيام بواجباته المنوطة به، وهذا في إطار التدابير الاحترازية التي فرضتها جائحة كورونا للحفاظ على صحة السجناء وجميع العاملين في السلك القضائي.   لكن الملاحظ من خلال العمل بآلية المحاكمة عن بعد أنه أظهر بشكل جلي إشكالية جوهرية تنصب أساسا حول مدى ملائمة هذا الاجراء للضمانات الدستورية المتعلقة بالمحاكمة العادلة، وقانون الإجراءات الجزائية للشروط والاجراءات القانونية الواجبة لضمان حقوق المتهم الموضوع رهن الحبس المؤقت. ومن ثم برزت الحاجة الملحة لدراسة هذه التجربة لإبراز دورها في حماية صحة السجناء والصحة العامة بصفة عامة هذا من جهة، وابراز سلبياتها واهدارها للضمانات الدستورية للمحاكمة العادلة من جهة أخرى.          The experience of the remote trial approved by order 20/04 has allowed the judiciary to carry out its duties, as part of the precautionary measures imposed by the Corona Pandemic to preserve the health of prisoners and all judicial personnel.    However, by working on the remote trial mechanism, it has clearly shown a fundamental problem, mainly focused on the appropriateness of this procedure to constitutional guarantees relating to fair trial, and the Code of Criminal Procedure for due process and due process to guarantee the rights of the accused in temporary detention.  There was therefore an urgent need to examine this experience to highlight its role in protecting the health of prisoners and public health in general, on the one hand, and to highlight its disadvantages and its waste of constitutional guarantees of fair trial on the other. The country is facing continuous urbanisation of coastal areas and growth of some major cities, especially the capital. Contrary to the vetted plans, alluring 3D images and virtual animations approved and shown in the media, the implementation process looks quite fuzzy and faces many challenges. Some of the launched New Towns are lagging behind schedule and are being converted into mass housing only programmes. Others are temporarily on hold. The aim of the study is to assess current planning practises in the light of global experience. The extensive literature review provides key principles that help to validate these experiences. Based on this , this research came to answer the fallowing question : How did the reformist trend develop in the Algerian press between 1908_1954 AD ? . For this, three Landsat satellite images dating from 1990, 2003, and 2015 were used.  These data are processed by the supervised classification to produce multi-date maps illustrating the Spatio-temporal dynamics of eight classes, namely: the urban, the olive groves, the gardens, the irrigated plots, the seasonal brackish marshes (sabkha), salines, and phosphogypsum.  The classification accuracy was assessed quantitatively by using the kappa index (> 0.7) through the confusion matrix. The result analysis showed that the urban growth by 18% against the decline of 20 of agricultural land. L’étude de la dynamique de l’occupation du sol est d’une importance primordiale pour le suivie et la gestion d’un territoire. C’est dans ce contexte que cette étude a été menée dans le but d’évaluer l’impact de l’évolution de l’urbain sur la diversité de l’occupation du sol dans le grand Sfax au centre-est de la Tunisie. Pour cela trois images satellitaires Landsat datant de 1990, 2003 et 2015 ont été utilisées. Ces données sont traitées par la classification supervisée pour la production des cartes multi-dates illustrant la dynamique spatio-temporelle de huit classes à savoir : l’urbain, les champs d’olivier, les jardins, les parcelles irriguées, les marais saumâtres saisonniers (sebkha), les salines et le phosphogypse. La précision de classification a été évalué quantitativement à l’aide de l’indice de kappa (>0,7) à travers la matrice de confusion.  L’analyse du résultat a permis de mettre en évidence la croissance de l’urbanisme par 18% contre la régression de 20 de terres agricoles.         يُشكٍّلُ العقار الوقفي أحد الآليات الفاعلة التي أثبتت مساهمتها في دفع عجلة التنمية الاقتصادية لاسيما    في ظل الانفتاح الاقتصادي الذي رافقه فتح المجال واسعا أمام الاستثمار الوطني والأجني باعتباره أداة لتنمية وتثمين الأملاك الوقفية وضمانة للمحافظة على ديمومتها وحركيتها بما يعود بالنَّفع على الفرد والمجتمع. وقد أولى المشرع الجزائري مؤخرا أهمية قُصوى للاستثمار في هذا النوَّع من الأملاك الوقفية من خلال تطوير البنية التشريعية المؤطرة لعملية استغلالها لاسيما تلك الموجهة منها لإنجاز مشاريع اقتصادية سعيا منه لتحقيق التنمية الاقتصادية واستقطاب اليد العاملة تزامنا مع الأوضاع الرَّاهنة التي تشهد تزايُدا على سوق العمل ، وهو ما جسَّده المرسوم التنفيذي رقم 18/213 الذي عُدَّ منعرجا حاسما في تجسيد البعد الاستراتيجي لاستغلال العقارات الوقفية العامَّة الموجهة لإنجاز مشاريع استثمارية. انطلاقا من هذا الطرح تهدِف هذه الورقة البحثية إلى تقييم مدى مساهمة استثمار العقارات الوقفية الموجهة لإنجاز مشاريع استثمارية في تثمين الأملاك الوقفية وتنميتها . The endowment real estate is considered as one of the most active mechanisms that has proved its contributions in the economic developement mainly in the light of economic openess which accompanied the vast national and foriegn investement which are considered as tools of development and the valuation of endowment properties through the development of the ligislative operation of endowment and its garantee for the sake of the preservation of its permanence and mobility for the benifit of the individual and the society as well . The forms of pollution as well as the degradation of oasis and agricultural lands, encourage us to think of the city differently. This is through the landscaping where the different characteristics of the site; urban constraints; and climatic specificities would be taken into account. To do this, the study proposes a landscape approach as a paradigm for developing the city’s green spaces, including creating a linear landscape course located in a new urban center of the city of Tozeur. The methodology adopted is based on developing a landscape assessment followed by a development proposal using design, modeling, and mapping software. According to this study, anthropogenic pollution, anarchic urbanization and environmental problems threaten the living environment of the inhabitants. The proposed linear landscaping would help the localities in question to reduce the effect of the various problems that the city faces. The results made it possible to highlight the role of such landscaping in the Saharan regions and to underline the importance of this project and the opportunities it will offer to boost Saharan tourism in the country's south and enhance the image of the Tunisian Sahara. La ville de Tozeur (sud-ouest Tunisien) est parmi les zones les plus touchées par une forte anthropisation et des problèmes environnementaux. Les formes de pollutions ainsi que la dégradation des oasis et des terres agricoles, incitent à penser la ville autrement. Ceci à travers l’aménagement paysager où les différentes caractéristiques du site ; les contraintes urbanistiques et les spécificités climatiques seraient prises en compte. Pour ce faire, cette étude propose une approche paysagère comme paradigme de développement des espaces verts de la ville, notamment la création d’un parcours paysager linéaire situé dans un nouveau pôle urbain de la ville de Tozeur. La méthodologie adoptée est basée sur l’élaboration d’un diagnostic paysager suivi d’une proposition d’aménagement en utilisant des logiciels de conception, de modélisation et de cartographie. D’après cette étude, la pollution anthropique, l’urbanisation anarchique et les problèmes environnementaux menacent le cadre de vie des habitants. L’aménagement paysager linéaire proposé aiderait les localités en question à diminuer l’effet des différents problèmes que la ville fait face. Les résultats ont permis de mettre en valeur le rôle d’un tel aménagement paysager dans les régions sahariennes et souligner l’importance de ce projet et les opportunités qu’il offrira pour dynamiser le tourisme saharien du sud du pays et revaloriser l’image du Sahara tunisien. يتمتع  الوقف بالشَّخصية المعنوية والاستقلال المالي، ويترتب عن ذلك ثبوت الأهلية الكاملة له في حدود عقد إنشائه، فله حق التصرف والتعاقد مع أي طرف، شأنه في ذلك شأن أي شخص معنوي آخر، لذا قد يتعرض الوقف لحالة الغبن أو الاستغلال، سواء بتواطؤ الناظر و الطرف المتعاقد معه أو من أحدهما أو من أي جهة كانت، لذا كان لا بد من مراقبة هذه العقود لحماية الوقف من النهب والسرقة.  فعقود الوقف تتشابه إلى حد كبير مع العقود الإدارية الصادرة عن الإدارة، وذلك بحكم أن الهيئة المشرفة عليه هي إدارة عمومية من أشخاص القانون العام، لذا كان لزاما تحديد طبيعة عقود الوقف من حيث أنها عقود مدنية أو عقود إدارية، وذلك من أجل تحديد جهة الاختصاص القضائي. فهي عقود مدنية، على اعتبار أن مؤسسة الوقف تتمتع بالشخصية المعنوية وبالذمة المالية المستقلة عن ذمة مسيِّريه، فهو في نظر القانون من أشخاص القانون الخاص، لذا فالقاضي المدني هو صاحب النظر فيها وما ينشأ عنها من نزاعات.  و يهدف هذا البحث إلى معرفة مدى صلاحيات القاضي المدني في مراقبة عقود الوقف، وكان من نتائجه؛ أن القاضي المدني ليس له السلطة المباشرة في الرقابة إلا بعد طلب من أصحاب المصلحة في ذلك، و يمكن له إبطال أو تعديل العقود الذي قد يكون تعديلا تشريعيا بموجب نصوص تشريعية عامة كالقانون المدني أو خاصة المتعلقة بالأوقاف، أو يكون تعديلا قضائيا بموجب السلطة التقديرية المخولة للقاضي بنصوص صريحة. The endowment enjoys moral personality and financial independence, and this results in proving its full capacity within the limits of its establishment contract. Therefore, it was necessary to monitor these contracts to protect the endowment from looting and theft. Endowment contracts are very similar to administrative contracts issued by the administration, due to the fact that the body supervising it is a public administration of public law persons, so it was necessary to determine the nature of endowment contracts in terms of civil contracts or administrative contracts, in order to determine the jurisdiction .  They are civil contracts, given that the endowment institution enjoys a legal personality and financial liability independent of its managers. In the eyes of the law, it is a private law person, so the civil judge is the one who considers it and the disputes arising from it.  This research aims to know the extent of the civil judge's powers in monitoring endowment contracts. That the civil judge does not have the direct authority in oversight except after a request from the stakeholders in that, and he can invalidate or amend contracts, which may be a legislative amendment under general legislative texts such as civil or private law related to endowments, or it is a judicial amendment under the discretionary power granted to the judge with explicit texts.
