لم يَلْقَ فن( تخريج الفروع على الأصول) كبير عناية رغم عظم نفعه وأثره، فهو حلقة وصل بين علمي أصول الفقه والفقه، فلا تتحقق الفائدة المرجوة من أصول الفقه إلا به، ولا يتحقق الفقه الصحيح إلا به. ولم يهتمّ الأوائل ممن خاض غمار التأليف في هذا الفن بالجانب النظري له، واهتمّ بذلك المتأخرون، إلا أن مؤلفات الأوائل تعدّ أولى بوادر استقلال( تخريج الفروع على الأصول) وظهوره، وإن لم يصرّحوا باستقلاله كعلم، ومن هؤلاء: نظام الدين الشاشي الحنفي( من رجال القرن السابع الهجري)، من خلال كتابه(الخمسين). وتسعى هذه الدراسة إلى إماطة اللثام عن شخصية الإمام الشاشي الحنفي، وعن كتابه( الخمسين) المعروف بــــ( أصول الشاشي)، وكذا الكشف عن منهجه في بناء الفروع على الأصول، من خلال مؤلَّفه سالف الذكر؛ مما يثري الجانب التنظيري لعلم (تخريج الفروع على الأصول) الفتيّ، ويبرز أهم الخطوات التطبيقية التي ترسم المنهج الأمثل لعملية إسناد الفروع- بما فيها المستجدات- إلى أصولها.
The science of (Takhrij al-Furu ala al-Usul) linking practical legal decisions to governing legal sources was not given much attention despite its great utility and its impact. It is a link between the science of jurisprudential principles (Usul al-fiqh) and jurisprudence (al-fiqh). Neither jurisprudence nor jurisprudential principles can achieve their objectives unless associated with this science. Early authors in this science did not give much importance to the theoretical aspect, but late authors have started to take interest in it. However, early authors were the first to have marked the independence and emergence of this science, though this demarcation was not explicitly stated by them. Among these authors is Nizam Al-Din Al Shashi Al Hanafi (a seventh century Hijri scholar), through his book (Al Khamseen). This study is an attempt to know about Imam Nizam Al-Din Al Shashi Al Hanafi and his book (Al Khamseen), known as “Al Shashi’s principles” and to identify his approach in linking practical rules to source governing rules (takhrij al-furu ala al-usul), through his book mentioned above. This is liable to enrich the theoretical aspect of this young science and highlight the most important practical steps that set the best approach to linking practical rules including non-precedented cases- with their source rules.
