تظهر أهمية عقد المزارعة في كونه من العقود التي تحافظ على الوقف إذا كان أرضا زراعية، فتساهم في بقاء منافعه للجهة التي حبس لأجلها، ودوام أجره للحابس، كما تكون مصدر خير للمزارع في الدنيا، فتغنيه عن السؤال وتخرجه من البطالة، وتجعل منه فردا منتجا، لا فردا عاجزا كسولا يكون عبء على أهله ومجتمعه، كما تكون مصدر أجر له.
احتقل فقهاء الشريعة الإسلامية في طبيعة عقد المزارعة وفي مشروعيته اختلافا كبيرا، مما يجعل الباحث يتساءل: ما المذهب الذي أخذ به المشرع الجزائري في المزارعة؟ وما التكييف الذي ينطبق عليها في القانون الجزائري؟ وما الآثار التي ترتبها في ذمة الطرفين؟ وما الدور الذي تلعبه في استثمار الأراضي الوقفية الزراعة؟
اكتفى المشرع الجزائري في قانون الأوقاف بتعريف عقد المزارعة، دون ذكر ما بقي من أحكامها، وكان من اللازم أن تفصل أحكام هذا العقد، أو يشار إلى تطبيق أحكام عقد معين عليه، كعقد الإيجار أو عقد الشركة، كما ذهب إلى ذلك الفقهاء ونصوص بعض التشريعات العربية.
The farming contract maintains the waqf if it is agricultural land, it contributes to the survival of its benefits to the person benefiting from this land, and the permanence of his wages for the endowment giver, it will also be a good source for the farmer in his life, it helps him to earn his living, and make him a productive person, not a lazy one. it will also be a source of good for him.
In the law of endowments, the algerian legislator was satisfied with defining the farming contract, without mentioning the rest of its provisions, and it was necessary to detail the provisions of this contract, or to refer to the application of the provisions of a specific contract to it,  as the lease contract or the company contract, as the islamic jurisprudents and the texts of some arab legislation went to.
