هدف البحث إلى تحديد مدى وعي العاملين في مجال التربية الخاصة بمفهوم الذكاء العاطفي في مدينة مكة المكرمة، من خلال معرفة تصوراتهم عن مفهوم الذكاء العاطفي، ومعرفة أثر الذكاء العاطفي فيهم. إضافةً إلى فتح المجال للعاملين في مجال التربية الخاصة من أجل تقديم مقترحاتهم التي تساهم في تنمية الذكاء العاطفي من وجهة نظرهم.
واتبع هذا البحث المنهج النوعي لتحقيق أهدافه، كما استعان بالمقابلة شبه المنظمة أداةً رئيسية لجمع البيانات من عينة البحث المستهدفة، التي تكونت من (6) معلمين واختصاصيين عاملين في مجال التربية الخاصة بمدينة مكة المكرمة. وتوصل البحث إلى عدة نتائج أبرزها: أن الذكاء العاطفي غير مفهوم كمصطلح بحد ذاته، ولكن ارتبط بمفاهيم أخرى تندرج تحت أبعاد الذكاء العاطفي كما ذُكر في نظرية جولمان وبار-اون.
كما بينت النتائج أنه من الممكن العمل على رفع مستوى الأداء الوظيفي ورفع كفاءة المنظمة من خلال الدورات التدريبية والورش للتقدم والحصول على مناصب عليا ولخلق بيئة عمل فعالة ومستقرة.
كما وضحت النتائج أن مهارات الذكاء العاطفي تساعد في زيادة قدرة العاملين في مجالات التربية الخاصة على التعامل مع الأسر بمختلف توجهاتهم وثقافاتهم واحتوائهم، والعمل على تغيير نظرتهم السلبية لأبنائهم وقدرتهم على العمل تحت الضغط، وحل المشكلات التي يواجهونها بطبيعة الظروف الموفرة لهم في بيئة العمل. وبينت النتائج أيضًا أن مهارات الذكاء العاطفي لدى العاملين في مجال التربية الخاصة مكتسبة لطبيعة تعاملهم مع ذوي الإعاقة.

تهدف العقوبة إلى إصلاح وتأهيل الجاني كهدف مستحدث تسعى السياسة العقابية الحديثة إلى تحقيقه فلم يعد الوصول إلى ردع الجاني كاف لإصلاحه، مما اقتضى تغيير وتطوير نوع العقوبات الموقعة عليه بعدما اثبتت العقوبة السالبة للحرية تعارضها وهدف السياسة العقابية، وهو ما أدى إلى تبنى عقوبات بديلة عنها يمكنها إصلاح وتأهيل الجاني وإعادة إدماجه في المجتمع، وهو ما تسعى إليه السياسة العقابية من خلال تبنيها لعقوبة العمل للنفع العام نظرا لدورها الفعال في الإصلاح والتأهيل وهو ما أخذ به المشرع الجزائري بوجب القانون رفم: 09-01 المؤرخ في: 25 فيفري 2009 المعدل والمتمم للأمر رقم: 66-156 المؤرخ في: 08 جوان 1966 المتضمن قانون العقوبات.

The punishment aims to reform and rehabilitate the perpetrator as a new goal, The modern punitive policy aims to achieve it ,The deterrence of the perpetrator is no longer sufficient to repair it, which required changing and developing the type of penalties imposed on the perpetrator after the negative punishment of freedom proved to be opposed and the goal of the punitive policy, which led to the adoption of penalties ,alternatively it can reform and rehabilitate the perpetrator and reintegrate him into society, which is what the punitive policy seeks by adopting the punishment for work for the public benefit due to its effective role in reform and rehabilitation ,which is what the Algerian legislator has taken according to law no: 09-01 of25 February 2009 modified and completed decree no: 66-156 of 08 June 1966 containing the penal code.
