تناولنا خلال هذا البحث مبدأ مسؤولية الدولة المدنية عن العقوبات السالبة للحرية وأساسها القانوني، وتبين إنه لا مجال لإنكار مسؤولية الدولة عن ذلك، لإن الدولة وإن كانت مكلفة بتوفير الحماية الاجتماعية للمجتمع، إلا إنها لا بد أن تمارس تلك السلطة بإشد المحاذير، لئلا يصاب الافراد بأي ضرر. وإذا ما أثبتنا مسؤولية الدولة عن تعويض المتضرر من الاضرار الناشئة عن العقوبات السالبة للحرية، فعلى أي أساس نقيم تلك المسؤولية، وبعد أن بينا أنه لا يمكن الاستناد الى نظرية الخطأ المرفقي، وتبين إن الأساس الأرجح ووفقاً لمبدأ الفصل بين السلطات الذي أقره دستور جمهورية العراق لعام 2005، هو إقرار مسؤولية كل سلطة على حدى، وإن بإمكان المتضرر إٌقامة الدعوى على كل سلطة على حدى، وتكون مسؤوليتها موضوعية عن الأفعال الضارة التي تلحق بالفرد ضرراً مادياً وأدبياُ.  ومِن ثَم بينا أمام من تقام تلك الدعاوى، وفي أي محكمة من خلال عرضها على اللجنة القضائية المختصة، ويتم تقدير التعويض نقداً، ويجوز وحسب ظروف الحال أن يتم الحكم بتعويض أدبي، كالنشر في الجرائد والمجلات. تم انهاء بحثنا وتضمن ما توصلت أليه الدراسة من نتائج وتوصيات ونأمن من المشرع العراقي وضع نصب عينه عند تشريعة القانون الخاص بتعويض الاضرار الناشئة عن العقوبات السالبة للحرية.
 
In this paper we present the results of a Monte Carlo simulation of the effects of neutron evaporation on the angular and energy dispersions in neutron-rich nuclei as a function of the mass number A, the kinetic energy E and the number of emitted neutrons. We based our simulation on the assumption of an isotropic random distribution for the neutron emission angles in space and on a Maxwell-Boltzmann distribution for the kinetic energy of the evaporated neutrons. Our results confirm large angular and energy dispersions for light, low-energy nuclei and for high neutron channels.
