شهد العالم خلال السنوات الأخيرة قفزة نوعية في مختلف مجالات الحياة نتيجة التطور التكنولوجي الذي أقدمت عليه الشعوب والأمم، بعد دمقرطة إستخدام الشبكة العنكبوتية التي غيرت نمط حياة الأفراد بشكل جذري، فكان التعليم عن بعد، والإستهلاك في مختلف أشكاله عن طريق الوسائط الإلكترونية، بل والتداوي عن بعد. وبطبيعة الحال لا يمكن للفرد أن يستفيد من هذا النوع من الخدمات والمنتجات إلا بعد أن يدرج بياناته الشخصية على منصات إفتراضية، هذه الأخيرة التي أثبتت الوقائع بأنها ليست في مأمن من الإختراق والقرصنة، حيث تهدف بعض الجهات إلى وضع يدها على هذه المعلومات من أجل تحقيق أهداف غير مشروعة مثل النصب والإحتيال، أو إنتحال الصفة.
تهدف هذه الدراسة إلى تسليط الضوء على مفهوم البيانات الشخصية التي يتم توظيفها في إطار الفضاء الإفتراضي من خلال الرجوع إلى المواقف التي ثبت عليها أعضاء المجتمع الدولي في مختلف الإتفاقيات الدولية ذات الصلة، وكان من أهم النتائج المتوصل إليها محدودية الحماية المقررة لهذا النوع من البيانات في الفضاء الإفتراضي نتيجة ضعف التحكم الذي تحرزه السلطات الوطنية على هذا النوع من الأبعاد بغض النظر عن درجة تطورها من عدمه.
In recent years, the world has witnessed a qualitative leap in various fields of life as a result of the technological development made by peoples and nations, after the democratization of the use of the Internet, which has radically changed the lifestyle of individuals. This make happend the distance education, consumption in its various forms through electronic media, and even distance medication.Of course, an individual can only benefit from this type of services and products after he inserts his personal datas on virtual platforms, the latter of which have proven facts that they are not safe from hacking and piracy, as some parties aim to get their hands on this information in order to achieve Unlawful goals such as fraud, and theft, or impersonation. This study aims to shed light on the concept of personal data that is employed within the virtual space by referring to the positions that the members of the international community have proven in the various relevant international agreements, and one of the most important findings was the limited protection established for this type of data in space. The default is a result of the weak control that local authorities have over this type of dimension, regardless of their degree of development or not.
