أضحت ظاهرة تجنيد الأطفال في تزايد مستمر خاصة مع توسع دائرة النزاعات المسلحة الغير دولية التي تشهدها الكثير من المناطق في الآونة الأخيرة لا سيما اليمن وسوريا وليبيا أو تصدير الأطفال إلى مواقع داعش للمساهمة في عمليات القتال، لذا أخذو وصفين الضحية والمتهم، وقد أدّى ذلك إلى بروز التباس في النظامين القانوني والقضائي الدوليين، يتراوح ما بين الحماية القانونية التي أقرتها معظم الاتفاقيات والمواثيق الدولية وبين تحميلهم للمسؤولية الجنائية عن الجرائم الدولية التي يرتكبونها خلال مشاركتهم في العمليات القتالية، وتعد ليبيا اليوم وهي من الدول المغاربية واحدة من أكثر الدول التي ارتكب فيها ومازال الأطفال المقاتلون المجازر، وأمام كل هذه الصور السلبية فإن العالم مطالب بالالتزام بتقديم حماية أكبر لهؤلاء الأطفال، فظاهرة تجنيدهم واستخدامهم في النزاعات المسلحة لم تعد تشكل تهديدًا فقط لحياتهم ومستقبلهم والتي تخلق منهم جيلا ضائعًا مشوهًا يعانى من الآثار الجسدية والنفسية والعزلة الاجتماعية، بل أصبحت أيضًا تشكل تهديدًا للمجتمع الدولي ، من حيث خلق جيل يتسم بالعنف والعدوانية لم يتعلم شيئًا من مهارات الحياة سوى العنف والجريمة ولا يجيد عمل شيء سوى القتال
