الجدل بين التاريخ و علم الإجتماع جدل قديم يعود أساسا لطول هيمنة التاريخ على علم الإجتماع ، و لم يمض وقت طويل على الابتعاد التدريجي لعلم الاجتماع عن التاريخ حتى عاد مفهوم التفسير ليجعل المصالحة بينهما شيئا ضروريا
يتناول هذا البحث موضوعا في غاية الأهمية، ذلك أن عمليات نقل وزرع الأعضاء البشرية أثارت - ولازالت تثير- اهتماما واسعا ونقاشا عميقا لدى مختلف الأوساط الطبية والدينية والقانونية والاجتماعية، ذلك أن المسألة مرتبطة بحياة الإنسان وحرية تصرفه في جسده. حيث فتح العلم آفاقا وآمالا واسعة أمام البشرية في مجال علم نقل وزرع الأعضاء، وأصبح حقيقة لا خيالا أن يُستبدل عضو مريض بآخر سليم، فتطورت عمليات نقل وزرع الأعضاء وارتفعت نسب النجاح فيها يوما بعد يوم. ولعل هذه الدراسة العلمية التأصيلية تهدف إلى البحث في الجانب القانوني بشأن معالجة المشرع الجزائري لموضوع نقل وزراعة الأعضاء

تعددت و تنوعت تعريفات النحو العربي ،ليدل هذا المر على عناية العلماء بهذا العلم ، لما له من أثر بين في شتى العلوم ، على اختلاف مقاصدها ، و لعل خير تعريف حدد معنى هذا العلم لغة و اصطلاحا قول ابن جني " هم انتحاء سمت كلام العرب في تصرفه من غعراب و غيره ، كالتثنية و الجمع ، و التحقير و التكسير و افضافة ، و النسب و التركيب ، و غير ذلك ، ليلحق من ليس من اهل اللغة بأهلها في الفصاحة فينطق بها و هو في الأصل مصدر شائع ، أي نحوا ، كقولك : قصدت قصدا ، ثم خصت به انتحاء هذا القبيل من العلم
إن عمليات نقل وزرع الأعضاء البشرية ( ) لم تحقق النجاح والشهرة التي وصلت إليها إلا بعد أن استقرت فكرة حُرمة جسد الإنسان في أذهان الناس التي قامت على مبدأ أخلقة الحياة. وقد كانت عمليات نقل وزرع الأعضاء من الأعمال الطبية التي أثارت جدلا كبيرا بين رجال القانون والطب وعلماء الاجتماع والأخلاق ورجالات الدين حيث الإنسان ليس شخصا قانونيا له حقوق وعليه التزامات فقط بل هو أولا وأخيرا جسد وروح ، لجسده حرمة ولحياته وصحته قدسية أثناء الحياة وبعد الوفاة . فكل هذه الأفكار دفعت بجانب كبير من الفقه المدني في فرنسا إلى استحداث فرع جديد من فروع القانون الخاص هو القانون الطبي الذي يهتم بحماية الإنسان وصحته منذ لحظة الحمل إلى ما بعد الموت، إذ أن حماية جثث الموتى تَحظى هي الأخرى بهذه الحماية أيضا .

لقد كانت للمقاومة الجزائرية بقيادة الأمير عبد القادر أثرها الكبير في تعطيل و انهاك قوات الاحتلال الفرنسي طيلة سبعة عشر سنة ، بداية من سنة 1882 إلى غاية سنة 1847.
لا يخفى التطور المذهل في الذي أحززه الطب في مجال نقل وزراعة الأعضاء، وأصبح بإمكان الإنسان المريض أن يستبدل العضو المصاب بعضو سليم بسهولة ويسر من الناحية الطبية، لكنه قد يجد عقبة أمامه تتمثل في عدم توفر العضو البديل، فليس كل الناس مستعد أن يتبرع بعضوه، ولم تنتشر بالحد الكافي ثقافة التبرع، فكان الطلب على قطع الغيار متزايدا في ظل نقص العرض، مما حمل البعض على البحث عن البديل ولو بالمقابل المادي، ومن هنا ولما كثر الطلب وقل العرض اشتغل أناس كوسطاء وسماسرة من أجل سد حاجة المرضى فتكونت في الخفاء وبعيدا عن أعين الدول ورقابتها سوق عالمية تسيطر عليها عصاباتٌ أخطرُ من عصابات المخدّرات، تتاجر في الأعضاء بيعا وشراء، وتستعمل أبشع الوسائل، فتَسْتَغِلُ فقرَ الناس في المجتمعات الفقيرة وتغريهم بالأموال لتكون أعضاؤهم قطع غيار يستفيد منها المرضى في المجتمعات الغنية، وقد يصل الأمر بهذه العصابات إلى ارتكاب جرائمَ قتلٍ متعمّد، وخطفٍ للأطفال، والمجانين، والمتخلفين عقليا، والمشردين ممن هم بدون مآوى، أو يعمدون إلى تزوير شهادات ميلاد، ووفاة، أو تزوير جوازات سفر، ... وغيرها، وكل ذلك لتكون هؤلاء الضحايا مصدرا يمدّها بالأعضاء.

تعتبربعض أنواع الرحلات الجغرافيا ذات فائدة كبيرة للغاية لدراسة جوانب من التاريخ الاقتصادي كما هو الحال بالنسبة لكتاب " وصف افريقيا " للحسنالوزان ، الذي يقدم معلومات مفيدة جدا عن أحوال الإقتصاد المغربي في الفترة الوطاسية السعدية
إن التطور الهائل الذي عرفه علم الأجنة خلال السنوات الأخيرة، أظهر الكثير من المعارف لاكتشاف أسرار الحياة الجنينية، حيث لفت أنظار العديد من الباحثين للاهتمام بموضوع الجنين. فلم يعد مجال الاهتمام بالجنين يقتصر على العناية به، والحفاظ على سلامته فحسب بل توسع إلى مجالات أخرى استجدت مع تقدم الطب الحديث. فقد أصبح الجنين يلعب دور المتبرع الأول للأعضاء البشرية، وذلك لما تتميز به الخلايا الجنينية من خصائص تجعلها صالحة للزرع. حيث كان لهذا الاكتشاف أثره الإيجابي في علاج بعض الأمراض المستعصية، كبعض الأمراض العصبية والسكرية، وذلك بنقل أنسجة أو أعضاء من الجنين وزرعها للمريض.

إن القول بالعلاقة بين الأدب و العلوم الشرعية ، و هو اففقرار بوحدة العوامل التي شكلت إطار العلاقة التي تمت تاريخيا بين هذه الحقول المعرفية ، و بالتالي البحث في اساسيات العلاقة و في نظامها و آليات إنتاجها داخل الثقافة العربية الإسلامية .و من ثم فغن مقاربتنا تصدر عن أطروحة تقول " إذا جاز لنا أن نسمي الحضارةافسلامية بإحدى منتجاتها ، فإنه سيكونه علينا ان نقول عنها غنها حضارة فقه و عندما نقدم الفقه بوصفه إطارا فكريا و معرفيا شاملا في الثقافة العربية الإسلامية فإنما نريد من وراء ذلك تأكيد الحقيقة التالية و هي أن الفقه الإسلامي كان أقرب منتجات العقل العربي إلى التعبير عن خصوصيته
محاضرتي في هذا الملتقى الواعد تكون في المحور الثاني: التأصيل الشرعي والضوابط الشرعية والقانونية والطبية، حيث اخترتُ الشيخ أحمد حماني - رحمه الله- بالذات؛ لأن هذا الشيخ الفقيه لم يُعرف قدرُه في بلاده، ومن كان يُداوم على حضور جلسات ملتقى الفكر الإسلامي في الجزائر يقف وقفة إجلال واعتراف لهذا العالم النحرير، وأردتُ من خلال هذه المحاضرة أن أُبيِّن للدارسين والباحثين أن الشيخ أحمد حماني - رحمه الله- يُعتبر من العلماء الأوائل في القرن العشرين مَنْ أفتى في موضوع نقل الأعضاء وزرعها،

لا ريب أن دراسة الأقليات يكتسي صبغة خاصة لا سيما في عصرنا ، و في ضوء المتغيرات الدولية حيث تتخذ - الأقليات - كذريعة لتقويض المجتمعات من الداخل بإثارة النعرات و الفتن
من صفات الشريعة الإسلامية الكمال والتمام كما قال تعالى: ﴿اليوم أكملت لكم دينكم وأتممت عليكم نعمتي ورضيتم لكم الإسلام دينا﴾ [المائدة:3]، كما أن من صفاتها الاستمرارية والصلاحية لكل زمان ومكان، لذا فإن النصوص من القرآن والسنة فصلَّت في القضايا التي لا تحتمل التغيير والتبديل، ولما كانت الحوادث والوقائع عبر العصور والأزمان المتلاحقة غير متناهية، وتستجد قضايا معاصرة في حياة المسلمين، كان من الضروري أن يتصدى لها أهل العلم بالبحث والبيان، للوقوف على حقائقها، ومعرفة أحكامها الشرعية، بالاستناد إلى القواعد الكلية المستنبطة من القرآن والسنة النبوية. ومن تلك القضايا ما يتعلق بالمسائل الطبية المعاصرة، ومن أبرزها وأظهرها مسألة نقل وزرع الأعضاء الآدمية، وقد أَوْلتها الدولة الجزائرية اهتماما خاص

القراءات تمثل ظواهر الأصوات اللغوية العامة كالإمالة والإدغام والهر من حيث التخفيف والتحقيق-. - وهي كذلك ميدان واسع لدراسة الأصوات اللغوية من جوانبها الأخرى، لأن علماء القراءات درسرا الأصرات دراما وصفية قبل أن يعرف الهح الوصفي ني دراسة اللغة في القرن العشرين. وقد بذل القراء جهودا متقعنعة النظير خدمة لكتاب الله ولفته الشرفة، فانتشرت تي الآفاق شرقا وغربا. وزنه لا يكاد يوجد علم من علوم اللغة العريية، يله من علوم الثويعة إلآ وتعد .1 لقراءات رافدا من روافده. وهل غضت علوم العربية إلا بالقرآن وعلومه؟ إن القرآن الكريم ححة ني العربية بقراءاته ايواترة وغير التررة، كما هو ححة في الشانة؛ خالقراعة الشانة التي فقدت ثرط التراتر لا تقل شأنا عن أوثق ما وصل إليتا من ألفاظ اللغة وأساليبها. وأهم الوساءل التي تقل مجا القراء١تاهي الروايات والساع من أفرا. العلماء، الأن ني القراءات ما لا يفهم إلا بالسعاع، ولا يمكن أن يؤخذ ٠ن الكتب. والأخذ عن العلماء درجات كل درجة لها مقداو من ائقة، فأعلاها أن يأخذ التلعيذ من أمتانه عرضا وسماعا، وتكون له نخة من أستاذه، ودونما أن يأخذ القراءة سماعا. والمفر للقرآن الكريم لا بد له من معرفة أوجه القراءات إن أراد تبيان معاني القرآن ودلالاته، لأن بالقراعات يتكشف من معاني الآية ما لا يكشف بالقراءة الواحدة, وبالقراءات لآرجة لديه بعض الوجوه اغيتملة على ب٠ض من معاني القرآن، ويا يعرف كيغية التطق بالقرآن الكريم، وكيفية الأداء وما فه من إعحاز، ي٠ن فقط في نظمه ومعانيه، بل ي تراكب الألفاظ وحروف الكلم. فالقرآن ححة علماء اللغة في معرفة لغة العرب، وحجة الفقهاء في الاسباط.
غايةُ الطب حفظ الصحة الموجودة، واستعادةُ العافية المفقودة، وإزالةُ العلة أو تقليلُها بقدر الإمكان، يقول ابن سيناء: غاية الطب حفظ صحة وبرء مرض. ( ) فالطب كالشرع وُضع لجلب مصالح السلامة والعافية، ولدرء مفاسد المعاطب والأسقام، ولدرء ما أمكن درؤه من ذلك، ولجلب ما أ مكن جلبه من ذلك. ( ) والأطباء يدفعون أعظم المرضين بالتزام بقاء أدناهما، ويجلبون أعلى السلامتين والصحتين ولا يبالون بفوات أدناهما، ويتوقفون عند الحيرة في التساوي والتفاوت، فلا يحل للطبيب الإقدام على وصف العلاج مع التوقف في الرجحان إلى أن يظهر له الراجح. ( ) فلا بد من أجل ذلك في كثير من الأحيان من تحمل أدنى المفسدتين لإزالة أعظمهما وتفويت أدنى المصلحتين لتحصيل أعلاهما.

ننطلق في مداخلتنا هذه من التعريف الذي يجعل من التركيبية إحدى مركبي علم النحو ، المركبة الثانية له الصيغة . فإذا كانت الصيغة بمفهومها العام تقف عند حدود الكلمة ، فإن موضوع التركيبية هو الجملة . فالتركيبية تهتم إذن بدراسة بنية الجملة ، فتقوم بتعيين الوحدات المدلالة المشكلة لها ، و تحديد العلاقات التي تربط هذه الوحدات ببعضها البعض ، علاقات لا يكون للجملة كيان لغوي بدونها .
خلو الرجل هو ما يطلق عليه عند العوام اسم العتبة في المحلات التجارية أو اسم المفتاح في الدور والسكنات ، و من المعروف أنّ القوانين في كثير من الدول العربية تمنح للمستأجر حقاًّ معنويا في المحل المؤجر يسمى الخلو (القاعدة التجارية) وذلك بعد مضي مدة معينة من إجارته (الامتداد القانوني للعين المؤجرة) ( )، وبموجب هذا القانون لا يستطيع المؤجر إخلاء المستأجر من محله إلا بعد إرضائه ودفعه له بدل الخلو، مما نتج عن هذا الوضع امتناع الملاك من تأجير محلاتهم وأملاكهم وتركها خاوية فارغة أو استئجارها بطرق وحيل ملتوية حتّى لا يقعوا في مأزق استيلاء المستأجر على المحل باسم الامتداد القانوني لعقد الإيجار. وفي كل ذلك مفسدة عظيمة واضحة من تضييع الأموال وعدم استثمارها مع كثرة المحتاجين للعقارات والمحلات. فما هو الخلو وما هو موقف الفقهاء المسلمين منه وما هو الحكم الأقرب إلى العدل والمصلحة في المسألة.

إن الإنسان مجبول بفطرته على الاجتماع والتعايش مع محيطه الإنساني والمادي، وهو من حيث طبيعته التي خلقه الله تعالى عليها لا يمكن أن يعيش عيشة سعيدة مستقرة بمفرده، كما لا يمكنه أن يجد للحياة طعما أو لذة إذا عاش بمعزل عن الناس، واستغنى بفكره وذاته عن العالم من حوله، لأن ما يريد الإنسان أن يحققه لنفسه من الاستقرار والسعادة والأمن في حياته قدراً عالياً من التفاعل الإيجابي مع غيره. والتفاعل الإيجابي البناء مع الحياة وما يغشاها من تطورات حثيثة وتغيرات متلاحقة لا يستطيع الفرد أن يقوم بأعبائها وحده، مما يستلزم ضرورة شيئين، هما: الأول: التعايش الإيجابي والتعاون الفعال بين بني البشر في المقام الأول، وبين ما خلقه الله تعالى في الكون في المقام الثاني. والثاني:قيام هذا التعايش والتفاعل مع الآخر على منهج مبناه الإيجابية والموضوعية والعلمية.

يذهب كثير من العلعاء إلى أن الشعر هر أول أطوار العرفة الانانية، كونه تأملا ق ملكوت الكون و تسلا لما تقع عليه الحواس، وما تختلج به شن الشار؛ وإذا كانن (ثيلي) ثمؤا[ج81 قد قال: إن الشعر هو مركز المعرفة ومحيطها وهو الذي سترعب العلوم كلها، فإن شارنا العربي ارتقى منا الحقل المعرفي الذي هو الشعر إلى مرقة النبرة وكاد
يسعى هذا البحث لبيان مفهوم " جرح الأقران " عند علماء الجرح والتعديل وما أعطوه له من خصوصيات تتعلق بدوافعه البشرية، كالحسد أو المنافسة أو الاختلاف العقائدي وغير ذلك، مع شواهد تطبيقية وأمثلة عملية لعدول من الرواة كانوا ضحايا لسبب من أسباب جرح الأقران، وتضمن هذا البحث الإشارة إلى حسن تقدير المحدثين لجرح الأقران في نظرية نقد الرجال، وقد خلص هذا البحث إلى جملة من النتائج منها: لا يقبل الجرح في حق من استفاضت عدالته واشتهرت إمامته، كما أنه يتوقف في قبول الجرح إذا خشي أن يكون باعثه يحمل طابعًا شخصياً كالاختلاف في الاعتقاد أو المنافسة بين الأقران.
This research attempts to clarify the meaning of peer's wounding at the scholars of wounding and amendment. They gave to this term some specifities, related to its human motives, such as envy and competition, or theological differences, and so on…
This study presented several practical examples as applied proofs to the narrator's reverse, which were victims of one of the causes of peers wounding.
This research dealt with the discretion of hadith scholars to peers wounding in narrator's critic theory.
This study concluded that wounding the upright narrators or famous imams is not accepted. We have to stop and pay attention when wounding can be related to personal motives, such as theological differences or competence between peers.
