Interpretation of Modawana’s problematic words in different ways can be considered one of the most significant reasons behind the disagreement between the Malikite scholars on such issues. This study clearly shows that these interpretations were supported by a number of scientific arguments. It also proves that the last generation of Malikite scholars has exposed them to a serious scientific criticism to choose the most accepted and reliable ones. Le rite malékite est parmi les rites de jurisprudence les plus répandus dans le monde musulman. Il compte d’éminents ulémas et juristes, qui en font la richesse. Grâce à leurs efforts méritoires, le rite connaît une extension remarquable. Par ailleurs, les juristes d’Alexandrie sont parmi ceux qui ont contribué grandement à la propagation du rite et à son ampleur. Ainsi, leurs efforts ont commencé du vivant de l’Imam Malek –que Dieu l’Agrée-. Ils ont été aidés, dans cette vaste entreprise, par les relations qu’ils entretenaient avec les juristes de l’Andalousie et ceux du Maghreb, mais aussi par la fondation des écoles ; ce qui a eu pour conséquence une plus grande extension du rite dans la société alexandrine de l’époque et l’accroissement du nombre des adeptes. Ils se sont illustrés, en particulier, dans les enseignements qu’ils prodiguaient, dans la composition d’ouvrages didactiques et dans la justice. Ainsi, leurs travaux ont porté leurs fruits, grâce notamment à leur bonne foi et à leur sagesse. Ce qui les a conduits à une meilleure ouverture sur les autres rites et écoles juridiques. Ils ont également su construire de bonnes relations avec les sultans et les princes de l’époque. Ce qui nous incite à faire de l’expérience des juriste alexandrins l’objet de la présente étude. This study searches the human values in the prophet Mohammed (Peace be upon him) war’s, values shown in justice when dealing with enemies by never crossing the line when punishing and no attacking of the civilians. In addition to this compassion and virtue when he forbids revenge, abusing enemy soldier’s corpses, and the use of lethal weapons that eliminated the existing life of humans, animals and plants. This study also shows the prophet’s(Peace be upon him) humanity by saving the lives of his enemies in offering them safety by joining Islam. As well as forbidding killing with hunger and thirst, and shows that the prophet (peace be upon him) had honored his enemies dead’s by never living anyone unburied. Le présent papier est une étude d’ordre comparative qui vise, par le biais d’un regard croisé entre la doctrine  islamique et son analogue positive, à jeter la lumière sur la question de l’âge de la majorité pénale dans le dessein de contribuer à enrichir la source matérielle des lois qui gouvernent nos sociétés contemporaines en cette matière, souvent revisitée et engendrant des avis conflictuels. La comparaison de la doctrine islamique avec la doctrine française sur cette question, notamment sur la base des conclusions du rapport, dit rapport du comité André VARINARD, permettrait d’enrichir le discours y relatif, étant donné que ces deux doctrines constituent des amonts pour les lois arabes, en général. This article aims to show the Algerian regulation of  freedom of belief based on the content of the various constitutions and the order No. 06-03 relating to the exercise of religious rites for non-Muslims.
