التقاضي امام محكمة العدل الدولية هي الهيئة القضائية لمنظمة الامم المتحدة وجهازها الوحيد بين اجهزتها الستة ومقرها( لاهاي-هولندا) بدأت بالعمل عام 1946 ولها نشاط قضائي طبقاً لأحكام القانون الدولي في الفصل في النزاعات بين الدول اضافة الى وظيفتها الاستشارية في الفتوى التي تطلب منها من هيئات الامم المتحدة والوكالات المتخصصة وشهدت نشاطاً متميزاً في الثمانينات وتتألف من 15 قاضياً يتم انتخابهم من الجمعية العامة للأمم المتحدة ومجلس الامن الدولي لمدة 9سنوات.
كل الأشخاص لهم الحق في الحياة وتمضية أوقات سعيدة متمتعين بالهدوء والاسترخاء في الطبيعة لا سيما المساحات الخضراء التي تتمتع ببالغ الأهمية وتتميز بالدور الفعال فيالترفيه عن الأفرادوتنقية الجو ودعم التوازن البيئي، ولها أثر جيد خاصة على الطفولة التي يجب أن تحظى بالحماية والرعاية اللازمة في سبيل تحقيق النمو الذهني والجسمي السليم وتطوير الحالة النفسية والفكرية لها. ونظرا لأهمية هذه الأخيرة يتطلب منا الأمر إلقاء الضوء عن كثب على نظامها القانوني بصفة عامة، موضحين أهميتها القانونية والاجتماعية والصحية والبيئية وأثرها المنعكس على مختلف المجالات، إضافة لتبيان معايير اختيار المساحات الخضراء وطبيعتها القانونية وكذا طرق تسييرها وتصنيفها والجهة المختصة بذلك، كاشفين في نفس الوقت ما لم يتم احترامه وتطبيقه وما يشكل نقصا فيه لإعادة القيمة الحقيقية للمساحات الخضراء ودورها الفعلي في رعاية وخدمة الطفولة. الكلمات المفتاحية: التشريع الجزائري، الطفل، المساحات الخضراء، رعاية الطفولة
Résume Tous les gens ont le droit de vivre, d’avoir et de passer des heures heureuses en se calmant et se reposant dans la nature; surtout dans les espaces verts qui sont beaucoup plus très éfficaces et très serviables pour l’enfance qui doit être protégée et bien respectée par les autres surtout dans ces dits espaces. Ces derniers qu’on-y doit jeter un coup d’œil sérieux pour savoir leur encadrement juridique et ce qui n’est pas bien appliqué, ainsi que ce qui est vraiment manquant pour lui rendre sa valeur et son véritable rôle pour aider l’enfance et la servir de tout ce qu’il faut.
