لعفو المجني علیھ في عقوبة السرقة أثره المعتبر؛ فھو في الفقھ الإسلامي یحول أحیانا دون وصول قضیة ّ السرقةللقضاء أصلا. وأحیانا أخرى یحول دون تطبیق العقوبة، والشرائع تختلف في ذلك سعة وضیقا. فالتشریع الجنائيالإسلامي اعتبر المجني علیھ ھو المسروق منھ، وبالتالي السرقةاعتداء على حق خاص قبل وصول الدعوى إلى القضاء،وبعد وصولھا تتحول إلى اعتداء على حق عام یغلب فیھ حق الله (الحق العام) على حق العبد (الحق الخاص)وقانون العقوبات الجزائري اعتبر الدولة كممثل للجماعة ھي المجني علیھ ابتداء وانتھاء، وھذا الاختلاف أثمر نتائجمختلفة شرعا وقانونا.والفقھ الإسلامي بواقعیتھ مثال لتشریع ھو في الحقیقة ملاذ للبشریة، وموئل لأھل العدل من النّاس فھو لم یلغ حقالمسروق منھ -المجني علیھ رأسا- في العفو، بل منحھ حق العفو عن ّ السارق لكن في زمن لا یتجاوزه، فإذا تعداه ولمیعف، أصبح العقاب حقا للدولة لا مناص من تنفیذه بشروطھ الشرعیة المعتبرة تغلیبا لحق الله المعروف بالحق العاموالذي لا یحق لأي أحد إسقاطھ، أو الإبراء منھ، أو التصالح علیھ ؛ فیمكن القول ّ إن التشریع الإسلامي اعتبر الحقالخاص واعتبر الحق العام؛ ففي بادئ الأمر اعتبر الحق الخاص حتى إذا لم یغتنمھ صاحبھ فات عفوه وتلاشى، واعتبرالحق العام بعدھا اعتبارا لا فكاك من ترتب الحقوق المتعلقة بھ، بینما أوغل التشریع الجزائي الجزائري في المثالیة وھذاوأن لا عبرة ّ بإلغائھ حق المجني علیھ أي المسروق من بالكلیة، واعتبار ّ أن السرقة وقعت على الھیئة الاجتماعیة ككل، ھلعفو المسروق منھ بالمرة
The victim's pardon in the punishment for theft has a significant effect; In Islamic jurisprudence,it sometimes prevents the case of theft from reaching the judiciary. At other times it prevents theapplication of the punishment, and the laws differ in this capacityIslamic criminal legislation considered the victim to be the one who was stolen from him, andthus theft is an assault on a private right before the case reaches the judiciary, and after its arrivalturns into an assault on a public right in which the public right prevails over the private rightAnd the Algerian Penal Code considered the state as the representative of the group as the victim,and this difference yielded different results
