يعد عصر الولاة في الأندلس من العصور الأساسية المهمة في تاريخ الأندلس, لأنه يمثل الفترة الأولى التي دخل فيها المسلمون إلى هذه البلاد واستقروا بها, وأسسوا كيانهم السياسي والعسكري والإداري, الذي استمر حوال ثمانية قرون, رغم تلك الفترة القصيرة التي قامت عليه كافة التنظيمات السياسية, طيلة الوجود الإسلامي في الأندلس, علاوة على أسس النظم الإدارية التي جرت بمقتضاها الأمور بعد ذلك, فضلاً عن تلك الجهود العسكرية العظيمة, التي قاموا بها فيما وراء البرتات, وفي خلال تلك الفترة ظهرت الولايات النصرانية الإسبانية في شمالي غرب الجزيرة وشمالها, علاوة على نشأة العداوة بين العرب والبربر, وكل تلك ظواهر تاريخية ذات آثار ومضاعفات تاريخية باقية, وستكون دراستنا لهذا العصر مقتصرة على التنظيمات والنشاط الإداري في الأندلس الذي يمثل الركيزة الأولى التي قامت عليها مختلف التنظيمات العسكرية والإدارية التي حددت المجتمع الأندلسي وطبعته بطابعها الذي استمر طيلة وجود المسلمين في الأندلس, وأسهم في تطور الفكر العسكري والإداري لهذه البلاد, التي شهدت قيام أرقى حضارة إنسانية في ظل المسلمين.
وقد شكل تاريخ الأندلس مادة اهتم بها كثير من المؤرخين في مصادرهم التي تناولت أحداثه التاريخية, وبحثنا التنظيمات والنشاط الإداري والعسكري في الأندلس خلال عصر الولاة (92-138ه/711-756م), هو محاولة لإظهار ما كتبه المؤرخين عن هذه الفترة المهمة من تاريخ عصر الولاة وخاصة في الجانب العسكري والإداري

إنّ كل من الفقه والقضاء أقدما على العديد من المحاولات للاعتداد بالكتابة الإلكترونية كدليل إثبات من خلال التوسع في الاستثناءات والثغرات التشريعية المنصوص عليها ضمن القواعد العامة حماية لحقوق المتعاملين بها، غير أن الاعتراف بحجيتها الكاملة في الإثبات أثار التساؤل حول ماهية قواعد الإثبات العامة التي تتيح امكانية الاعتداد بالكتابة الإلكترونية أمام القضاء؟ وإلى أي حد يمكن الاعتماد عليها؟، ومن خلال البحث في محاولات الفقه والقضاء الجاهدة للاعتداد بالكتابة الإلكترونية كدليل إثبات استنادا على بعض القواعد العامة، تبين بوضوح قصور هذه القواعد عن استيعاب امكانية تطبيقها على الكتابة الإلكترونية، وتعذر منحها الحجية القانونية الكاملة مقارنة مع الكتابة على الورق، وذلك نظرا لطابعيهما المختلفين، مما استلزم ضرورة التدخل التشريعي لتعديل القواعد التقليدية العامة للإثبات بالكتابة لتتوائم مع شكلها الإلكتروني المستحدث.

Doctrine and jurisprudence have repeatedly tried to admit electronic writing as a means of proof, broadening the legislative exceptions of the general rules to protect the rights of operators. However, the recognition of all its value as evidence raises the question of the notion of general rules that allow for the possibility of considering electronic writing before the judge and up to what limit can it be admitted? And by researching in doctrine and jurisprudence the attempts to recognize the electronic writing as a means of proof on the basis of the general rules one discovers clearly the limits of the applicability of these rules on the electronic writing, and the impossibility to give it the full legal value of writing on paper, because of their differences which necessitated the importance of legislative intervention for the amendment of the general traditional rules of evidence in writing so that they adapt with the electronic form.
