يتناول هذا المقال مساهمة الفقهاء والأدباء بالمغرب الأقصى في نهضة اللغة والأدب من بينهم العلامة محمد المختار السوسي خصوصا في فترة الاستعمار الفرنسي، حيث يعد من أهم المنظرين للاستقلال المغربي من خلال الكفاح في سبيل التحرر، لذلك عمل جاهدا من أجل الرفع من قيمة الأدب واللغة باعتبارهما من بين السبل لتحرير الشعب المغربي من الاستعمار الغاشم.

يتناول البحث موضوع تسعير السلع  في ضوء مقاصد الشريعة الإسلامية من حيث الحكم الفقهي المتردد بين الحرمة والجواز، كما يتطرق إلى حدود سلطة ولي الأمر في فرض التسعير على التجار، وقد وقع الاختلاف بين الفقهاء في حكم التسعير لورود حديث يحرمه وآخر يجيزه، وجاءت هذه الدراسة لدفع التعارض الظاهري بين هذه الأحاديث من خلال بيان السياق الذي وردت فيه وحيثيات الواقع والمصلحة المعتبرة في ضوء مقاصد الشريعة الإسلامية التي جاءت لحفظ أموال الناس باعتبارها أحد الكليات الخمس الضرورية التي اهتمت الشريعة الإسلامية برعايتها وصيانتها، كما أبرز البحث منهج الشريعة الإسلامية في الترجيح بين المصلحة العامة والخاصة بتقديم مصلحة المجتمع على مصلحة الفرد إذا وقع ضرر على عموم المجتمع من غلاء الأسعار. وأوصت الباحثة الجهات الإدارية والتنفيذية في الدولة بضرورة مراقبة الأسواق واستقراء حالة العرض والطلب والسعر والدخل من أجل خلق حالة من التوزان بعيداً عن استغلال الباعة، أو إجحافهم حقهم.

Abstract: The research deals with the subject of pricing commodities in the light of the purposes of Islamic Sharia in terms of the jurisprudential ruling that hesitates between prohibition and permissibility، as well as the limits of the authority of the guardian in imposing pricing on merchants، and this study came to push the apparent contradiction between these hadiths by clarifying the context in which they were mentioned and the merits of reality and the considered interest in the light of the purposes of Islamic Sharia that came to save people’s money as one of the five necessary colleges that Islamic Sharia took care of its care and maintenance، as The research highlighted the approach of Islamic Sharia in weighing between the public and private interest by prioritizing the interest of society over the interest of the individual if harm occurred to the whole of society from high prices.
