 تناولت هذه الدراسة المبادرة الذاتية كمفهوم، ومن ثم الإشارة إلى أهميتها من خلال بيان الرؤية التأصيلية للشريعة الإسلامية لهذا المبدأ، وقد أوضحت الدراسة كذلك أقسام المبادرات من حيث القبول والرد (محمودة أو مذمومة) وذلك نظراً للأثر المترتب عليها إيجاباً وسلباً.
 وتهدف هذه الدراسة إلى بيان موقف الشريعة الإسلامية من المبادرة والدعوة إلى الاتصاف بخلقها والإعلاء من شأنها وشأن القائمين بها، وذلك في جميع المجالات، انطلاقاً من سعة وشمول الدين الإسلامي وتنظيمه لجميع النواحي الإنسانية والحياتية، فليست المبادرة في ما يخص الحياة الدينية فقط، بل حتى في أمور الدنيا وما يرجع نفعه إلى العباد في دنياهم، فمن مقاصد الشريعة الإسلامية جلب المصالح ودرء المفاسد من عمارة الأرض والإصلاح فيها وقطع الفساد ودفعه.
 وتهدف الدراسة كذلك إلى كشف جملة من الفوائد والآثار المترتبة على قيام المبادرات وإحيائها على مستوى الأسرة والمجتمع، وتعويد الأفراد على طرح المبادرات والإعلاء من شأنها لما لها من فوائد ومنافع خاصة وعامة.

تنص المادة 127 من القانون رقم 12/07 المتعلق بالولاية على أن الولاية تتوفر على إدارة توضع تحت سلطة الوالي من أهم هياكلها الكتابة العامة، التي تسير من قبل الكاتب العام للولاية، الذي عرف منصبه العديد من التطورات إلى أن أصبح يعد المساعد الأول للوالي، حيث يشغل دور محوري في تسيير شؤون الولاية بسبب طبيعة منصبه والسلطات الممنوحة له ودورها في التسيير المحلي.

Article 127 of law no 12/07 on the state provides that the state has an administration placed under the authority of the governor, one of the most important structures is general writing, which is run by the state’s public clerk, whose position has known many developments until he is considered the first assistant to the governor, where he occupies a pivotal role in the running of the state, because of the nature of his position, which has a major impact on the general policy of the state, through the powers granted to him and its effects on local administration.
