This article is based on the approach of one of « the reminding councils from the wise experct words » texts of Abdelhamid Ibn Badis, which is an exegesis or analysis of the verse n° 108 of Surat Yusuf . It is a semantic approach according to the semantic field’s method having as a source the idea that the text is a group of words that form a conceptionnal system reflecting the author’s view to the world. As the text’s reference is Quran and its aim is to apply the Quranic method in the Algerian society, then its view to the world is unseparable of the Quranic one and in the same time, it is related to the Algerian fact and reality. For, Ibn Badis was a great of his era who was conceptionnally linked to his islamic history اختلف الفقهاء المعاصرون في القول بتقنين أحكام الفقه الإسلامي بين مؤيد له باعتباره ضرورة من ضرورات العصر، ومعارض له خوفا على ضياع أحكام الشريعة باعتبار ذلك مدخلا لتشبهها بالقانون الوضعي، واستدل كل منهما على ما ذهب إليه بكثير من الأدلة الشرعية، وبالإطلاع عليها كان القول بالتقنين هو الراجح – في رأيي-وذلك لوجود عدة مبررات تدعم ذلك على المستوى الداخلي والخارجي مع الاحتياط لمنع أي خطر يصيب الشريعة الإسلامية أثناء ذلك. فتضمن هذا البحث: توطئة: بينت فيها المستجدات التي جعلت مسألة التقنين ضرورة من ضرورات العصر ثم ضبط لتعريف التقنين حتى لا يتلاعب به، ثم وضحت المبررات الداخلية فالخارجية، وأخيرا التأكيد على أن هذه المبررات حقيقية وليست وهمية؛ مما يجعل التقنين أمر فرضه واقع الحال ولا يمكن لأحد إنكاره إذا أردنا تمهيد الطريق لتطبيق الشريعة الإسلامية.      Les savants ou les juristes de la Jurisprudence islamique ne partagent pas tous le même point de vue concernant la codification des différents jugements ou le rationnement de la jurisprudence. Les partisans, eux, voient que c'est une nécessite à notre époque par contre les opposants craignent que cette opération entraine la perte des jugements de la" Charia" étant donné sa ressemblance avec les lois posées par l'homme.      Personnellement, en étudiant les preuves avancées par chaque parti, J'ai vu que l'avis des partisans était plus rigoureux et plus cohérent sur le plan interne et éxlerne et ont veillé à proteger "la Charia" de tous risques.      Cette recherche contient "Prélude" dans laquelle j'ai donné la définition éxacte du "rationnement" pour qu'il ne puisse y avoir d'ambiguité puis je suis passé au second lieu à expliquer et clarifier les arguments qui nous incident à prendre en charge ce rationnement de la jurisprudence car il s'agit de preuves réelles fondées sur notre vécu quotidien.      Et à la fin, il faut recomailie que le rationnement ont une solution que nul ne peut contester surtout si nous voulons vraiment appliquer notre "Charia" . The scholars have made tremendous efforts to state the aspectsof the miracles of the Quran as to perform the right of the Bookof Allah upon them. When the Mu’tazili “Nadham” , who wasthe first to talk about the “Sarfa”in the Quran, other scholarswere very motivated to discover more aspects of the miracles ofthe Quran.The “Khatabi” pointed out the influence of the Quranon both of the reciter and the listener equally. However, “AlNabhani”, emphasized that the matter of the Miracle of theQuran with non-abrogated recitation as characteristic of thenon-abrogated recited Quran contrary to the abrogated Quranwhich is being recited that has a miracle aspect because of itsrecitation. Since corporate governance is a system by which companies are governed and controlled, the joint-stock companies that embrace it must create a concrete change in their organization demonstrated by the reconfiguration of their boards of directors according to the principle of efficiency, based on the foundations and criteria laid down by the majority of corporate governance codes, in particular the French code and the Belgian code. The effect of these codes appears through the skills and expertise of the Board of Directors, in addition to engage independent members. One can also see the effect of the rules of governance by creating specialized committees under the board of directors in order to support the role of the latter in the administration and control of the company for its own interest. This paper is a study of intertextuality and stile in the letters of ElbachirElibrahimi such as: the intertextuality in critics methods, intertextuality and stile in the letters of ElbachirElibrahimi. استقرت النظم القانونية الداخلية على تمتع رؤساء الدول بحصانة ضد المسؤولية الجزائية تختلف في مداها للتأرجح بين الإطلاق والتقييد تأثرا بطبيعة النظام السياسي لكل دولة، فبعد أن كانت الحصانة تجد مصدرها في حرمة ذات الملك في الأنظمة الملكية، وما ترتب عن ذلك من تأكيد لقاعدة لا مسؤولية الملك المطلقة وإنكارا لمبدأ المساواة أصبحت الحصانة ضرورة تفرضها مقتضيات الوظيفة لأجل الأداء الفعال لها، لتقرر بذلك الحصانة النسبية لرئيس الدولة في الأنظمة الجمهورية، والتي يجب أن تستند إلى حجج مشروعة وإلا عدت خروجا وخرقا لمبدأ المساواة.     وبالموازنة عمدت أحكام الشريعة الإسلامية إلى تغليب المسؤولية الجزائية للحاكم وعدم الاعتداد بالحصانة، وذلك تكريس لمبدأ المساواة حسب ما تقتضيه مبادئ السياسة الشرعية في الإسلام، للتأكد صلاحية أحكام الشريعة الإسلامية كتشريع كامل لاستتباب الأمن داخل المجتمعات ولضمان حقوق وحريات الأفراد في كل الأحوال حتى ولو استدعى ذلك محاسبة الحاكم. To date, internal legal systems lean on the immunity against penal code; this immunity is nuanced and always changing between independence and restriction, it’s influenced by political regims’ nature of each single state. In the beginning, in kingdoms, immunity found its jurisdiction’s root in the inviolacy of the king himself, which means the absolute consecration of unaccountability and the denial of equality principles. In fact, the immunity became a necessity commanded by the office of state’s needs for the well doing of the function process. From then on, this relative immunity enjoyed by the president in republic case, should lean on legitimate pretexts, otherwise it’d be considerated as a violation and denial of equality principles. In comparison, the Islamic law do prevail penal code on governors by annihilating immunity in order to reinforce equality principles which is an Islamic origin, so confirming lawful politics in Islam as a strong and reliable legislation for guaranteeing the real-estate security, freedom and right of persons even if it requires the accountability of the governor himself. Creator An entity primarily responsible for making the resource شايب ربي, العمرية Date A point or period of time associated with an event in the lifecycle of the resource 2017-06-29 Description An account of the resource     القوامة في مفهومها الحقيقي هي عملية تنظيميّة للشراكة الزّوجيّة، وهي مسؤولية يتحمل كل من الزوجين تكاليفها كلّ يقوم بوظائفه المنوطة بهم تطبيقا لقوله تعالى:﴿ الرِّجَالُ قَوَّامُونَ عَلَى النِّسَاءِ بِمَا فَضَّلَ اللَّهُ بَعْضَهُمْ عَلَى بَعْضٍ وَبِمَا أَنْفَقُوا مِنْ أَمْوَالِهِمْ فَالصَّالِحَاتُ قَانِتَاتٌ حَافِظَاتٌ لِلْغَيْبِ بِمَا حَفِظَ اللَّهُ ﴾   وللقوامة مقاصد شرعية تتمثّل في حفظ مقصد حدود الله – عز وجل -من الانتهاك، وبالتالي حفظ عرض المرأة وكرامتها وتنظيم الجانب المؤسسي والمالي للأسرة، وكذا تحقيق مقصد التكافل الأسري في الإسلام.  لكن للأسف في واقعنا اليوم تظافرت أسباب عدّة أدّت إلى ضعف القوامة في العالم الإسلامي عموما، وفي المجتمع الجزائري خصوصا، أبرزها:     اتّكالية الرّجل بسبب عمل زوجته واستغلالها، وكذا علمنة أفكار المرأة بشتّى الوسائل واتّخاذ الإعلام العلماني وسيلة لتحطيم كيان الأسرة المسلمة.    ولأجل القضاء على هذه الظاهرة، لابّد من تكاتف جهود كلّ المؤسّسات من الأسرة إلى المسجد إلى المدرسة، إلى الجامعة ...، حتّى تعود الأسرة المسلمة إلى نبعها النّقي الصافي، ومن هذا المنطلق نستطيع أن نقضي على كثير من الآفات الاجتماعيّة الّتي كاد المجتمع الإسلامي عموما، والمجتمع الجزائري خصوصا أن يغرق فيها.
