يهدف هذا البحث إلى توضيح وبيان أنواع المنازعات التي تنشأ بمناسبة الحصول على الدفتر العقاري أو قبل ذلك، خاصة وأن المشرع الجزائري يأخذ بقاعدة إمكانية إلغاء الدفتر العقاري بعد ظهور وقائع جديدة تجيز القيام بذلك، أو رفض تسليم الدفتر العقاري من طرف المحافظ العقاري لطالبه في حالة الشك في المعلومات المقدمة إليه من طرف هذا الأخير، وهو ما يخالف أهم قاعدة في نظام الشهر العيني الحقيقي التي تنص على انتهاء كل المنازعات والشكوك بخصوص العقار بمجرد تسليم الدفتر العقاري لصاحبه، لان الشهر يطهر الملكية، الأمر الذي يخالف المشرع الجزائري باعتماده إلغاء الدفتر العقاري، مما صعب من مأمورية المحافظ العقاري من جهة وزاد من الضغط على جهاز القضاء من جهة أخرى بكثرة المنازعات في هذا المجال .
لذا يسعى البحث إلى بيان ذلك من خلال التطرق إلى المنازعات التي تكون قبل تسليم الدفتر العقاري من طرف المحافظ العقاري وأمامه، والتعرض إلى المنازعات التي تكون بعد تسليم الدفتر العقاري والتي تكون أمام القضاء.
The aim of this research is to clarify and clarify the types of disputes that arise on the occasion of obtaining the real estate or before, especially as the Algerian legislator takes the rule of the possibility of canceling the property ledger after the emergence of new facts that permit doing so. Or refusing to hand over the property book by the real estate governor to his claim in case of doubt in the information presented to him by the latter, which contradicts the most important rule in the real real real month system that states that all disputes and doubts concerning the property are over once the real estate book is handed over to his company. This is because the month disinfectates the property, which contradicts the Algerian legislator by adopting the cancellation of the real estate ledger, which makes it difficult for the governor of the real estate on the one hand and increases the pressure on the judiciary on the other side with the proliferation of disputes in this field.
The research seeks to illustrate this by addressing the disputes that are before the delivery of the mortgage by and before the real estate governor, and exposing disputes that are after the delivery of the real estate and which are before the courts.
