إن المؤسس الدستوري إعتمد نظام الدفع بعدم دستورية القوانين بموجب القانون رقم 16/01 المؤرخ في 17/03/2016 المتضمن التعديل الدستوري لعام 2016،وهي آلية رقابية وحمائية تكفل حماية الحقوق والحريات الأساسية من مختلف صور انتهاك القوانين لها،وقد ترتب عن استحداث هذه الآلية ضبط ممارستها بشروط وإجراءات مقررة قانونا،عكست تأثر المؤسس الدستوري بنظيره الفرنسي بشأن  كيفية وخصوصية معالجة الجهات القضائية للدفع بعدم الدستورية،بالإضافة إلى إعمال نمط الموازنة بين مبدأ الأمن القانوني وترتيب الآثار  على الحكم بعدم الدستورية بما يضمن عدم إعمال الرجعية الإ وفقا لضوابط تخضع في تقديرها لسلطة المجلس الدستوري حماية للحقوق المكتسبة و للمراكز القانونية السابقة في نشأتها على صدور الحكم عدم دستورية .

لا ندحة في أن اي مجتمع تحركه مجموعة من المؤسسات على اختلاف أنواعها وتركيباتها وأحجامها...غير أن ما يميز جلها أنها تسعى إلى تحقيق التنمية الاجتماعية والرقي بحياة الفرد وتحقيق الأفضل له، ولقد حظيت المؤسسة المتحفية لما تحووه من فنون ورسوم ومقتنيات وتحف أثرية... باهتمام واسع على مختلف المستويات الدولية والجهوية و المحلية في تشكيل شخصية الفرد والحفاظ على هويته. ويفسر ذلك ضربا من الوعي بأهمية دورها في نشر الثقافة والمساهمة في التربية والتعليم والمحافظة على التراث الوطني وتعزيز الهوية الثقافية في عالم لا يعرف الثبات. ويعتبر الطفل ، رجل الغد من الفئات الحساسة في المجتمع والذي يعتمد في تنشئة سلوكه الاجتماعي ورسم وصقل وملامح شخصيته على تكامل ادوار ووظائف العديد من المؤسسات الاجتماعية بداية بالأسرة ثم المدرسة والمسجد،...ويعد المتحف أحدها حيث يسند له الدور التربوي التكميلي للمدرسة وهذا استعدادا لإنتاج الطفل المواطن. ولاستجلاء هذه المهمة الموكلة للمتحف علينا الإجابة على التساؤل التالي: إلى مدى يستطيع المتحف أن يعزز من سلوك المواطنة لدى الطفل؟

Toute société est expédiée par des institutions de toutes sortes, combinaisons et tailles. Cependant, ce qui est si distinctif, c'est qu'ils cherchent à réaliser le développement social et à améliorer la vie de l'individu et à atteindre le meilleur pour lui. Le musée est doté d’un grand intérêt à différents niveaux d'international et régional et même local. car elle englobe : de l'art, du dessins, des objets de collection à travers les antiquités… Ceci explique la conscience de l'importance de son rôle dans la diffusion de la culture, la contribution à l'éducation, la préservation du patrimoine national et la promotion de l'identité culturelle dans un monde en mutation. L’enfant, l’homme de demain, est l’un des tranches les plus sensibles de la société , son comportement social et l’affinement et la caractérisation de sa personnalité, s’appuie sur complémentarité des rôles et fonctions de nombreuses institutions sociales : Partant de la famille à l'école et la mosquée...Le musée est l’institution qui assigne le rôle de l'éducation complémentaire de l'école et la préparation à la production de l'enfant citoyen. Afin d’éclaircir cette tâche du musée, nous devons répondre à la question suivante : dans quelle mesure le musée peut-il améliorer le comportement de citoyenneté chez l'enfant
