إنّ المتأمّل في فقه االخلاف ومسيرته في التاريخ الإسلامي، تتجلى له كيف كانت نشأته من مناظرات الفقهاء للتعرف على الرأي الأهدى، وتقليص شقة الخلاف بينهم، ثم تنامت الكتابة فيه فدونت الموسوعات الفقهية المقارنة وأسهم في بنائها مختلف الفقهاء، من كل المذاهب الإسلامية، وسعوا لإقامة دعائم الفقه المقارن على أساس الحجة والدليل وابتغاء الوصول إلى الحق فيما اختلف فيه، وسيلتهم في ذلك الموسوعية والموضوعية. ولقد كان الإمام السالمي نموذجا للعالم الضليع والموسوعي المقتدر، وإن تراثه العلمي شاهد على خصاله ويعتبر كتابه "المعارج" نموذجا طيبا للفقه المقارن المتسم بالموضوعية إلى حد كبير، مع ما اصطبغ به من مسحة أدبية جعلت قراءة كتابه لونا من المتعة تنعش القارئ، كما يعد كتابه "المعارج" كتاب فقه مؤيد بالدليل الشرعي والعقلي يعج بالقواعد الأصولية والفقهية والمقاصدية، فيه ظهرت براعته وملكته الأصولية، ونتيجة منطقية وميدانا تطبيقيا لكتابه الأصولي "طلعة الشمس"، لأن هذا الأخير ألفه الإمام قبل تأليف كتابه الفقهي "المعارج"
Those are some hints About The comparative Jurisprudence, It’s presented to us how it was grown up with experts debates to notice the appropriate opinion, and reducing the disputes between them, then many writes and comparative Jurisprudence encyclopedias appeared after that, the thing that helped in building different experts from different ideologies in this field, and they helped in making the Jurisprudence supports and crutches that based on profess and evident in order to reach the truth that was disputed about. It showed us how ESALIMI was the example of the honest scientist, and his knowledge is the biggest evident of his behaviors. His book “ELMAARIGE” is considered as a good example to the comparative Jurisprudence that is characterized by the subjectivity with the Literary character that makes the book more Acceptable by the reader, also this book “ELMAARIGE” in considered as a spiritually and mentally proved, it’s full of Jurisprudence rules.
