إن للحرية الفردية تقدير دستوري، وهي تحظى لأجله بحماية خاصة في مواجهة تعسف السلطة؛ إذ لا يجب تقييدها إلا لضرورة، ولا يجوز سلبها، من حيث الأصل، إلا بحكم جنائي؛ ومع ذلك فإنه لاعتبارات تتعلق بكشف أدلة الجريمة ومكافحتها، يجوز تقييد هذه حرية مؤقتا قبل صدور حكم بالإدانة، كما في حالات القبض على المتهم وحبسه احتياطيا؛ غير أنه لخطورة هذا الأمر، بحسبانه يفرض قبل الادانة، فإن الموازنة بين اعتبارات مكافحة الجريمة، وضرورات صيانة الحرية الفردية، يستوجب تقييد سلطة المشرع في فرض تلك القيود المؤقتة، منعا للتعسف في ممارسة السلطة، فالأمر لا يتعلق بالتعسف في استعمال مكنة التقييد من قبل سلطة التحقيق، وإنما بأساس ممارسة هذا القيد وشروط هذه الممارسة وفقا للقانون. لا شك أن فرض القيود على سلطة المشرع، لا يمكن أن يتحقق إلا من خلال قيود تسمو في قوتها على نصوص التشريع العادي؛ وهو ما يعني أن فرض القيود على سلطة المشرع لا يتحقق إلا بنصوص أسمى، وهي النصوص الدستورية. ولهذا فإن هذه الدراسة تُعنى ببحث الموقف الدستوري من تقييد الحرية قبل المحاكمة بمناسبة دعوى جنائية؛ وذلك ببحث أساس ونطاق هذا التقييد في مطلبين؛ يخصص كل واحد منهما، وفق منهج تحليلي، لدراسة هذا الموضوع وذلك من حيث الأساس وأثره في التطبيق على النصوص.
Individual freedom has constitutional discretion, for which it receives special protection in the face of arbitrary authority. It should not be restricted except out of necessity, in terms of origin, except by a criminal ruling. However, for considerations related to detecting evidence of crime and combating it, this freedom may be temporarily restricted before a conviction is issued; However, due to the seriousness of this matter, balancing considerations of combating crime with the necessities of preserving individual freedom requires restricting the legislator’s authority, to prevent abuse of power. There is no doubt that imposing restrictions on the legislator’s authority can only be achieved through restrictions that exceed in their strength the texts of ordinary legislation. These are constitutional texts.
