لم يتطرق غالبية فقهاء الشريعة الإسلامية والقانون إلى دراسة آثار عقد الزواج دراسة تفصيلية دقيقة مابين إبرام العقد والبناء، والذي جرى العرف على أن يكون يوم الزفاف، كما أن المشرع الجزائري قد تطرق إلى بعض هذه الأحكام في قانون الأسرة بصفة منفصلة، ولما كانت الشريعة الإسلامية مصدرا لقانون الأسرة فإنه قد استمد أحكام هذه الفترة من الزواج منها، كما أحال ما لم ينص على حكمه إلى أحكامها بموجب نص المادة 222 منه، فبمجرد العقد يملك الزوج عصمة زوجته وتصبح محرمة على غيره، ويحل له منها شرعا ما يحل للزوج بعد الدخول، غير أن الأمر ليس على إطلاقه عند بعض الفقهاء المعاصرين، فليس للزوجة أن تطيع زوجها ما دامت في بيت أبيها، ويعود ذلك لمستجدات وأفكار دخيلة على مجتمعنا الإسلامي الذي ذهبت من بعض أفراده المروءة، وأصبح شائعا عند بعض الأزواج قبل الزفاف الخروج والسفر ويصل الأمر حتى إلى المعاشرة الجنسية قبل توثيق العقد ما يفتح الباب للتنكر له، كما يترتب عن إبرام عقد الزواج استحقاقها للصداق، وكذلك النفقة عند بعض فقهاء الشريعة الإسلامية، وبصفتها زوجة فإنها ترث زوجها عند وفاته قبل البناء وتعتد عدة الوفاة، وللزوج أن يطلق أو يظاهر أو يولي، ولها أن تخالعه، ولهما أن يتلاعنا
