إن حياة الشيخ الحفناوي بن الشيخ تمثل أحد النماذج النادرة للمثقف الجزائري الريفي في العهد الاستعماري من عدة وجوه ، و منها تواضع أهل الريف و استغلال السلطات الاستعمارية لهم ، بما يخدم مصالحها و مشاريعها ، و رغم كل ماتمتلكه هذا الشخصية من ملامح النبوغ و التميز ، و رغم كل العطاء الذي قدمته على المستوى التعليميأو الصحفب أو الادبي أو الديني أو الإجتماعي ....
إن الملاحظ أن قانون الأسرة الجزائري وخاصة تعديل 2005م ركز على النصوص التي تعطي حقوقا أكبر للمرأة، وتجعلها عنصرا فاعلا في المجتمع بعيدا عن العبودية الاجتماعية التي كرستها بعض الأعراف والعادات البالية المخالفة للشرع ولكنها مع الأسف نسبت إليه، ومن ثم أصبح الشرع في نظر المدافعين عن حقوق المرأة في هذا الزمن متهما بالرجعية والتخلف والحجر على المرأة، وما هذا في الحقيقة إلا محض افتراء على الدين الإسلامي، وهذا ما يظهر بوضوح في جملة الحقوق التي كرسها الإسلام للمرأة في جميع الميادين ومن بينهما الحقوق المالية التي منحت لها وكذا ما تتمتع به من أهلية التصرف في هذه الأموال مثلها مثل الرجل؛ وهذا ما دفعني إلى التركيز على هذه النقطة والمتمثلة في الحديث عن الحقوق المالية للزوجة في الفقه الإسلامي مقارنا بقانون الأسرة الجزائري. فما هي هذه الحقوق يا ترى؟
وقد حاولت الدراسة الإجابة عن الإشكالية من خلال العناصر الآتية: أولا: مكانة المرأة في الإسلام، ثانيا: حق الزوجة في الصداق، ثالثا: حق الزوجة في المتعة والنفقة، رابعا: حق الزوجة في أجرة الرضاع والحضانة، وأخيرا: حق الزوجة في السكن والميراث.
وقد توصلت الدراسة إلى مجموعة من النتائج، أهمها: أن الشارع الحكيم منح المرأة حقوقا مالية واسعة، وأطلق يدها في التصرف فيها كما تشاء دون وصاية من أحد سواء كان أبا أم زوجا، وهذا ما يوضح أن الإسلام كرم المرأة وأعطاها من الحقوق ما يكفل لها العيش بكرامة وأمان.
كما أن المشرع الجزائري في قانون الأسرة وضح هذه الحقوق المالية للزوجة، إلا أنه مازال منقوصا بعدد لا بأس به من المواد التي تنظم هذا النوع من الحقوق للزوجة خاصة ما تعلق بالمتعة، وأجرة الرضاعة والحضانة.
It is noticeable that the Algerian family law and the amendment of 2005 focuced on the texts that give more rights to women and make of them an active element in society far from social slavery which enshrined by some outdated customs and habits against islamic legislation but unfortunatly attributed to it consequently, Islam has become in the eyes of women’s rights defenders accused of reverse racism and backwardness but, this is in fact a pure slur on the Islamic religion and this is what clearly appears in the rights enshrined in Islam for women in all fields, including the financial rights granted to them as well as the capacity to act in the money like a man. This is what prompted me to focus on this point of talking about the financial rights of the wife in Islam in comparison to the Algerian Family law, so what are these rights ?
The study tried to answer the problem through the following elements :
First, the status of women in Islam . second, wife’s right in dowry . third, wife’s right to breastfeeding and nursery fare and finally the wife’s right in housing and inheritance.
The study found a range of results . it show’s that islam grant women wide financial rights and give them full freedom to dispose on these rights as they wish without guardianship of one, whether a father or a husband. And this what explains that islam honored women and gave them rights that ensures them to live in dignity and safety.

غن المداخلة الموالية للدكتور سميث في غنى عن شرح لقد عثر على البردية لدى الباعة بحي خان الخليل بالقاهرة سنة 1959 من قبل الدكتور سميث الذي أسعارها من البائع و حملها غلى صديقه الدكتور محمد مصطفى مدير متحف القاهرة للفنون الإسلامية ، فاكتشف لتوه انها وثيقة قديمة و نادرة ، و شاطره في هذا الرأي السيد احمد .م.حمدي محافظ الكتب العربية و مسؤول بالمتحف الذكور و لما علم الدكتور سميث بحاجة المتحف إلى تلك البردية لإضافتها إلى مكتبة ، اقترح أن يقوم هو بشرائها و تكون هدية منه لمكتبةالمتحف ، و لكنه طلب في مقابل ذلك أن يكون له شرف غهدائها لأستاذه و هو كاتب هذا البحث لكي يدرسها و ينشرها فقبل فقبل الدكتور مصطفى منه ذلك و إثر ذلك أرسلت البردية إلى السفارة الأمريكية بالقاهرة لتقديمها لحكومة الجمهورية العربية المتحدة بإسم المركز الأمريكي للبحث بمصر الذي يعتبرالدكتور سميث أمينا له.
يدرس هذا المقال موضوع التعويض عن أضرار الارتفاقات الإدارية. في مجال المواصلات السلكية واللاسلكية .وذلك في إطار القانون رقم 2000/03 المؤرخ في 05 / 08 / 2000. المحدد للقواعد العامة المتعلقة بالبريد والمواصلات السلكية واللاسلكية.
إن هذا المقال يهدف إلى تحديد مدى فعالية التشريع الجزائري. في مجال التعويض والمنازعات المتعلقة بأضراره. والناجمة عن ارتفاقات المواصلات السلكية واللاسلكية. والغرض من ذلك هو محاولة التوصل إلى تعميم حق التعويض على كافة الأضرار. وتحديد بدقة ووضوح الجهة القضائية المختصة بالفصل في هذا النوع من النزاعات.
C’et article traite l’indemnisation des dommages causés par les servitudes administratives des télécommunications. dans le cadre de la loi n/2000/03. Du 05/08/2000. Fixant les règles générales relatives a la poste et aux télécommunications.
Elles visent a déterminer l’efficacité de la législation algérienne qui gère l’indemnisation et le contentieux des servitudes administratives des télécommunications.
La généralisation de l’indemnisation et la détermination avec précision de la juridiction compétente en la matière ; c’est l’objectif de cet étude.

منذ بدايات الاحتلال حاربت السلطات الاستعمارية الدين الإسلامي في جميع رموزه بكل ضراوة ، و لم تسمح إلا للإيكليروس الرسمي الإسلام الذي صنعته بالمساجد الكبرى لخدمة مصالحها ، فلم يكن له تأثير ديني و معنوي على الأهالي كما تمكنت السلطات من تدجين الطرق و الزوايا
تقوم إشكالية هذا البحث على التحقيق في حكم تولي المرأة القضاء في المذهب الحنفي، وذلك بالرجوع إلى مصادر فقهاء الحنفية المعتمدة، واستقراء أقوالهم في المسألة. ولا تنعدم فائدة الخوض في هذه المسألة؛ تأسيسا على ما اشتهر عن الحنفية بإجازتهم قضاء المرأة في غير الحدود والقصاص؛ لأن ثمة ما يثير التساؤل وفحواه: هل جواز القضاء يفيد جواز التولية؟ وهذا ما سأتناوله بالتحليل في هذه الدراسة.
The problem analysis of this research-paper stands on the detection in the rule allowing the woman to be a judge according to the Hannifin’s rite, by referring to the approved Hannifin jurisprudents’ sources, and the induction of their speeches about the question. And the latter is of great interest for the Hannifin’s famous establishment of allowance for woman to be a judge; except, in the matters of restrains and sanction; because, there are a disputable question including: whether the allowance of judgment implies the allowance of the governance? And that is what we shall deal with it by analysis in this study.

من أبرز سمات الخطاب الصوفي أنه يتخذ من اللغة المتواضعة عليها مادة بنائه ، غير أنه يعمد إلى تحويل النظام اللغوي إلى علامات سميوطيقية ، و هذا التحول الدلالي في ارتقاء باللغة من مجال المواضعة إلى مجال أرحب هو المجال السميوطيقي
إن الحقوق السياسية هي ما تمنحه الدولة للأفراد من حقوقٍ ذاتِ صلة شخصية بهم ضمن المصلحة العامة، وتتمثل في حق المواطن في الاشتراك في إدارة الدولة، بحيث يكون اشتراكُه مباشراً عن طريق تولّيه أحدَ المناصب التنفيذية في الدولة، أو غير مباشر عن طريق ممثلين عنه هم أعضاء المجالس المنتخبة.
وتعدّ المرأة شريكاً أساسياً في تحقيق أهداف التنمية وتطوير المجتمع، ولأجل ذلك فقد ناقش العلماءُ مسألة تمتّعها بالحقوقِ السياسية منذ وقتٍ مبكر، وأخصّ بالذكر حقّها في الانتخاب والترشيح وتولّيها المناصب والوظائف العامة، وهو ما سيكون محل الدراسة في هذا البحث، حيث سيركّز في إشكاليته الرئيسية على الحقوق التي تمتعت بها المرأة في ظل الحكم الإسلامي ، مع محاولة الإجابة على بعض الأسئلة التي توصل إلى نتائج البحث.
The political rights that any state allots to individuals are those rights that relate to their personalities amongst general interests characteriesed by the actual participation of the citizens in governing throughout holding executive posts in the govrment, or by being indirectly represented by elected members in differents assemblies.
The women is considered an essential partner to realise the development of society. For such a purpose scholars dealt with the issue of her political rights very early. Here ,I mean her rights to vote and being elected to occupy poialitical and social posts .The present study emphasizes the rights the woman enjoined in the light of Islamic rule, and tries to answer the questions the research attained.

الشعر السياسي العربي مجال خصب ، أبدع فيه الشعراء بالتأثير في دواليب الحكم ، و تحريك أطراف السلطة . بفظل تأثيرة في نفوس المستمعين ، و كثيرا ما وصفت الجزائر في العهد العثماني بالتخلف و الجمود و غياب الثقافة و ضعف الأدب و الفنةن لإنشغال الناس بالحروب و النزاعات
تعد جريمة العدوان أو الحرب العدوانية من بين أهم الجرائم الدولية في القانون الدولي الجنائي، غير أنه ولاعتبارات قانونية، وأخرى سياسية، لم يتفق المجتمع الدولي على تعريف موحد لها إلا بعد مؤتمر كمبالا 2010، والذي تضمن تعديلات في النظام الأساسي للمحكمة، بموجب القرار RC/Res6 فعرف العدوان وبين أركانه، في المادة 08 مكرر وبين اختصاص المحكمة بجريمة العدوان ودور مجلس الأمن في ذلك المادة 15 مكرر و15 مكرر2. ورغم جدية التعريف المتوصل إليه، إلا أنه لم يتطرق لصورا أخرى للعدوان كما أنه وضع شروطا لممارسة المحكمة لاختصاصها وأخضعها بشكل ما إلى سلطة مجلس الأمن؟ مما يسمح لكل حقوقي انتقاد هذا التوجه، الذي جاء به مؤتمر كمبالا والقرار الذي نتج عنه.
في حين نجد وأن منظومة الفقه الإسلامي بما تزخر به من أحكام فقهية مستندة إلى أصول الشريعة الإسلامية- بشان الحرب وقواعدها-، قد حرمت كافة أشكال العدوان، واعتبرته جريمة كبرى، رغم أن هذا المصطلح لم يحظ بتعريف الفقهاء الأقدمون، و يمكن أن يصاغ من خلال مبادئ الشريعة وأحكام الفقه الإسلامي نظرية متكاملة لجريمة العدوان، ويبرز وجهة نظر المجتمع الإسلامي تجاه كافة أشكال العدوان الذي يعد المجتمع المسلم أكبر ضحاياه؟. فما حقيقة العدوان، وما أركانه، وما دور مجلس الأمن في تقدير حالة العدوان؟ وهل حقق مؤتمر كمبالا رغبة الدول في تحقيق حلم العدالة الجنائية الدولية؟
The crime of aggression or the war of aggression is one of the international crimes in the international criminal law. Yet, for legal and political reasons, the international community did not reach an agreement on how to define it until Kampala conference was held in 2010. This conference adopted amendments in the court stature, by virtue of the decision RC/res6. In article 8 bis, a definition of aggression and of its conditions were incorporated. Article 15 bis and 15 bis 2 limited the exercise of the jurisdiction of the court on this crime and specified the role of the Security Council in this respect. Despite the efforts deployed for reaching this definition, many other aspects of aggression remained uncovered. Moreover, the provided definition set out conditions for the exercise of the court of its jurisdiction and made it somehow under the control of the Security Council. This is enough reason for jurists to criticize such an attitude adopted by the Kampala Conference and the resulting decision thereof.
On the other hand, the Islamic jurisdictional system rich in jurisdictional provisions based on Islamic law (Chari’a) about war and its rules, prohibited all forms of aggression and considered it a serious crime although that the term of aggression itself was not defined by ancient Islamic jurists. A complete theory on the crime of aggression may be established on the basis of the Islamic jurisdictional law (fiqh) to explain the attitude of the Islamic society towards all forms of aggression which Muslims make most of its victims. Thus, what aggression is really? What are its conditions? What is the role of the Security Council in judging a case of aggression? Has Kampla Conference met the wish of states to establish international criminal justice?

آليات المالية الإسلامية التضامنية متعددة الأهداف والأشكال، يمكن أن تأخذ شكل مؤسسة أو صندوق أو جمعية أو غيرها من الأشكال القانونية، ومن ضمن هذه الآليات نذكر مؤسسات (أو صناديق) الزكاة، مؤسسات (أو صناديق) الوقف بمختلف أنماطها، صناديق الإغاثة، صناديق كافل اليتيم، هياكل التمويل الإسلامي الأصغروغيرها. غير أن تركيزنا في هذا البحث سينصب على مؤسسات المالية الإسلامية التضامنية الداعمة للاستثمار، وكحالة عنها سنتناول بالعرض والتحليل مقترح صناديق الوقف المتخصصة في تمويل المشروعات الصغرى للفقراء، مبرزين أهميتها الاقتصادية والاجتماعية، مقومات قيامها، تنظيمها وأدوات عملها، المخاطر المرتبطة بأنشطتها وسبل التحوط منها، وكذا مؤشرات قياس أدائها المالي والاجتماعي-الاقتصادي.
The Islamic solidarity finance mechanisms are numerous in terms of forms and objectives, they can take a form of a foundation, a fund, an association or any other legal forms, among these we findzakat foundations(funds), Wakf funds with their different types, relief funds, orphan care funds, financial structures, Islamic microfinance structures ... In this present article we will focus on the Islamic solidarity finance foundations supporting investments and, as a case study, we will discuss and analyze the proposal ofWakf funds specialized in the finance of micro-projects for the poor, showing its social and economic importance, the elements of its establishment, its organization and its means of work, risks relevant to its activities and prudential rules of protecting them as well as indicators of evaluating its economic, social and financial performance.

تعتبر القاعدة الفقهية "الغنم بالغرم" أو المشاركة في الأرباح والخسائر أساس العمل المصرفي الإسلامي، وقد أوجدت المصارف الإسلامية المشاركة في الأرباح والخسائرا بدورها في الوساطة المالية بين المودعين والمدخرين تعتمد مبدأ المشاركة في الأرباح والخسائر ر المال لنفسها صيغا تمويلية تقوم على هذا الأساس ممثلة في صيغ التمويل بالمشاركة وهي المشاركة، المضاربة، و بعض صيغ التمويل الأخرى التي تستخدم فيها المصارف الإسلامية الأموال المودعة في حسابات الاستثمار المشترك. ومن ثمة فقد كان القرار التمويلي في هذه المصارف ووفق صيغ التمويل هذه مبنيا على معدل العائد المحقق من الاستثمار الممول أو ما يعرف بمعدل عائد المشاركة، الذي ارتأينا أن نعرضه كمؤشر لقياس كفاءة الاستثمار الممول بالمشاركة.
ومن منطلق ما تنطوي عليه صيغ التمويل بالمشاركة في المصارف الإسلامية من مخاطر، تفضي إلى تقلبات في معدل عائد المشاركة وتؤثر على استقرارها جاءت هذه الدراسة كمحاولة لتوضيح أثر التغيرات في معدل عائد التمويل بالمشاركة على استقرار المصارف الإسلامية، من خلال قياس الاستقرار المالي لعينة من المصارف الإسلامية السعودية والبحرينية باستخدام مؤشر الاستقرار المالي z score ، وتقدير علاقة معدل عائد المشاركة لعينة الدراسة بمستوى الاستقرار المالي باستخدام بيانات البانيل والبرنامج الإحصائي eviews 8 للوصول إلى مجموعة من النتائج.
The Jurisprudential rule of participating in both the profits and losses « al ghurm bi al ghunm » is considered as the basis of Islamic banking, and Islamic banks have created for themselves some financing formulas based on this rule represented in the funding formulas to participate, including musharakah, mudarabah and some other funding formulas where Islamic banks use the deposited funds of the investment joint accounts, it is therek the funding decision in this banks, and according to these funding formulas based on the rate of return from investing, or what is know as a prfits and less sharing ratio (participation rate of return).On the basis of risk with musharaka funding in islamic banks , this study comes as an attempt to illustrate the role of participation rate of return on the stability of Islamic banks, by measuring the financial stability of a sample of Saudi Islamic and bahraini banks, using the z score index. Than We will estimate the relationship between participation rate of return and financial stability index, using panel data and the statistical program eviews 8, and thus obtain a range of results.

نحاول في هذا المقال تشريح واقع العملية التقويمية المستمرة للتحصيل الدراسي لدى الطالب بالجامعة الجزائرية بصفة عامة و جامعة 8 ماي 1945 قالمة - الجزائر ، على وجه الخصوص ، بما عليها ، و ذلك من خلال عرض إيجابياتو سلبيات مختلف الاختبارات التحصيلية الحالية "شفوية ، مقالية ، موضوعية ن ...." ثم نحاول اقتراح رؤية تقويمية استشرافية اكثر موضوعية نستطيع من خلالها أن نحقق مبدأ تربويا هاما.
القبر مظهر من مظاهر تكريم الله عز وجل للإنسان، له أحكام شرعية متنوعة تخصّه، تدل على عالمية الشريعة الإسلامية وشمول أحكامها لأحوال الناس أحياءً وأمواتا.
ومِن أهم أحكامه التي قررتها الشريعة وجوبُ احترامِه والاعتناء به بما يوافق الشرع والاهتمام به؛ توقيرا ومراعاة لِحُرمَةِ ساكنِه الميْتِ، وعدم التعرض له والاعتداء عليه بأي شكل من أشكال الأذى، ووجوب تنزيهه عن مظاهر التقديس والمباهاة.
The grave is one of the features that shows how God has given humans a great value and importance more than any creature on this earth. The grave, however, has its own varried Islamic rules and principles this in turn indicates that Islam sets eyes on every thing governs and belongs to people's life even after their death.

إن الذي نقصده بالبنوة هو المذهب اللغوي العلمي الذي ظهر في أروبا و أمريكا في بداية القرن العشرين الميلادية و تطور و بلغ أشده في نهاية الأربعنيات و هو يدعو إلى دراسة اللغة كنظام و كبنية لها وجود سابق لوجود أجزائها و مكوناتها.
إنّ من مظاهر الرحمة الإلهيّة بالعباد، أن كلّفهم الله تعالى ما يطيقون من التكاليف الشرعيّة، قاصدًا إلى تحصيل ما فيها من المصالح الدنيويّة والأخرويّة، ولم يقصد بالتكاليف الشرعيّة إيقاع المكلّف في ضيق ومشقّة وحرج، فإذا خرجت المشقة المصاحبة للتكليف عن المعتاد في التشريع، وبلغ الحال بالمكلّف إلى حدّ الحرج والعنت؛ شرع له إسقاط تلك التكاليف، أو تخفيفها بما يناسب الحال.
إنّ هذه المشقة التي ترافق التكاليف الشرعيّة شدّة وضعًا، وتختلف من شخص لآخر، ومن حال إلى حال، لا بدّ لها من ضابط يضبطها، ولا بدّ من معرفة المشقّة المستجلبة للترخيص بالتخفيف أو الإسقاط؛ ولا بدّ كذلك من معرفة العلاقة التي تربطها بالتكاليف الشرعيّة.
من أجل تسليط الضوء على هذه الجزئيّة؛ متضمّنًا ما يلي:
- قدّمت البحث بمقدّمة موجزة عن حيثيّات هذه الجزئيّة، وما هي الأشكاليّة العلميّة المطروحة للدراسة.
- تكلّمت عن مفهوم المشقّة، بتعريفها لغة واصطلاحًا، مع بيان أقسامها.
تحدّتث عن علاقة المشقّة بالتكليف الشرعي؛ وبينت حقيقة التكليف الشرعي، وحكم التكليف بما لا يطاق.
- جمعت النتائج التي توصّلت إليها من خلال البحث في خاتمة.

Pour mettre en évidence cette partielle , contenant :
- Présentation d’une brève introduction sur les mérites de cette particularité, et la nature du problem scientifique à exposer.
- J’ai exposé la definition de la difficulté et de ses parties.
- Je me suis étalé à definer la relation entre la difficulté et la cout légitime, j’ai ensuite determine la definition exacte de ce dernier, ainsi que la mise en service et la disposition exigeant qu’insupportable.
- En conclusion j’ai réuni mes recherches sous formes de resultats que j’ai présenté d’une manière appropriée dans cette these.

يناقش المقال بعض أهم النظريات و الأراء ، التي ربطت بين الأدب عامة و الرواية خاصة و بين التحولات الاجتماعية ، بحيث يتناول مجموعة من نماذج مثلث مراجع الدراسة السوسيولوجية للرواية ، إلى أن نضجت في شكل المنهج السوسيونصي ، مع الإشارة إلى بعض المنعطفات التي ربطت بين هؤلاء ، و يكشف عن العلاقة القائمة بين المجتمع و تغيراته
يتناول هذا المقال موضوع العقد وأثره في ثبوت الدين في الذمة؛ وذلك باعتبار أن العقد يمثل أحد مصادر الالتزام، وأحد الأسباب التي توجب تعلق الدين بالذمة. ونظراً لأهمية هذا السبب أو المصدر من مصادر الالتزام، يأتي هذا البحث لتسليط الضوء على هذه الحيثية من خلال التعرف على مفهوم العقد في اللغة والاصطلاح، ثم التطرق لبعض أنواعه ومظاهره، كالبيع المؤجل، والقرض، والسلم، والاستصناع، ثم بيان آثار العقد في ثبوت الديون، وعلاقتها بالجهة المدينة، والتزاماتها حيال الدائن.
Cet article traite de l’objet du contrat(agreement) et son impact sur la preuve de Debt (la dette) dans cette divulgation et étant donné que le contrat représente une des sources d’engagement (d’obligation) et l’une des raisons qui ont dû être attaché à la divulgation de la dette. Compte tenu de l’importance de cette raison ou d’importantes sources d’engagement à la source. Trouver voici le point culminant du récit en identifiant le concept du contrat dans la langue et la terminologie puis abordé certains des types et des manifestations, telles que vente différée(acquisition reportés) et de prêt et Salam Agreement et Istisnaa Agreement.
