استقلالية القضاء في الجزائر.. تكريس دستوري أم إجحاف قانوني؟

يرتبط موضوع السلطة القضائية بمبدأ استقلالية القضاء وتحرر القاضي من أي ضغط أو تدخل من أي سلطة أخرى، ولا سلطان عليه إلا القانون وضميره المهني.
يرى المراقبون في مجال القانون، أنه لا مجال للحديث عن قضاء مستقل، ورئيس الجمهورية هو رئيس المجلس الأعلى للقضاء، ونائبه هو وزير العدل، وأن أغلب أعضائه يعينهم هذا الرئيس .
إن المنصب الذي يشغله رئيس الجمهورية يمنح له سلطات واسعة في تنظيم المسار المهني للقضاة، بدء من سلطته في تعيين القضاة، والحركة السنوية التي ما فتئ إن يقوم بها سواء بـ: (إحالة القضاة على التقاعد، العزل، النقل..) .
إن قانون رقم 04/11 المتعلق بالقانون الأساسي للقضاء، عهد لوزير العدل سلطة إحالة ملف الدعوى التأديبية للقاضي على المجلس الأعلى للقضاء، ومنحه حق توقيع عقوبة الإنذار.
 إن هذه الدراسة جاءت بغرض تسليط الضوء على مدى استقلالية القضاء في ظل التعديل الدستوري لعام 2016 وما هي المحددات القانونية والتنظيمية المنوط بالقاضي مراعاتها أثناء أدائه لوظيفته.؟
The subject of the judicial authority is related to the principle of the independence of the judiciary. The judge is free of any pressure from any other authority and has no authority other than the law and his professional conscience.
According to observers in the field of law, there is no raison for talking about an independent judiciary. The president of the republic is the president of the Supreme Council of the Judiciary. His ad joint is the minister of justice and most of his members are designed by this president.
The position held by the President of the Republic gives him wide powers to regulate the professional course of judges, starting with his authority to appoint judges, and the annual movement he has been carrying out, whether by: (referral of judges to retirement, segregation, transportation...).
Law No. 04/11 on the Basic Law of the Judiciary provides the Minister of Justice the authority to refer the disciplinary case of the judge to the Supreme Council of the Judiciary and to sign the warning.
This study is intended to highlight the independence of the judiciary under the constitutional amendment of 2016 and what are the legal and regulatory determinants that the judge is required to observe in the performance of his job.?
