لا مراء في أن المنازعة الانتخابية تعد انعكاساً للمراحل التي تمر بها العملية الانتخابية، فهي تشمل جميع الأعمال المادية والإجراءات القانونية الممهدة للانتخابات، والمرتبطة بسير العملية الانتخابية، انتهاءً بفرز الأصوات وإعلان النتائج؛ لهذا فقد سعى البحث إلى محاولة الفهم الدقيق للمنازعات الانتخابية والطعون الواردة عليها من خلال تحليل نصوص القانون رقم 1 لسنة 2021م بشأن انتخاب رئيس الدولة، لإبراز دور الرقابتين الإدارية والقضائية على العملية الانتخابية، وبيان الإجراءات المتبعة من قبل ذوي الشأن لتقديم الطعون، والجهات المختصة بنظرها. وقد خلص البحث إلى أن الطعون الانتخابية تعد الأداة الفاعلة في إضفاء المشروعية على الانتخابات العامة بما تتضمنه من تصحيح أو تعديل وصولاً إلى تحقيق العدالة الانتخابية المنشودة، لاسيما وأن الدولة الليبية مقبلة على انتخابات رئاسية لأول مرة في تاريخيها. مما يستدعي وضع نظام قانوني دقيق وشامل للطعون الانتخابية يمتاز بالبساطة وسرعة البت فيها استنادا إلى نصوص قانونية واضحة تضمن تلافي المشاكل والثغرات التي شابت القانون رقم 1 لسنة 2021م.

There is no doubt that electoral disputes are a reflection of the stages that the electoral process goes through. Therefore, the research sought to accurately understand electoral disputes and the appeals against them by analyzing the texts of Law No. 1 of 2021 AD regarding the election of the President of the State. The research concluded that electoral appeals are an effective tool in granting legitimacy to general elections, including the correction they include, especially since the Libyan state is about to hold presidential elections for the first time in its history. This requires the establishment of a precise legal system for electoral appeals to ensure that the problems that marred Law No. 1 of 2021 are avoided.
