تمثل التصرفات القانونية منطلق النظم القانونية في تحريك قواعدها القانونية لتحقيق استقرار المراكز القانونية، وقد نظمت المدونات المدنية على اختلاف الأنظمة القانونية حكم التصرفات القانونية للمريض مرض الموت دون أن تعرض لماهية مرض الموت ذاته، بل تركت المجال أمام الاجتهاد الفقهي والقضائي ليحدد ماهية مرض الموت، على نحو لم يغلق معه باب الاجتهاد خاصة في ظل ما يستحدث من أمراض وجوائح يمكن أن تدخل تحت مفهوم مرض الموت، ومن ثم فان البحث عن مدى اعتبار جائحة كوفيد 19 من قبيل مرض الموت وان كان لن يؤثر على التنظيم القانوني لتصرفات المريض مرض الموت، إلا أنه سيفتح الباب ويوسع من نطاق التصرفات التي قد تبطل حال ممارسة المريض بالكوفيد أي من التصرفات التي قد تمس حقوق الغير، فالظرف الصحي سيؤثر على استقرار المراكز القانونية بشكل كبير.
 
يُعتبر المبنى المدرسي من أهم أساسيات العملية التعليمية، ومن أهم عوامل نجاحها، وزيادة مستوى التحصيل العلمي لدى التلاميذ، لأنه يمثل الوعاء الذي تتفاعل بداخله كافة عناصر العملية التربوية والتعليمية من حصص تعليمية ونشاطات ترفيهية وإدارة مدرسية، وعلاقات اجتماعية بين جميع الفاعلين في العملية التربوية بمختلف تصنيفاتهم. ولا يمكن أن تقوم العملية التعليمية بشكلها الصحيح دون الاهتمام والعناية بالمكان الذي ستتم فيه هذه العملية من جميع الجوانب: بدءا بالتصميم والبناء ثم التجهيز، وهذا كله له أثره النفسي على نفسيات التلاميذ الذين يقضون ساعات كبيرة من النهار في هذا المكان، بالإضافة إلى تأثيره على بقية العاملين في المدرسة من معلمين وأساتذة، وإداريين وغيرهم. لذلك وجب إعادة النظر في مباني المدارس، بوضع الخطط الجديدة لإنشائها وفقاً لمعايير الجودة العالمية والمقاييس التربوية الحديثة، بما يتيح قدرا كبيرا من الراحة النفسية للتلاميذ من جهة ويتواكب مع احتياجات التعليم ومتطلبات العصر من جهة أخرى. ومن هذا المُنطلق جاءت هذه الورقة ضمن هذا المحور الخاص بالمرافق المدرسية و الإصلاحات التربوية لتسلط الضوء على بعض الجوانب الأساسية من هذا الموضوع، مع الإشارة إلى أهم الإشكالات التي تعاني منها المنظومة التربوية في الجزائر.
The school building is considered as the fundamental element in the educational process and one of the most important factors of its success and of the increase in the level of knowledge acquisition, since it represents the recipient in which all the elements of the educational and didactic process interact, including educational sessions and recreational activities, administration and social relations between all the actors of the educational process. The educational process cannot take place without considering the place in which it takes place, in all its aspects, starting with design, construction and equipment. All this has an impact on the psychology of the students who spend long hours in this place, in addition to its impact on the rest of the people: teachers and administrators. Consequently, school buildings must be reconsidered, developing new plans to implement them in accordance with international quality standards and modern educational models, in order to allow, on one hand, a psychological comfort of the students, and on the other hand, to be attentive to the educational needs and current requirements. From this viewpoint, this article is in line with school equipment and educational reforms in order to shed light on certain fundamental aspects of this subject, with reference to the most important problems from which the education system in Algeria suffers.
