لقد أسس الشرع الأسرة على اعتبار الحق أحد ركائزها الأساسية ووسيلة لتحقيق مصلحة الطرفين الرجل والمرأة، دون أن يظلم أحدهما الآخر، هذا الحق الذي طالما حرص فقهاؤنا على تأكيده وتمكين كل فرد من الأسرة منه وخاصة المرأة. وإن قراءة في نوازل الأسرة وبخاصة ما تعلق بالمرأة وشؤونها الزوجية، من كتب النوازل والأقضية والوثائق عند المالكية، ليثبت لنا تهافت الدعاوى المغرضة التي تحاول التنقيص من علم ونزاهة علمائنا الفطاحل، وتشويه صورة فقهنا الإسلامي، واتهامه بأنه فقه ذكوري، سنّ مجموعة من الأحكام تصب في مصلحة الرجال على وجه الخصوص، بينما يظلم المرأة ويهضمها حقوقها.
  والوقوف على تلك الفتاوى والأقضية التي صدّرها فقهاؤنا، من خلال كتب النوازل والأقضية والوثائق، فيما يتعلق بقضايا المرأة الأسرية، سيكشف عن النظر الحقوقي الرصين الذي تمتع به فقهاؤنا المالكية في إيجاد الحلول والأجوبة لما يعترض العلاقات الأسرية من مشاكل وعادات قد تهضم الحقوق أو تؤدي إلى تعسف أحد الزوجين في استعمالها، وسيجلي لنا حتما أهمية الأصول الاجتهادية في المذهب المالكي التي يقوم عليها منظوره لقضايا المرأة على الخصوص، وما تمتعت به من وضع حقوقي متميز، منحه الشرع لها وأكده تراثنا الفقهي تطبيقا لمبادئ العدل والإنصاف، واعتمادا على الأعراف المقبولة، ومراعاة مقاصد الشريعة في تحقيق المصالح ودفع المضار عن كل فرد في الأسرة بما فيهم المرأة.
Sharia has established the family, taking into consideration the right as one of its fundamental pillars and as a means of achieving the interests of both men and women, without oppressing each other.Muslim scholars in general and the Maliki have always affirmed this right in particular.The empowerment of every family member, especially women to use their rights. A reading in family new issues and matters especially those relating to women and their matrimonial affairs,in thewriting of the Maliki. Reveals the reluctance of tendentious actions
and subversive theses that attempt to diminish the knowledge and integrity of our scholars, distort the image and justice of our Islamic jurisprudence, and accuse it of being a male jurisprudence, enacting a set of judgment that is particularly in the best interests of men.
Identifying these fatwas issued by the Maliki scholars and the verdicts relating to new issues,
with regard to women's family matters. It will reveal the rigorous human rights consideration
 respected by Maliki scholars in finding solutions to problems of family relations that may interrupt upon rights or lead to abuse by one of the spouses. The importance of jurisprudence in the Maliki doctrine given to women's issues in particular will inevitably be evident to us, and its privileged human rights status, and affirmed by our jurisprudence heritage as far as the principles of justice and equity are concerned. Those principles arepart of the foundations of Islamic law, based on accepted customs, taking into account the Sharia's purposes in the realization of interests and the prevention of harm to everyone in the family, including women.
