النظرة الحادية للتراث هي نظرة قاصرة ، و عرجاء .و قد أكد لنا التاريخ المعاصر أن ذثيرا من الشعوب و الأمم التي حققت طفرة نوعية في حياتها المعاصرة مثل الصين و اليابان هي التي عملت على إحياء تراثها ، ثم فتحت الباب على مصراعيه لإقامة جوار معه برؤى و مناهج معاصرة
تعتبر الشفعة سببا من أسباب كسب الملكية العقارية، وهي ذلك التصرف الذي يحد من حرية التبايع، فالشفعة تكسب الشفيع عقارا باعه صاحبه لشخص أجنبي، مقابل ما تم دفعه من ثمن ومصروفات، وباعتبارها سببا استثنائيا تغيب فيه حرية التعاقد، فإن المشرع الجزائري أحاطها بمجموعة من الشروط الموضوعية والإجرائية، فمن الشروط الموضوعية كونها لا ترد إلا على العقارات، ومن الشروط الإجرائية وجوب احترام الشفيع لآجال إعلان رغبته في الأخذ بالشفعة وإلا سقط حقه، حيث ستكون الشروط الموضوعية محل هذه الدراسة، والتي بموجبها يكون طالب الشفعة مؤهلا لاكتساب العقار بالشفعة.
The right of pre-emption is considered as one of the causes to obtain a real-estate property ,it is an action that limits the liberty of sale, the right of pre-emption grants the beneficiary of the right of pre-emption a real-estate sold by its owner to a third party, in compensation of what was paid as a price and the other expenses, while if we consider the right of pre-emption an exceptional motive in which the liberty to conclude a formal contract is absent, the Algerian legislation established a number of substantive and procedural requirements for that matter. Among the substantive requirements is the fact it is only valid for real-estates, and among the procedural requirements the obligation of the beneficiary of the right of pre-emption to respect the periods in which he expresses his wish to acquire a real estate by pre-emption, otherwise he will lose his right to do so. The substantive requirements will be the subject of this study by which the pre-emption claimant will be eligible to obtain a real-estate by means of pre-emption right.

لقد أضحت دراسة التفكير البلاغي عند العرب بآليات و مقاربات منهجية معاصرة من إهتمامات الباحثين و المختصين خصوصا أولائك الذين أرادوا ربط التراث بأواصر التحديث
هذا البحث يتناول قضية مهمة في أصول الاستدلال وهي اعتبار السياق، ثم بيان أثر ذلك في الفهم السليم للسنة النبوية، ومن أجل ذلك فقد جاءت الدراسة في محورين أساسيين: نظري وتطبيقي .
فأما الـمحور النظري فقد كان من خلال نظرة موجزة على تعريف السياق وما يتعلق به من ألفاظ، ثم بيان أهمية السياق في فهم نصوص الشريعة، وذكر الأدلة الشاهدة على ذلك.
وأما الـمحور التطبيقي فقد بيَّن جملة من الأوجه التي وظف فيها العلماء السياق في فقه السنة النبوية، وإبراز أثر ذلك في اختلاف الفقهاء.
وقد خلص الباحث إلى أن دلالة السياق محور رئيس في الاستدلال عامة وفقه نصوص السنة النبوية خاصة، وأنه جُنَّةً من الوقوع في الخطأ ودليل إلى الفقه الصحيح
This research deals an important issue in the basics of inference which is considered as context, then the impact of that statement in a correct understanding of the Prophetic Sunnah.
The researcher concluded that the indication of context is essential in the jurisprudence of the texts of the Sunnah, and it is avoid from falling into error and a guide to the correct understanding.

يتناول هذا المقال موضوع الشركات: أقسامها وزكاتها، من خلال تعريفها اللغوي والاصطلاحي (في الشريعة والقانون)، وتبيان أنواع الشركات،للوصول إلى كيفية تقدير زكاتها بالنظر إلى أنواعها المختلفة (أشخاصا وأموالا)، بهدف وضع طريقة أمثل لتحصيل زكاة هذا النوع من الأوعية الزكوية المهمة، وذلك لتحقيق مصلحة المستحقين.
This article addresses the issue of the Zakat of firms and companies, through its linguistic and terminological definition (both in Sharia and law),and the identification of companies types, to arrive at how to estimate the amount of this kind of Zakat given to its different types in order to develop an optimal method for the collection of this important category of Zakat, so as to achieve the interests of those who deserve it

هذا المقال المنتمي غلى مجال تدريس اللغة الانجيزية للأغراض الكادمية يشير إلى أن تدريس الكتابة الأكادمية ينبغي أن يحتا مكانا مركزيا في منهاج تدريس طلبة اللغة الانجليزية من خلال اشراك جميع أساتذة
إن النساء والأطفال بصفتهم مدنيين، هم الأكثر عرضة للمساس بهم أثناء النزاعات المسلحة الدولية ويتعرضون للانتهاكات الجسيمة لحقوقهم، ولهذا نجد العديد من النصوص والمواثيق الدولية التي تضع أحكاماّ للحماية تخص هاتين الفئتين، أهم هاته المواثيق: اتفاقية جنيف الرابعة لحماية المدنيين الصادرة في 12 أوت 1949، فقد وضعت أحكاما تخص المدنيين بصفة عامة ثم خصصت مجموعة أحكام تضع حماية تفضيلية وخاصة للنساء والأطفال وقد أضاف البروتوكول الإضافي الأول الملحق بالاتفاقية والصادر في سنة 1977أحكاما أخرى من باب التكميل والتطوير في قواعد الاتفاقية الرابعة لجنيف.
كما أن هيئة الأمم المتحدة قد سعت جاهدة ومازالت لحد اليوم تسعى لحماية هاتين الفئتين من خلال العديد من القرارات الناشئة لمجموعة كبيرة من آليات الحماية.
Women and children are the most touched civilians during The International Armed Conflicts and are facing grave violations of their rights. Concerning that, we find a lot of Texts and International Contracts putting regulations of protection specific to these two genders. Most important of those contracts is The Fourth Convention of Geneva for saving civilians issued in 12 august 1949; which has stated general rules regarding generally the civilians, then it has specified a collection of regulations setting a favoured protection especially for women and children; and The First Additional Protocol has been issued in year1977, besides other regulations for the continuity and progress in the rules of The Fourth Geneva Convention.
Also, The United Nations organism has attempted and is till nowadays attempting hardly to protect these two categories through holding various decisions as a group work of a big mechanism of protection

يتناول هذا المقال أهمية إستخدام الأستاذ للتغذية الراجعة باعتبارها إجراء ناجعا في تحسين القدرة على التعبير الكتابي عموما و تطوير صنعه الكتابة باللغة الانجلزية على وجه الخصوص ، و هو ما يجب أن يكون انشغال كل أساتذة التعبير الكتابي في سياق اللغة الانجلزية سواء أكانت لغة ثانية أم اجنبية .
إن التطورات المتسارعة التي تشهدها السوق الاستهلاكية اليوم والتي نتج عنها عدم توازن في العلاقات التعاقدية نتيجة للخبرة والمعرفة التي يكتسبها المتدخلين منتجين كانوا أو موزعين مقارنة بالمستهلك الضعيف. حيث أن هذا التفوق المعرفي للمتدخلين أدى إلى انفرادهم بصياغة العقد ووضع بنوده بعيدا عن أي رقابة الأمر الذي ترتب عنه فرض شروط مجحفة وتعسفية في حق المستهلك.
The rapid developments taking place, today, in consumer market engender an imbalance in the contractual relationships, as a consequence of the knowledge and experience of interveners either manufacturers or distributors in comparison with the weak consumer. This cognitive superiority of the interveners gives them the monopoly to draw up the contract and to set its terms away from all control; this is what leads to impose unfair conditions on the consumer.

إن الأسرة باعتبارها المؤسسة الاجتماعية المسؤولة على إنتاج الأفراد الذين يقومون بهمة تعمير الأرض التي استخلفهم الله فيها، تحظى بحماية المجتمع والدولة كما نصت على ذلك المادة 58 من دستور 1996، فهل المجتمع الدولي أيضا اهتم بالأسرة وشؤونها، ووفر لها الحماية القانونية الكافية ليحافظ عليها باعتبارها الخلية الأساسية الأولى لقيام المجتمع الإنساني؟ عند قراءة الوثائق الدولية، لا نجد اتفاقية خاصة بالأسرة، وإنما جاء الحديث عنها في ثنايا الاتفاقيات والمعاهدات الدولية المختلفة.

نتج عن الفتنة التي أودت بحياة الخليفة عثمان بن عفان -رضي اللله عنه - و الصراع الذي نشب من بعد ذلك بين الإمام عي و معاوية - رضي الله عنهما - إلى ظهور فرق سياسية دينية فكرية ، سعى كل تيار جاهدا لإصلاح الحال ، وفق منظوره ، و بالوسائل المتوفرة لديه
بدأت مسيرة المصارف الإسلامية في العديد من الدول الإسلامية كجمهورية مصر العربية في عقد الستينات من القرن العشرين ( تجربة ميت غمر ) وتبعتها في عقد السبعينات صحوة شملت عدة دول منها دولة الإمارات العربية المتحدة (بنك دبي الإسلامي ) ودولة الكويت (بيت التمويل الكويتي) وجمهورية السودان (بنك فيصل الإسلامي السوداني) وكذا الحال تجربة بنك فيصل الإسلامي المصري في عقد السبعينات ، إلا أن هذه التجارب كانت تمثل اجتهادات على مستوى المسئولين من تلك المؤسسات ، وبالتالي فان تجربة النظام المصرفي الإسلامي الشامل اقتصرت على ثلاثة دول هي إيران وباكستان والسودان ، وبما أن التجربة السودانية كانت ذات معاني ودلالات في من حيث تنوع الأدوات المستخدمة، فان هذا البحث يأتي للوقوف على مسيرة ا التجربة السودانية تطبيق النظام المصرفي الإسلامي خلال الفترة 1977-2012م.
Islamic banks started in many Islamic countries like Egypt in the sixties and was followed by an Islamic revival in many countries among which is the UAE where Dubai Islamic Bank was established, in Kuwait (the Kuwaiti Finance House), and in Sudan (Faisal Islamic Bank). The practices of these banks depended on the experiences of these banks authorities, thus the implementation of a comprehensive Islamic banking system was put into practice in only three Islamic countries, namely Iran, Pakistan and Sudan.
Since the Islamic banking systems in Sudan has other implications, this thesis will look into the procedure that was foll owed with regard to Islamic banking form 1977 to 2012.

تحاول هذه الدراسة التطبيقية مكاشفة المنجز الروائي العربي الجزائري ، من خلال البحث في بنية المكان و تحديد هويته من الناحية الدينية ، فيرتبط بقيمة التقديس تارة و بقيمة التدنيس تارة أخرى و هذا إنطلاقا من منظور الشخصيات الفاعلة في الروايات المختارة
قد يفضي إبرام المرأة لعقد العمل إلى إمكانية تعرضها إلى إشكال مختلفة من الاعتداءات والعنف، كالعنف الجسدي أو الجنسي، وسواء أكان ذلك أثناء عملها أو بمناسبة القيام به، الأمر الذي يتطلب من المشرع توفير الحماية اللازمة لها للحيلولة دون وقوع العنف أو أي اعتداء في مواجهتها وتمكينها من درئه إن هو وقع.
والناظر إلى التشريعات النافذة يلاحظ وجود بعض الأحكام الخاصة بمواجهة الاعتداءات والعنف الذي قد يتعرض له العمال بصفة عامة، كما قد يلاحظ وجود بعض الأحكام التي تهتم بالجانب الوقائي من الاعتداء أو العنف قبل وقوعه، وعلى نحو مماثل للأحكام التي ينظم الجانب العلاجي للاعتداء أو العنف في حال وقوعه.
وقد حاولت هذه الدراسة البحث في الأحكام الخاصة بمواجهة الاعتداء أو العنف الذي قد يقع ضد المرأة العاملة، ولاسيما من ناحية مدى حاجتها إلى إحكام خاصة بحمايتها في هذا المجال.
Making a labor contract for women may cause different aspects of violence against them such as body or sexual violence inside organizations or outside, for that reasons legislative should protect women and be cautious that these things will not happen.
If you are looking for current legislations you can find some thing about violence against workers in general without mention if it is for women or men, some of them specialized in proactive processes and the others solving problems after happening.
In this study the author try to search in how to find especial legislations for taking care of women in labor.

يشكل اللجوء الملاذ الآمن لكل شخص يعاني اضطهاداً ما، وكان متمثلاً في المجتمعات القديمة في الملجأ الديني، ومع التطور القانوني لمركز اللاجئين أصبح للجوء قانوناً ينظمه ويحكم مسائله المتفرقة؛ حيث يمثل في ضوء هذا التطور فرعا من فروع القانون الدولي.
تدرس هذه المقالة إشكال اللجوء والفرار من العقاب، ما دور دولة الملجأ والمسؤولية الملقاة على عاتقها لتحقيق مبدأ عدم الإفلات من العقاب وهذا في ضوء أحكام القانون الدولي.

تعتبر قضية تلقي المناهج النقدية في النقد العربي الحديث و المعاصر من أهم القضايا التي تطرحها الساحة النقدية لما تتضمنه من عديد الإشكالات على المستويين التأصيلي و الإجرائي
باعتبارالاقتصاد الإسلامي مجموعة الأصول العامة الاقتصادية، التي نستخرجها من القرآن الكريم والسّنّة النبويّة، والبناء الاقتصادي الذي نُقيمُه على أساسا تلك الأصول بحسب كلّ بيئة وكل عصر، وبخلاف الاقتصاد الوضعي الذي انفصل انفصالاً تامًّا عن الدين، فإنّ الاقتصاد الإسلامي يتميّز بارتباطه التامّ بدين الإسلام عقيدة وشريعة، وبناء على ذلك فإنّه لا ينبغي أن ندرس الاقتصاد الإسلامي مُستقلاًّ عن عقيدة الإسلام وشريعته، لأن النظام الاقتصادي الإسلامي جُزء من الشريعة ويرتبط كذلك بالعقيدة ارتباطًا أساسيًّا، فإنّ الدارس لكتابات شيوخ جامع الزيتونة، والقارئ لمؤلّفاتهم، يلحظ عنايتهم الكبيرة بالاقتصاد الإسلامي، لأهمّيته في حياة الأفراد والمجتمعات ولدوره في حماية الأمّة الإسلاميّة وضمان العزّة والمناعة لها.
